DV 2023 AOS (Adjustment of Status) Only

Hi Sm1smom,

Is there any rule about the validity of your passport as of the time you go for your biometrics or interview? For example, if you are traveling to Ghana, your passport must be valid for at least 6 months at the time of arrival. Do we have anything similar when adjusting status here?

like six months beyond the date of the adjustment of status interview.
 
I am not really sure if it was because of the early filing. My case number showed current in march but I submitted my documents on Jan 23. I got accepted and have my biometrics scheduled already. I didn't even attach a memo. #ChicagoLockbox
What’s there to not be sure about the rejection having to do with early filing considering the OP got a rejection notice that specifically stated the rejection was due to early filing. Package rejection due to early filing is not unusual which is why the AOS Process Spreadsheet went to the trouble of creating this awareness.

like six months beyond the date of the adjustment of status interview.
None that I’m aware of. The passport simply needs to be valid (unexpired) as at the time of using it as a form of ID.
 
How many passport style pictures are needed in my package?
It depends on the number of forms you plan on including with your package. So I suggest you read the instructions for whichever form you plan on including with the package.
 
In I-485, question no 64, "Identify the total value of your household assets", (i) does the investment in the US stock market and crypto market fall under household assets? If it does, do I calculate the asset value on the basis of my cost valuation or the present market valuation?
(ii) Also, does my asset back in my home country count?
 
1. I think you should be able to figure this out on your own - please use your discretion.
2. They can, if they like.
3. The spreadsheet contains “recommended” documents to be included as applicable, or as each applicant wishes.
4. Just use your discretion on this also please.
5. No need to redo the medical for that.

One follow up on Evidence of Financial Support as we assemble the package. We are not filing the affidavit of support form and have put together the following financial support evidence for each one of us to include in our applications:

Principal applicant financial support documents include:
- Proof of employment + salary for both principal and spouse and 3 most recent for each one of the following: bank statements, retirement account statements, IRS transcript, W2, spouse's bank statements, spouse's retirement account statements

Planning to have the same package for the derivative. Are we overdoing it? The reason I ask is that each bank statement is about 5-6 pages and we have multiple bank accounts making financial support evidence pretty thick and I am worried if we are overloading the submission with unnecessary pages. Should we maybe include only Summary Page of each statement?

i. Yes, stocks and bonds fall under assets. Present market valuation.
ii. Use your discretion.

If you have several bank accounts, consider not including statements for them all. Especially if they do not have a significant amount in them. You can also consider getting a letter from your bank (in place of the bank statements) stating confirming you have such an account, when it was opened and how much you currently have in it (the letter is usually a one Paderewski document). Finally, I wouldn’t include retirement account statements, since it’s not like an account you can generally spend from, in case you fall on hard times, before retirement.

Hello @Sm1smom, I am an AOS applicant from NY (FO queens), my case was received in mid-November and I am waiting for the interview date.
I contacted a live agent via Emma today to ask for a status update. They said, "Your case is located at the National Benefits Center. The process will start at the National Benefits Center and then be completed at the field office[...]". I am now confused because I thought at this stage the case would have been at the FO already, I did not know there was another office before the FO, in your experience, is this normal for DV applications?

I also saw from the spreadsheet that an applicant from NY, number current in January has already had the interview scheduled, at this point, I don't really understand what is the logic behind the scheduling system.

All applications move from the Lockbox to the NBC to the FO - you can check the "NBC_LockBox_FO" tab of the AOS Process Spreadsheet for more on what each of these locations are responsible for. Although your application should already be with your FO by now, so I highly doubt what the agent said about it still being at the NBC is correct.

@Suze - can you confirm your FO is indeed New York, NY as there are a couple of FOs in New York (which folks have sometimes assumed were the same as the New York, NY FO).

@Nicdep - I see another case from New York, NY current in October, filed 2 months before you which seems to also be waiting for the IL. Assuming it is not a situation of this other selectee failing to update the spreadsheet, this seems to support what I've written earlier on about the New York, NY FO. Nonetheless, you may wish to initiate congressional case follow up assistance at this point - as in contact your congress person's office and request their assistance with following up on your case with USCIS. While this does not guarantee an immediate action/response from USCIS, it sometimes helps with moving cases along or bringing it back to their attention if it had fallen through the cracks.

I also had the feeling the agent was not correct since I have contacted Emma live agents other times and they have always confirmed that the case was at the Queens FO, indeed one time an agent even said Queens is usually a busy office and it may explain the dalay.

About the other Selectee filing in October, If i understood which selectee you are referring, they may have asked for a AP (I have read this in some post here), so I don't know if this can impact on the timeline for interview.

1. how do I get to know who is my congress person's office to contact?
2. Is there a form to fill up or is it an email I have to send? In this case, do you have examples of this kind of email to show?

Also, the agents always send me to visit the link of Case processing time, but application based on DV lottery are not included, so I wonder if there is another way to check the processing time for DV AOS.

Applying for AP has nothing to do with the delay - if you take a look at the section of the spreadsheet I referenced earlier on, you’ll get a better understanding of who does what.

1&2 Take a look at the FAQ section of the AOS Process Spreadsheet.
 
As long as you do not use an AOS based EAD and/or AP to work or travel, you remain in your current status for as long it is currently valid. Big difference between submitting/applying and using.

For mailing the DV Fee -- should the letter be w/ signature confirmation or it is not needed and simple tracking is sufficient?

You actually can apply for the benefit and end up not using them.
