DV 2025 AOS (Adjustment of Status) Process Only

Next week, I'm looking forward to the visa bulletin for April 2025, in which I expect my CN will become current for May 1 in the advance notification chart of the bulletin. I did not submit a DS-260, but I have paid the DV admin fee of $330 (2NL received). I am getting ready to file my 2024 federal tax return (1040NR) as an F1 student. This filing will be before I submit my AOS package later in March.

For my 2024 tax return, my accountant asked me to complete IRS Form 13614-NR (Nonresident Alien Intake and Interview Sheet) to determine tax residency and other things. One question asks if you have an LPR change in status application pending.

Am I right that only the action of submitting the I-485 or DS-260 triggers a 'yes' answer here? I.e., just paying the DV admin fee is not an application to change status. So I plan to answer 'no', given the status of my AOS package at the time of filing my tax return this week.

I submitted DS-260 the previous year with my husband in 2024. Should I put yes to this while I'm submitting my TAX return, because I thought, as my number is not active yet, I do not need to put yes, but I'm not sure right now. @Sm1smom

You can select NO if you’ve not yet sent in your AOS application.

I have one question who can be beneficiary if my husband is principal applicant?
You and your spouse are both AOS applicants, you have separate AOS applications in the system. Only difference is your spouse is the DV selectee.
 
This is what they replied to my representative. Nothing special, the same reply I get when I ask EMMA, lol

"A review indicates that your constituent's application is still pending within processing time. Once further action is taken, a notice will be sent to the address of record.

This is kinda discouraging. Seemingly, they're confirming that representative cannot fast-track on case.

Hi team, yesterday I received a USPS informed delivery notice with an image of a letter from USCIS New York (Federal Plaza). The envelope was hand written. The letter never arrived. Any ideas how to trace the letter and/or who wrote it. I completed my bios last month and so expect it is related to an interview. Anyone had any experience with receiving a similar letter from the FO?

Hi, I’m a DV24 selectee. I think that’s your interview letter. I also got mine from Federal Plaza last year. Sometimes informed delivery mail arrives a day later than mentioned. Fingers crossed you get it today because you need it for the interview.
 
In April bulletin, May cutoff for Europe is still 16000. Now I feel really scared and devastated. I think my CN 23k will not be current in this FY - or it'll be current too late to get the GC. It's terrible.
Hey, I understand how easy it is to think of the worst case scenario. But for you, there’s still time to remain hopeful. My CN was EU21k and it went current in July of last year. There were also a lot of approvals here in the last 2-3 months of the fiscal year since FOs tend to pick up speed toward the end of it. Best of luck!
 
Hi, I’m a DV24 selectee. I think that’s your interview letter. I also got mine from Federal Plaza last year. Sometimes informed delivery mail arrives a day later than mentioned. Fingers crossed you get it today because you need it for the interview.
Didn’t arrive. For the Bio appointment, both me and my attorney received the appointment letter. Does anyone know if the interview letter is sent to both? Thanks

Interview letter received for appointment on 04/11/2025, added to sheet!

Both my spouse and I received letters on the same day.
Both letters only had the two sheets in them:
- Main page with (what looks to be) standard checklist of "items to bring", and date/time of appointment
- Second page stapled to first page, with a few sentences finishing the text from the first page, also appears to be standard

Nothing in the checklist looks to be specific to our case and looks standard.

Neither of our envelopes contained additional pieces of paper. I assume any additional RFE for bringing to the interview would be on a separate printed page?

Other than the docs in the "Interview Tips" spreadsheet, am I correct in assuming that this is all we need seeing as there wasn't a separate piece of paper requesting any new info?

Did your status change before receiving the letter?

No it didn’t, myUSCIS still looks like this:

- Biometrics received fingerprints taken (Oct)
- Case was received (Oct)

And that’s it. I was able to see the letters through Informed Delivery which was extremely useful.

Take along anything else you can think of that could be helpful to your case. Being over prepared wouldn’t hurt.
