Seriously, when do they start processing H1B's again ? This could bring things to a halt once again
Why the hell do they give work permission for JUST one year , same with AP, these things aggravate things quite a bit, cost us a lot of money and keep the officers busy with boring, useless paperwork :-(

I pray that this immigration limbo will end soon for us and for all of you.

EAD and AP trigger "touching" 485 file?
Hi all,
I applied for my AP and EAD yesterday(will be on H1 till end of Jan) with the hope of triggering review of my 485, given that FP2 was done late last month.....hope it leads to their revisiting my 485 application and realizing that the FPs are in!!

Yep, I hope so. Although this is not guaranteed. There seems to be a tendency on USCIS to keep "the whole case" as a "unit", and many times onw approval or application triggers another ... and there are many other cases when there is no "triggering effect". Oh well !

As I'm sure you know, they're planning to change this. I'm not sure when it's going to be implemented, but I think EAD's are going to be valid for the time that it takes to obtain GC approval. Wouldn't that be sweet?!mendieta said:

485 approved!!!!!!
My and my wife's 485s got approved today according to the USCIS website and e-mail notification!! (that is the same as the receipt date for my AP and EAD applications!!!!) Given this timing, I am pretty sure the EAD/AP apps didn't have anything to do with trigger of 485 review (unless electronic filing triggers an "ultra expedited" review, even in the middle of summer vacation photograph reviews )....thus ends my saga that started in July 2002.
Thanks to this forum for all the support and morale boosts......it was and is really invaluable.
Anybody with any leads on what is next? (waiting in line at the local BCIS office for stamping? does one need to take an appointment?)

I have a questions for you. According to what you say there was no LUD change on your I-485 to acknowledge your FP2s and prior to your approval.
Your FP2s were done 07/24 and you were approved 08/26.

No. There was no LUD change. From what I have read here and there (no statistical or factual basis) it takes between 15 days to 60 days for the FBI to get stuff to BCIS. I believe they probably revisit your file when they add the "FBI fingerprint check report" to your file and if everything is hunky dory per their standards/guidelines/memos etc. they approve it. I believe this to be true further, because as and when the I-140 is approved, per the Fujita memo, they have to give a complete look at the 485, and hence, if it is just the FBI clearance missing, they are open to approving your case as soon as they get this..... But of course, all this is conjencture.....
One more question - Does anyone know whether it is OK to travel on H1 while your I-485 has been approved (prior to getting the "green card" stamp)? I read the relevant laws, and to my limited reading/legal understanding, nothing is mentioned regarding your status vis-a-vis the H1 once your 485 is approved. Given that it is a "change of status" application, it makes sense that you are actually not on H1 anymore on the approval of 485. However, I wonder what happens if I was to be out of the country (and believe me, I AM quite often out of the country)..........any comments?

If you call them they will say you can postpone it to a Wednesday or a Saturday, 2 or 3 months ahead!! Just show up with your FP notice and photo ID/sarjundc said:

I don't think turning up "very" early for your appointment should be that big a problem. If it is not right, they should let you know when you show up there early!!
