DV 2025 AOS (Adjustment of Status) Process Only

Yes, your aos is abandoned if you leave the US without AP (unless you are on a H1/4 or L visa, which you aren’t)
Does anyone know how long it would take me to change from AOS to CP if I haven't completed the DS-260 form?

I'm referring to the average time it would take to get an interview appointment at the US embassy in my home country.

Is your number current?
rule of thumb is around 1-2 months for kcc to process your ds260, and another up to 2 months to get your interview depending when in the scheduling cycle the ds260 processing is completed (interviews are generally scheduled 4-6 weeks in advance). All that assumes no capacity or other issues at your consulate, which could add further delays.

Understood. Thank you. Alternative category would be anything that is not UHP (like AP). Anyway, all of that is esoteric.

I just realized that we might have another issue blocking our application. Our immigration officer mentioned during the interview that they couldn't see a derivative applicant's case in "documents from the State", saying that "State didn't send it and they need to fix that". Meaning State Dept. I didn't pay attention to that initially because nothing was asked of us, but I now think that what happened is that our DS-260 was submitted twice, first after adding primary applicant, and then again after adding a derivative. And because we got married after the selection, info about derivative applicant was not included in KCC file by default. They shown us a photo and information about the main applicant (photo submitted during DV registration), and said that this is what is missing for a derivative.

I'm thinking about emailing KCC and explaining what happened, but our officer said they will request this information from "the State". What do you think I should do?
 
How should I fill out a money order for Form I-485? What should I write in the "Pay to" and "Address" sections?
See below link for "Pay to" information (click drop down arrow for "How to Write Your Check"). Use your Lockbox address for the address section.

Form I-134 Declaration of Financial Self-Sufficiency has been updated by USCIS. This updated version (01/20/25 edition) is effective as of today, Mar. 3rd. So any applicant who already filled out the form and are yet to file should ensure they're downloading and using this updated version with their AOS package.

OMG, I literally mailed my aos in the morning of March 3rd, and when I checked the website it said the accepted edition date is 10/24/24, I mailed priority with the option to be delivered March in the morning March 4th. They updated the website later. Was there any prior communication?! I didn't see anything. What does it mean for me? Are they going to reject it, if so, how long does it usually take for them to return everything so I can fill again? This is bad

Thanks! Just for giggles, my review of both forms indicates the only difference is removing the option of "Another Gender Identity" in Part 3, Item 3....now it only allows "Male" or "Female".

This prompted me to check the I-485. It is also updated as above (new edition 01/20/25).

1. No harm in including 2024 documentation.
2 & 3. I’ll recommend you stop trying to over analyze the process, or stressing over how USCIS will know, or what if scenarios. Provide the recommended financial support documentation. While past/previous financial strength helps USCIS see a sponsor’s historical trend, more emphasis is placed on current income.
Mom, if I understand your answer correctly for the I-134, the sponsor should include copies of:

- Tax return transcripts for 2023, 2022, and 2021 (2024 not yet filed)
- 2024 W-2 form
- Paystubs for 2025 so far?

No prior communication. The update notification was sent the same day as at when the forms became effective which is an unusual practice. Since the main difference between the previous version and the new one was to remove the gender neutral identity, and assuming that was not the selected option on what you sent, they may go ahead and process the form as is. You’ll just have to wait and see at this point.

Ideally 2024 tax transcript should be included seeing as you’re including the 2024 W-2.

Well, the sponsor's returns seem complicated...the W-2 from his employer is available right away, but other tax forms from his businesses cause delays in his annual filing....he says he usually gets an extension to file taxes by October (rather than by April). This is the issue with the 2024 tax transcript. So I'm trying to nail down what he should provide for 2024 as alternative evidence.

Again, I'm very sorry for being annoying.

I've received a response from U.S. Consulate General Frankfurt. Since I asked if they could request my case from USCIS, they just responded that Adjustment of Status cases can only be processed within the US. I don't think the person responding to our inquiry was familiar with the process you described earlier. I will try to clarify.

I also emailed KCC explaining our situation and that our case is on hold with USCIS. Their response in attached. They did mention that if we had our interview scheduled we need to ask the consulate to request our case, but I think they were talking about transferring between consulates. It is somewhat hard to get clarity from them, while also acknowledging all the time that I don't want them to do anything just yet...

I went ahead and recalled my package because apparently it didn't reach Elgin lockbox, so I will replace the form with the new edition and mail it back. I am losing a few days but oh well, better be safe

That's good. You might as well ensure you're using the updated I-485 in that case.

It is what it is in that case. Use/include whatever you have, keep your fingers crossed and hope for the best is all I can tell you at this point.
