Is this a 129 really ? Is it an H1 petition ? AFAIK your I140 is approved right ?

Anyways, I am not sure what this message means. I googled for it (the full message quoted) and only got a couple hits, not very encouraging but I thought I should give you the info I found. It is mostly on this LONG thread:

thanks for reply. i want to clear that this is not my case but it is my sister's case. she came on b1-b2 visa then in december 2001 we filed intra comapny transger visa (L-1) for her, she got approval for that case in may 2002 the status was valid for one year, then we filed extension in may 2003 she got rfe in aug 2003, our lawer replied for that in nov 2003. now after almost 1 year we saw this message " this case was transferred to our administrative appeals office for review. that office will notify you of any further action taken on this case...".... i would like to inform you that we applied for i 140 in june 2003 after we applied for extension. till today the message for i 140 is same and shows that they are processing the case .... i dont know that what this means?

Hi again rbv,

in the extense thread I pointed to, I think there are a few case like this. People get transferred to AAO without a prior case denial ( In principle you would get to AAO if your case gets denied and you decide to appeal). But I couldn't find a resolution to these cases. maybe if you read the whole thread ...

Also, another possibility is to call the USCIS 1800 number and see what they have to say

What does the lawyer think at this point ????

One more thing, did she apply for I485 at the same time as she sent the I140 in ? Does she have EAD ? I am thinking whether she has valid status anyways from the GC application itself ...

as far as in this case she has not filed her 485 or her ead. our lawyer said that the petetions for 129 and 140 were pending and uscis has not denied it yet, so she is not out of status as far. the message changed yesterday so after that we were not able to talk with lawyar but last week when we talked with him he told to file her ead and 485. so do you think that this can be done after this change of message? is it so that if a case has been transferred to aao the chances of denial increases? what do you think should be best in this case? can you help us to get good out of this?

i am really short of time with something extremely important waiting. I wish I was an expert and I could really help. But this is the best I can think of: I would right away file I-485, EAD and all that crap . Something like, now. This would be based on the I-140, which is not under any problem right now. I think that the I-140 application itself gives her status but I am not sure. I see no reason not to go further with the I485 at this point, it could only help IMHO ....

Hi, Added my info to the tracker.
I also restored the instructions in the heading. Copied and pasted from another posting, but used most recent tracker to post!
I also worked on the formatting to try to restore the original. If you guys don't like it please replace with previous tracker. I did not alter any information, only the spacing and also formated all dates as xx/yy/zz. Nothing to fix misalignement of unapproved cases, as you know, they will get properly aligned when put in bold after approval! The only solution I can think of is to put in bold only the approved dates in the approval column. I can do that if you want.

This is a great idea: or even better, how about we put bold from the
approval date on (including the names, it is just two columns). Also, we have to get rid of the smilies, there is a limit on the number of smilies per post, and not everyone can use a smilie, this is unfair ;)

If you have time to do it is would be wonderful (anyway you want)

Hi mendieta and all,

There is now a consolidated tracker for 140/485 VSC http://immigrationportal.com/announcement.php?f=158&announcementid=59

I noticed that only a few of the EB1 cases are represented and I was surprised that most of the info collected here is not included.

They are tracking all 140/485 simultaneously in a very nice excel spreadsheet that does a number of useful calculations. The data is sorted and color coded by EB category, so that we can still know how things are progressing for a given EB classification. There are actually two trackers, one for 2003 another for 2004. All the individual trackers in the VSC forum have been closed in the last month and moved to the consolidated one, except this one (for example look at the last post in http://boards.immigration.com/showthread.php?p=947789#post947789)

Mendieta, since it's your thread, do you think it would be a good idea to consolidate the data from this EB1 tracker with the other tracker as well and that all future updates ought to be done there instead?

LUD changes

I had 2 LUD changes to my (and my wife's) I-485 applications today. As I've NEVER had an LUD update since the initial filings in 2002, this is newsworthy to me :D

The message now says fingerprint review recd. and processing has resumed. Since I haven't heard anything about my I-140 yet, I'm not really expecting anything.

Regarding joining or not the consolidated tracker. First of all, I think we should do whatever everyone likes, I opened the thread but lots of folks maintain it.

Here are my thoughts:

* Ether way is fine with me (close this one and join the other one, or keep going like we did until now)

* We should not duplicate efforts: that is, we should do one or the other

* Ideally, immigration.com would provide a web interface to a database for this sort of tracking. I thought something along these lines was being implemented but it hasn't happened so far. The initial idea was to maintain this thread until the real tracker was built.

* One PRO of maintining this that it is EB1-OR specific, and many of the discussions and timeframes are specific and depend a lot on the category

* One PRO of joining the consolidated tracker is that consolidation is always good. But we would need to open a 2002 consolidated tracker for several people in this thread.

I don't know, what do you guys know ? Ideas ? Insight ?

One alternative could be to join the consolidated tracker, have them include 2002 cases as well (I believe there are many unadjudicated 2002 cases in other categories as well) and to maintain this thread to have discussions on case specific issues! Individual details can be incorporated into the signature files.

That could be a good option, track there, discuss here ...

And I wonder, would it be possible to export an ascii version of the spreadsheet in a readable way ? Maybe we can keep an ascii copy here ... (I can try whenever I have time, although I don't use MS Office, I am using OpenOffice on Linux ...)
 
More good news from my side. Last week I reported that my wife's (primary app) I-485 was approved. Today, Nov 8, I recieved 2 e-mails that my (derivative) I-485 has also been approved.

Our details:

I-485 RD: 12/09/2002
I-485 ND: 01/13/2003

FP1: 02/2x/2003 (I have forgotten exact date, seems so long ago)
FP2: 07/17/2004 (scheduled date: 08/18/2004, completed early)

LUD w/o message change (wife and me): 08/26/2004; 10/05/2004; 10/06/2004

Primary app AD: 11/02/2004
Derivative app AD: 11/08/2004

Waiting for notices to go for stamping and get plastic card

Case Inquiry Letter

So, I finally received the USCIS letter in response to my case inquiry. Essentially, is says "shut the freak up and keep waiting", in a very elegant language I have to admit ;)

More seriously, it says that "my case has been delayed due to their need to get 2nd FPs because FPs expire in 15 months", and it goes on apologizing, but it wraps up by saying that they can't tell me when they will make a decision. This is a form letter, they just put your name and send it on the mail.

It hurts when you see these long waits, and USCIS is using their limited resources (despite our huge processing fees) to waste time on EAD/AP renewals, FP repetition (why would they expire anyways ????), and so forth ... oh well !

Someday it's gonna happen, I just hope it doesn't happen too late :(

Well you are quite the optimist! I hope you are right!!
In any case it would seem that you should be coming very soon, esp. after that letter you received.
