DV 2026 AOS (Adjustment of Status) Process Only

Hi mum,

I paid my $330 DV registration from the US which I just mailed a few days back, before that I had mailed KCC for AOS transfer and they just replied today that it's late and I cannot proceed with AOS now since my case has been current. Although I havent received 2NL.

Do I need to fly back to my country to do the CP, and if I do so would this payment be fine or I need to pay the registration again ?
I already have a F1 visa.
Assume by “current” you mean in October? If the case had already been transferred to the consulate it may just be easier to go and do it there (assuming that’s relatively easy for you) than try get it transferred back. Can you share which consulate?
Unfortunately no the DV fee if paid in the US cannot be applied to CP. you will be required to pay the consulate on the day of interview.

Yes Susie, I mean October. It's Kathmandu Consulate. KCC emailed me that I need to contact consulate to update the 260 as they cannot do it now since the CN is scheduled.

If they have procedure to do this, can I possibly email them and ask them to transfer ?

I am a student and I'll have to leave my semester entirely to give interview and fly back to the USA.

Each embassy is different, you’d have to contact them and ask.
Why would you need to give up a whole semester for probably maximum 2 weeks away? I understand it’s not ideal and you’d have to make up work, but colleges can usually make a plan.

Yes, this was a few months ago. I initially started filling out my DS260 without any knowledge about the process. I didn't know that when I selected USCIS/CP on the first page, I wouldn't be able to change it later. So I emailed KCC, and they changed it for me. But now, given that I have more information about the process, I would like to do AOS. I don't know if I should email KCC again, since I never submitted that DS260 indicating CP, and I'm not going to submit it. Thank you a lot for your reply.

I recall telling you back in May to hold off on submitting your DS260 form until after you had entered the US though, since you were planning on processing AOS and waiting to attend your F1 visa interview at the same time. Seems like you went ahead nonetheless and submitted the form with the CP option. Well, you might as well take the time off from your studies and attend the CP interview. You’ll need to make the DV payment at the embassy, the embassy will not honor the receipt for the payment you made in the US.

Alternative, you can contact the embassy to inform them you’ll be filing for AOS and will not be attending the interview at the embassy. Then proceed with filing for AOS and keep your fingers crossed that the KCC will retrieve your case file from the embassy when the USCIS reaches out to the KCC to request your KCC file.

Finish filling out the DS260 form, when you get to the section for reviewing the form, you will have the opportunity to change the process option by yourself at that point.

Am I missing something- I thought kcc didn’t send cases to the embassy unless the ds260 was submitted.

@SA22XX , are you sure you didn’t hit submit? If so, do as mom suggests above.

I don’t know the impact on non DS260 submission in your specific situation since you previously contacted KCC to inform them you wish to process CP

That’s usually the case AFAIK, but in OP’s case, I honestly don’t know how the KCC will interpret the back and forth OP already had with them. In the past, it used to be that if the DS260 is left unlocked after the initial submission, KCC wouldn’t schedule the case when it becomes current while it is still unlocked. That no longer seems to be the case.

In this case, you are referring to people who initially submitted and then unlocked it, right?

I believe that is what mom means, but they would need the ds260 submitted in the first place to send the case to the embassy. I haven’t seen anything that indicates this has changed. The instructions for CP remain the same, and that this is the first thing in the process. Hence my earlier question to you - are you sure you didn’t submit it?

Thank you! Yes, I'm sure, I never finished it. I just double-checked, and both my derivative and mine say "incomplete". I emailed KCC while my DS260 was still open because I wasn't able to change the first page, and I didn't know I could change it later.

Fyi, kcc cannot change the info on the ds260. When they change someone from AOS to CP or vice verse, tha DS260 has been reported multiple times to still show the original selection, with only the email from kcc confirming the change.

Sorry, perhaps I explained myself wrong. I did email KCC a few months ago, when I asked them to change to CP but I didn't write them again to change back to AOS. When I wrote them back then, they replied in the same day and made the change in the DS260 (while it was still incomplete)

Oh goodness, I thought you were the person who was initially asking the question that said kcc wouldn’t change it back. I just realsied that’s was someone else. Please ignore my last responses.
 
If my DV case becomes current in November, do I have to file the AOS package within that same month, or can I pay the DV fee, complete the medical, and then file the AOS later in Jan or Feb? In other words, is it mandatory to file as soon as the case is current, or is there flexibility in timing?

You can file anytime after your CN becomes current.
