DV 2024 AOS (Adjustment of Status) Process Only

Thank you for this amazing platform, I have learnt so much from past experiences, and the spreadsheets here. Much serendipitous!

I guess I have a unique situation, at least one I cannot seem to find out in the forums. I got selected, and I did mentioned my wife as a derivative when I entered the lottery. Now we have a USC child that recently arrived. So my questions are:

1. I DONOT need to create a separate i485 form for my USC child, correct?
2. If i end up filling the DS 260, should I say that she will immigrate with me in the form? I guess she does not need to 'immigrate'?
3. Regarding the affadavit of support, me and my wife collectively make more that 125 % of the PGL. Do I still need a support letter from someone USC or GC holder?
4. Me and my spouse go to separate schools in different states, although we are married since 2016. Is this going to be an issue with the IO?
5. I am sure our child's birth certificate would be required as supporting documents. Does this go with the primary, or the derivative applicant?

1. No DS260 submission required for a USC.
2. A USC cannot “migrate” to the US, answer NO.
3. Having an I-134 as a backup financial document, especially for F1 status is never a bad idea.
4. This shouldn’t be an issue especially since you did not get married after your selection and she was mentioned on your entry submission. You however need to be careful with the listed primary address on your I-485 form, otherwise your applications will end up being separated as they will fall under two different FOs which will impact your interview process.
5. Each package should contain a copy of the child’s birth certificate.

Thank you for the clarifications. One last thing: Should I go for the i-134, or i-864? I see the spreadsheet mentions i-134, but I read online that i-864 is for immigrant visas. I was wondering the difference.

I work in the USA on H1b visa while my husband has dependent H4 spouse via. He lives in Dubai and he was selected for DV2024. When he filled in a form, he mentioned Abu-Dhabi consulate.
Our case is 17xxx
The question is whether we can proceed with AOS from his side being H4b holder ? Is that considered a change of status ? I mean is H4b a status ?
On the other note, can he attend interview in Abu-Dhabi and once he comes to states, we will send petition for me to obtain GC ?

Thank you for the clarifications. One last thing: Should I go for the i-134, or i-864? I see the spreadsheet mentions i-134, but I read online that i-864 is for immigrant visas. I was wondering the difference.
The AOS Process Spreadsheet spreadsheet contains the correct information applicable to DV based AOS applications.

I am deciding whether to do CP or AOS depending on the situation in the near future and I have 2 questions:

1) How critical is the timing of DS260 for CP? I see a majority in my home country already filled out the form from group chats. If I submit it in August for example, will it delay my interview by a few weeks/months?
2) If I switch from CP to AOS in December for example, will it delay my case as well?

1. Your interview schedule will largely depend on a combination of factors such as when your CN becomes current, plus DS260 form submission which influences when the KCC completes processing the form, and the embassy where your interview is supposed to take place.

2. It depends on the above listed combinations.
 
My lawyer tells me ds 260 must be filed for the dv lottery .I know it's been stated on spreadsheet that highly recommended with reasons,but can someone confirm if not submitting it ever had a negative impact on their AOS application?
 
Thank you. I wrote an email to the Ukrainian Embassy in DC and this is what they said:

"in November 2010 the Ministry of Education and Science of Ukraine took a decision to terminate issuance of "non objection letters"."

How can I get the waiver if my home country terminated issuance of the letters?

Does the “NO OBJECTION” option not apply to your case?

How long should the passport be valid for at the time of interview? mine will be only be valid for 3 months next septemeber.

Do I need to renew?

I am a DV2023 winner and never filled DS260. I got my GC without a problem.

I am a dual citizenship and won the dv 2024 with my country of birth (Argentina) but I’m currently an f-1 with the passport of my second nationality (Peru).
I was going to apply for an e-3 visa (available for Argentinians) but my lawyer said I could not qualify for AOS because status could not be transferred between passports.
Will I have this same problem by winning dv lottery as Argentinian?

Hello everyone, and thank you for this wonderful resource! The spreadsheet has been a North Star.

I have been selected for Europe, case number 5XXX. Am currently resident in the United States on a H1B. Decided to proceed with AOS for reasons of convenience and given that we both have a generous amount of time left on our visas.

My husband and I submitted the DS-260 this past Wednesday (24th), and I just mailed our DV processing fee money order, with our medicals booked for Tuesday.

I wanted to check;
1) Steps are correct thus far
2) I was a little spooked with the money order, as you have to specify who it is payable to. This is not explicitly referenced within the DOS instructions, however as the address commences with 'U.S. Department of State', this is who I made it payable to. Can I confirm that this was correct?
