DV 2026 AOS (Adjustment of Status) Process Only

If your CN gets to be current, yes you’ll be eligible to process AOS. Your applicable DV FY would have been over anyways by the time your current E3 will need to be renewed in Oct. 2026.

Hello. I have won a lottery too (EU28***) and I am Canadian citizen. My wife’s company is going to transfer her to US on L-1A visa and myself on L-2s in the next couple of months. We have already completed DS-260 forms. Our interview would be in Montreal. Would we be eligible to file for AOS while in US or do we have to go for the interview in Montreal, Canada? Thank you for your help!

L visas are dual intent, so there is no problem moving to the US on an L visa and then doing AOS. Be sure to read the AOS process spreadsheet.

In addition to the spot-on response already provided above, I’ll recommend holding off on submitting the DS260 form for now though, at least until after you’ve entered the US on your dual intent visa(s).

My case number is EU26XXX. I currently hold an L1 visa and reside in the US. I was born in Turkey and applied under the Turkish quota. I also hold Canadian citizenship, which I obtained through a refugee claim in Canada.
My Turkish passport expired in 2024, and I am unable to obtain a new one, as the Turkish consulate or embassy will not issue me a replacement. Given this situation, I would like to ask:
Will I need a valid Turkish passport at any point during the AOS application process, or will my expired Turkish passport and valid Canadian passport be sufficient?

Hey! My case number is kind of high - EU27000 and I am doing my studies on F1 currently. The thing is I am not sure, if I should start the process anyways, because I want to finish my studies without an issues (I still have a few years to go), and be able to travel outside once a while. However, in case my case becomes current and there is no enough time for the AOS to be processed, I will have denial and later can not extend my F1 visa, that is what I know. I would really appreciate any suggestions that would help me to have clear decision. I have no idea what are my chances. Thannnks a loot!

It’s not a problem from the perspective of getting a visa. The manual the consulates use expressly say this:

9 FAM 402.12-13 (U) TEMPORARINESS OF STAY

(CT:VISA-1980; 04-29-2024)

a. (U) Applicants for L visas are not subject to INA 214(b). In addition, INA 214(h) states that the fact that an applicant has sought or will seek permanent residence in the United States does not preclude them from obtaining or maintaining L nonimmigrant status. The applicant may legitimately come to the United States as a nonimmigrant under the L classification and depart voluntarily at the end of their authorized stay, and, at the same time, lawfully seek to become a permanent resident of the United States.


(Mom might want to clarify her caution but it’s possibly related to the fact that you will have listed CP/Montreal on there so need to ensure you give enough notice to kcc that you are doing AOS. Again, refer you to the aos spreadsheet.)

It ordinarily shouldn’t be a problem. However, under the current administration, I would caution to be mindful of the fact that anything could be a problem.

While harboring a future immigrant intent is allowed on a dual visa/status, a CO or CBP may decide to not take kindly to applying for a dual status visa with an established intent of filing for AOS upon admission into the US.

The bell has already been rung in this case since you’ve already submitted your DS260, nothing you can do about this except to truthfully answer whatever question may be asked about your AOS plan at the embassy or the POE

Your Turkish passport is irrelevant to the process. Just make sure you have your B/C (issued by the recognized authority) to demonstrate your Turkish eligibility. If you entered the US with your Turkish passport though, or have a US visa on it, you’ll need to include a copy of it in your AOS package.

You are absolutely right. I missed the part where OP clearly indicated the plan as at the time of DS260 submission was to process CP. My initial and follow up responses to the OP are therefore not applicable.

Here is the tricky part: My case number is high EU43xxx. My Opt expires in July 14th 2026.

What should I do? File the ds-260 or do AOS?

You will not be eligible to file for AOS if your status would have expired (and you have no other valid status to roll into) by the time your CN becomes current.

You should probably understand also that your case number is probably very high compared to the others in the region - based on the dv26poll - https://dv26poll.xarthisius.xyz/

That means some risk that you never become current and if you do it will be very late in the fiscal year.

Recently, I got selected for dv with a good CN just before a few weeks of waiting to book my interview date for F1. what should I do as I want to continue with my studies ? Would this affect my F1 if I give interview before filling DS-260 as it shows different intent of stay ?

Is it possible to apply for F1, reach USA, join the university and then apply for ds-260 ?
Would I be able to take interviews for DV from inside the USA ?

Hard to answer your questions without knowing a few pertinent details.
1. When is your program of study supposed to commence (as in when do you plan on arriving in the US if F1 visa is approved?
2. What is your DV CN range?

What exactly is(are) your question(s)?
1. Considering my case number is 27XXX, and I am on F1 currently, would it be too risky to start the AOS process once it becomes current - due to not having enough time? I have few more years to finish my studies here.

2. If I decide to file and get denied due to not having enough time before sept30, 2026, in that case would it be absolute block point for renewing F1 visa later on?

3. With this case number, should I consider this opportunity/file, or just go on/not file?

I know these are too specific, but any suggestions will help to make up my mind. Thanks!
