DV 2024 AOS (Adjustment of Status) Process Only

Hello Mom, Can you please confirm the following in Part 1? I entered US on TN but later changed it to H1B.

hi everyone
i am filling i-485 for my daughter 5 years old.
should i leave the public charge section, general eligibility and inadmissibility grounds sections empty or do i fill them out like i did for myself?
 
I have a silly question. I’m about to send my AOS package! Should I tell my DSO that I am adjusting my status? Will my DSO automatically terminate my status?

Don't make the mistake of informing your DSO of your AOS processing, as they could end up creating unnecessary problems for you by terminating you in SEVIS. Wait until you've successfully completed the process before informing your school about your new status. You gain nothing by prematurely informing them you're filing for AOS.

Thanks, Mom, much appreciated! I'm asking because I requested an enrollment verification letter from my school, and they informed me that it can only be obtained through the DSO. Additionally, they require an explanation of why I need it.

I’m surprised you can’t basically print this out from your student portal. Anyways, you can tell them you just need it for your personal records. You can tell them you want to have it on hand for when returning back to the US in case you need to travel out of the country for family emergency or whatever. You can tell them you need to send it to your parents/employer/sponsor back at home as proof of ongoing schooling, or in support of an external scholarship application your working on. I’m sure you can come up with whatever reason on your own outside of stating it is in support of your AOS application.

Hi all,

I am happy to share that I received a notification that my interview has been scheduled and learnt through Emma chat that it will be on April 12.

However I have a question. My I-20 status expires on March 31 and previously my original plan was to extend it for 3 months as I supposed it would take more time to get the card. Previously my lawyer was ok with getting a new I-20. However recently she told me that signing a new I-20 (which contains an attestation that I seek to remain in the US temporarily and solely for education) might be risky at this stage. Howeve the DSO advises me to keep my status.

Now I am in dilemma. I actually heard that previously people extended their I-20 and even got a OPT( which includes getting a new I-20, signing it and sending to USCIS!) still got their cards successfully. Now what do you think? Do you advise me to keep my status and let it lapse in the hope that I will be quickly approved?
 
Hello, I just realized the revised I-94 which i got along with I-797A Notice of action for my H1B does not reflect in I-94 database (expiration date and the class is different). Does I-94 database reflect only when you enter and leave US? Do i need to contact some office to update the expiration date and the class for I-94 database? If not, which i-94 should be attach to the AOS package?
Appreciate your response.

The online I-94 database is a CBP database for recording travel history and duration of granted authorized stay upon admission at the POE. That database will not reflect new I-94 dates on the NOA issued by USCIS following a COS or EOS. As for the I-94 to include with the AOS package, may I suggest you take a look at the AOS Process Spreadsheet?

Yes, i94 available online only relates to your initial status when you arrived. No need to contact anyone. You attach both (or all if you have more). They prove different things: the former that you were admitted, the latter that you have a valid status. You'd attach everything in between to prove maintaining valid status.
Everything I said above is in AOS spreadsheet I believe...

I am the winner of DV2024, my case number is EU19*** and I am waiting for an interview in Warsaw.I'm not in current. and here’s the question: my boyfriend is in LA waiting for EB1, he has already received an rfe, and I want to fly to the USA on a tour visa (I have one) in the near future, get married, and apply for AOS so that we can have an interview by lottery together. Please tell me this is real, considering that in Europe there will be 18,000 people on the ballot for May, will I have time to change my status and get to an interview?

AOS is intended for people already residing in the US before the decision to file for AOS was made. Entering the US on a non-dual intent NIV with a preconceived intent of filing for AOS is considered a fraudulent attempt at obtaining an immigration benefit, which is frowned upon. However, if you declare this preconceived intent of filing AOS at the POE and you are subsequently admitted into the US following that declaration, filing for AOS after that will most likely not be considered a fraudulent attempt at obtaining an immigration benefit.

CAVEAT:
The IO, at the time of the AOS can still ask why you decided to enter the US and process AOS even if this intent was disclosed at the POE. You will need to be prepared for this.

DISCLOSURE:
We’ve had previous cases of DV selectees who entered the US on a visitor’s who subsequently successfully processed their selection via AOS without declaring their preconceived AOS intent at the POE.

NOTE:
Should you decide to proceed with entering the US to file for AOS, do make sure you understand the AOS process before doing so. I highly recommend you go through the AOS process spreadsheet to ensure you understand the steps involved.
