DV 2025 AOS (Adjustment of Status) Process Only

2. It wouldn’t hurt for him to call. Usually USCIS will not discuss spouse’s A application with the spouse B without spouse A being present on the call to give their consent.
3. It doesn’t affect the outcome of the case, it may just piss the front line agents off and cause them to not be friendly with the caller.
4. Yes, if you both listed your different addresses in Part 1, Q18 as that is what is used in scheduling the bio appointment AND in assigning the applicable FO by the way.

In cases where spouses are in your type of situation and in which they each listed their separate addresses, the Lockbox has
separated the cases and sent each case to the FO with jurisdiction over the listed addresses. The applicants in such situations ended up experiencing additional delays especially in situations where the derivative’s applicant’s FO had a faster processing time - the application could not be approved until after the main selectee’s application had been adjudicated by their own FO and forwarded their AOS case file to the derivative’s FO.

By the way, where you guys already married as at the time of the eDV entry submission in 2023?

We got married in December 2024 after he won the DV. We included a Bona Fide with our package, too.

1. I understand your point. Does this mean that we could get biometrics in 2 different places? And eventually get the interview also in 2 different FOs? I thought what always matters is the principal applicant's location.

2. Also, we created the USCIS account soon after we received the text message. But accidentally, my husband created the account with my receipt number, and I did with his receipt number. Is this an issue? Do you think it is good to remove the case and add it back with the correct receipt numbers?


Also, my husband contacted USCIS again with "Chat with Emma," and they said biometrics is not yet scheduled. So, I guess we have to wait.

The fact that you got married after DV selection and are both residing in different states is likely to put your applications under additional scrutiny AFAIK. If only you had mentioned this before filing, you would have been better advised on how to proceed with filling out your I-485.

Doing so is likely to complicate things IMO, as it could further delay the approval process.

My AOS package was delivered on July 17, and I received the NOA a few days later. I completed my biometrics on August 5. I will be current in September, and my Field Office is Detroit. I haven’t received an interview letter yet. My question is: based on your experiences, can I now consider myself safe from the risk of rejection due to early filing (which in this case would be determined by my FO)?

As already explained in a previous post to your question, your case is safe from package rejection due to early filing. It however is not yet safe from case denial due to early filing.

I understand, thank you. My doubt was more about whether, now that it has been over two weeks since biometrics and my package is presumably at my FO, I can also consider myself safe from an early filing denial risk. Do you have any idea about it?

The only way to know is after the case has been approved (with or without an interview). The IO is not looking at the case until they’re ready with the adjudication process, which is the earliest they can determine if a case is incomplete and they issue a RFE, or if a case should be denied without an interview for any reason such as early filing, etc. Until the review process starts, the case is just sitting with a pile of other cases assigned to the IO regardless of how long the case as been at the FO.

There’s no standardized period for receiving the IL following bio appointment completion. The fact that someone completed the background check appointment doesn’t necessarily mean they cleared the background check. Some FOs, as a matter of fact, do not wait for the bio appointment completion before sending out the IL, while some actually wait until after the background check clears before sending out the IL. So the timing varies.

I keep telling folks wanting confirmation as to if their application is already with the FO or not is a complete waste of time. It is not unusual for one frontline agent to confirm the case is already at the FO, and for another to tell you a couple of days later that the case is at the NBC. Per the standard procedure, the NBC forwards the case file once the bio appointment has been scheduled. It is as simple as that.

Your CN is current in Sept. Wait until the end of August to see what happens.

What little information did you find about your FO from the Timeline spreadsheet(s)?

Yes I did.

Remind the IO the FY end date is fast approaching, and that your family is processing FTJ. Which means your AOS case file needs to get forwarded to the embassy where their FTJ interview is supposed to take place ASAP following your AOS approval.
 
Hi Mom I have applied for adjustment of status its rejected, i got this notice with my package, I'm not sure why its rejected attached is notice of action it has not said about the rejection cause also I don't see any M-180 form with my rejected package.

My guess is it was rejected for early filing and the agent that rejected it was too lazy to provide an actual reason, they instead included a generic notice with reference to an obsolete form.

Take a very close look at your form to confirm you did not leave a required section unsigned, nor sections left blank. Also take a look at the edition of the submitted forms (both I-485 and I-693) to confirm you used the current edition of the forms. If all of these checks are in order, then it means the package was erroneously rejected for early filing.

2. do I need to do repackage my medical form since it has been opened.
