DV 2026 AOS (Adjustment of Status) Process Only

Hello! I just take a look at the documents required for AOS and i have a doubt, if i dont have a ssn and never had an income in the US I would only have to present bank statements for the financial part? And any copy of my 8843 form? Thanks!
Your form 8843 does not help your overcome the presumption of being a public charge. Your bank statements may, if you have a substantial amount of savings in them to demonstrate you’re not likely to become a public charge, as it is not simply a case of providing bank statements. Otherwise, find a qualified person to provide you with an I-134 and the applicable supporting documents.

Perfect thank you! But apart from form 134 i would only need to prive bank statements from mine part and my husband? Or other financial documents are required?

Hey everyone, I’m in a tricky situation and could really use some advice.

I'm an international student with a full assistantship secured for a PhD program starting Fall 2025. My F-1 visa interview is scheduled in about a month, and everything on the university side is ready to go.

At the same time, I’m also a DV 2026 selectee with a case number under 1000 for Asia. I've already submitted the DS-260 and am currently waiting for the second letter (2NL).

I’m hesitant to take the risk with AOS (Adjustment of Status) after arriving in the U.S. as it seems long, uncertain, and complicated, especially as a new student. If I don't give the F1 interview, I might lose my assistantship. But incase if I decide to give my F1, higher chances that I'll be rejected due to my 260 submission.

Would love to hear your thoughts—anyone else faced this situation? What’s the best course of action in this kind of dual-path uncertainty?

Not sure what else it is you're expecting us to tell you, considering I already recommended to you barely a month ago, (May 6th to be precise) in this post to hold off on submitting your DS260 form until after your F1 visa interview if you truly want to give yourself a chance at obtaining the NIV. Seeing as you've since gone ahead and declared your immigrant intent with the DS260 form submission, you'll just have to wait and see as to how your F1 visa interview turns out.

Not required for the DS-260 form (if you're processing AOS). However you should submit form AR-11 which is a normal requirement for anyone with a non-immigrant status to report their change of address within 10 days of relocating to a new address.

1. Probably not, but check the reciprocity tables for your country to be sure. If it says the online version is ok, you’d be ok. If not and it says physical copies available you’d need to get those.

 
Special Seal(s) / Color / Format: Birth certificates have no security features as they are a copy taken from the book where they are registered. Each copy must have a blue or black stamp with a legend stating “es copia fiel del original.” Digital copies may not have the stamp but will be issued as a PDF with a digital signature. Digital copies will have a verification code.

Does anyone know if this means that digital copies are allowed?

Currently, I am on F-1 OPT, which is expected to expire in February 2026.

I have three questions:
  1. If my number becomes current around January or February 2026 and I submit my AOS application at that time, will I be allowed to remain in the U.S. even if my F-1 status expires while the application is still pending?
  2. If I switch to a G-4 visa before submitting my AOS application, would I still be eligible to adjust status from that visa category?
  3. What if I didn't submit DS 260, will i get my 2 NL through DV administrative fee payment?

If I was in your shoes and I plan on processing my DV selection via AOS, I would refrain from submitting the DS260 form for now and proceed with my plan as is, all the way to getting the E3 visa and returning back to the US. Yes the E3 visa is a NIV, however there’s no need to inform the embassy about your DV selection while applying for the NIV unless they pointedly ask, in which case you’ll have to truthfully declare your intention.

You can’t withdraw a DS260.

Your submitted DS260 cannot be withdrawn. In your previous post, you indicated your E3 visa expired in Oct. 2026 and you did acknowledge the response provided to you back then regarding your visa situation.

1. If AOS application gets filed and is accepted before current status expires, you are allowed to remain in the US until the AOS application gets adjudicated.
2. Yes.
3. Maybe.
