Agree, the worst I can think of is that they'll tell you to come back when you are due. In this case you wasted a trip. But most likely you'll be ok, and speed up your approval :)

Sheesshh, I really really really wish they'll send me the freaking call for FP2 !

I suggest that you go. The worst that can happen is that they tell you to return on the scheduled date. If the place is not crowded and if there is no quota for the day then please do go. Have your FP ready next time they visit your dossier. The early the FPs are in the better your chances. Everyday day without the worry about the I-485 approval is worth a million. Don't you want to start your peace of mind sooner?

All I know is that if you are on AOS then if you leave the country you must have an AP in hand otherwise you lose the AOS status.

No. There was no LUD change. From what I have read here and there (no statistical or factual basis) it takes between 15 days to 60 days for the FBI to get stuff to BCIS. I believe they probably revisit your file when they add the "FBI fingerprint check report" to your file and if everything is hunky dory per their standards/guidelines/memos etc. they approve it. I believe this to be true further, because as and when the I-140 is approved, per the Fujita memo, they have to give a complete look at the 485, and hence, if it is just the FBI clearance missing, they are open to approving your case as soon as they get this..... But of course, all this is conjencture.....

One more question - Does anyone know whether it is OK to travel on H1 while your I-485 has been approved (prior to getting the "green card" stamp)? I read the relevant laws, and to my limited reading/legal understanding, nothing is mentioned regarding your status vis-a-vis the H1 once your 485 is approved. Given that it is a "change of status" application, it makes sense that you are actually not on H1 anymore on the approval of 485. However, I wonder what happens if I was to be out of the country (and believe me, I AM quite often out of the country)..........any comments?

I know for a fact that it is OK to travel on a valid H1 while your 485 is in process (I believe it also applies to O1 and a few other such "work visa" categories).
However, my lawyer has advised me against traveling on H1 once the 485 is approved (i.e. go out of the country using H1 AFTER 485 is approved, prior to getting it stamped on my passport), since you are really not on H1 the moment your adjustment of status is approved and any travel you START stating that you are on H1 can be construed as misrepresentation since the claim when one presents oneself at the border crossing on return is that one is still on a valid H1 - which is not the case.......

I agree with this - I went 3 weeks before my appointment date (in Boston), and there was no problem. Take your passport and EAD and appointment notice (and anything else you think you might need, just in case!). Good luck!!

early FP

Thanks guys for all the wonderful tips and support. I will go next week (3 weeks prior). that way, if something happens i can go again and yes i definetly want peace of mind :)

since, with INS being paranoid is nothing new, a freind of mine had suggested that in case u go earlier and get FPed u will 'miss' ur actual appointment date and hence have a chance of ur application being abandoned. However, i think after FP ur ACCOUNT GETS UPDATED? maybe i will go twice just to be safe :D

As you go to give your FPs, pay attention to details such as the agent pulling up your case on the screen and input the data in. I do not think that there are two arjundc in line. If you go a second time, the agent will say:"but we took your FPs 3 weeks ago!" Who is going to be trouble then?

Finally I got my 2nd FP notice today dated Aug.24(no LUD change). One good thing is my appoinment for FP is soon on September 9th. My lawyer promptly called me to inform me the same message.

Mendita! since my finger print expiry(2 months ago), I have been pushing my lawyer to write a letter to USCIS for 2nd FP!She did! No response! Just 2 weeks back I asked her to send the copy of the original letter again to USCIS! I am not sure this letter has triggered the FP notice.
Why don't you try the same! just the suggestion!

One more thing, a month back I have applied for H1 extension and my immigration officer tagged I-140 AD notice plus I-485 RD notice with H1 application. She is hoping that this might hasten the 485 approval!!!
You see! what are all one has to do!Too much of a wait man!

FP2 notice, pl help

I received FP notice but in the mean time I changed job from coast to coast and this FP notice is for the old address. I had called the 800 number and they told me to write to USCIS but so far no reply from them. The scheduled FP2 is on sept9th. should I go to the local office and get the finger print done? is that allowed?
also for 485 RFE was sent for medical which had expired + employment letter. I mailed AC21 along with new employement letter but now the new update for AOS says they have asked for more documents? am I in big trouble? I have not yet received this another letter.

Hi all,
My wife and I went to the Philly office to get our "I-551 processing" stamping (No appointment necessary....I don't know whether 485 stamping appt's can be made thru infopass, but if possible, I recommend you do it since it is much faster (else took us about 2.5 hrs).
The notice asked us to take passport, I-94, 2 STRAIGHT FACING photographs per new USCIS requirements (as of yesterday; ALTHOUGH THE NOTICE STILL TALKS ABOUT THE ANGLED PHOTOGRAPH) and the notice (yes, you get the courtesey copy and the lawyer the original, but the courtesey copy is good enough for the stamping). Although we did take passport photographs from our friendly neighborhood camerashop, the officer said that our faces occupied a larger percentage of the photograph than prescribed. He did offer to accept those photographs, but warned that it could lead to a delay in the plastic card if they ask for "better" photographs later. The officer was really nice. He collected the I-94, took signatures and fingerprints and allowed us to go get photographs (from one of the convenient expensive trucks outside the INS office in Philly) and jump the line when we got back (seemed to be the norm for the day since today was just the second day since they started taking only "normal" passport photographs). He held on to our passports till we got back, stamped and wrote in the expiry dates, had us review our stamps for accuracy and bid us good day!!
From his tone, taking your EAD's and advanced paroles is not a necssity. I believe it was just a courtesey he (and probably many other immig. officers) extend to help us keep our personal immigration files clean by destroying unncessary documents (that is exactly what he did - just tore/cut up the AP's and EAD cards).
He asked us to expect the plastic card in 2 to 6 months He also asked us to come back 2 weeks prior to the stamp expired to renew the stamp in case the card didn't come in by then.
Believe me, this was THE NICEST interaction I have had with a USCIS officer till date!!

Hi, skusa: a quuick question: are you saying you got one RFE for your I 485 and after you replied, you are expecting another RFE?
 
FP ahead of schedule

I was on vacation abroad. Got my H1B extension, and visa stamp on 17 Aug, and returned US with my new H1B. At JFK, the agent told me I needed a parole to get in since I had a pending 485, I just shrugged my shoulders. I think I am 100% sure that I can admit to US with H1B while having a pending 485 petition. The embassy also knew about the pending petition and didn't bother with it. Or am I in any danger violating my valid status?

When I went to pick up my mail, I saw the courtesy copy of the Approval letter for my and my wife's applications. It got approved on 8/20.
I guess I shouldn't have spent time and money for second H1B visa stamp at the embassy. I will be going to INS local office this week to apply my plastic card.

This is really good news after 2 years of waiting. Thanks for everyone in this forum for all the support.

Early FP2

Hi Arjundc

Sorry to hear you had a wasted trip. I guess it just depends on where and when you go. My attorney advised me that you can attempt to appear on an earlier date but may well be refused admission, as you have found.

All things considered I think I will sit tight until my appointment on Sep 29th.
