DV 2023 AOS (Adjustment of Status) Only

OP I just want to confirm, your application at lockbox was erroneously rejected even though you were eligible to apply under the early filing memo?
Hi there! Yes, correct, I was eligible to apply 4-6 weeks before my number was current. I had attached a cover letter explaining this + the law that states I can apply early, and I was still rejected unfortunately.

Yikes, I'm very sorry to hear. I'm deciding on whether to do early filing should I become current as one of the later/high numbers, and this doesn't inspire confidence.

1. Post once, exercise some patience while waiting for a response - posting the same set of questions over and over will not lead to a quicker response.
2. I edited your second post by deleting your payment receipt as it contains your personal information. You should be careful with what you share on a public forum, learn to protect yourself personal information.
3. Slow down! Start by going through the AOS Process Spreadsheet which contains a step by step guide of what the DV based AOS Process involves. That spreadsheet also has a lot of AOS related FAQs in it. So start by going through it first, then post follow up questions on this thread. You’ll find the link to the spreadsheet either in the first post on page one of this thread, or below in the signature section of my post.

Hi everyone! I have been reading this thread from page 1 and I noticed some people mention EADs but I was not clear if we need to report them somewhere in the AOS package? I got an EAD from an OPT right at the same time that I got my H1B so I never really used the EAD. Should I report it somewhere in the I-485 or other documents? Thank you!
I’m guessing the posts you read referencing the EAD card mostly have to do with including a copy of the EAD in the AOS package. If you take a look at the AOS Process Spreadsheet, you will come across it as one of the recommended documents to be included in the AOS package.

Thanks, and I wish you good luck with your application too :) I think it depends a lot on the officer. The one who got my case, based on the response they gave me, had no idea how this worked *at all*. Not just the early submission but the whole DV AOS thing.

Thank you mom! I was planning on including it but I wasn't sure if I missed in the i-485 or other documents any sections I should have reported it.

An immigrant officer did not reject your case, it never got to the stage of being assigned to an officer. A contract worker at the Elgin Lockbox rejected the package most likely because they’re not familiar with DV based AOS applications which is not surprising to me considering until recently, the Chicago Lockbox used to the only Lockbox responsible for all DV based AOS applications. Even then, new contract workers did occasionally reject DV based AOS applications for early filing, which is why the AOS Process Spreadsheet went to great lengths to call this out.

Hi Sm1smom

I send my AOS package to Phoenix Lockbox about 3 weeks ago but still I haven't got any reply or receipt. Is it normal to take 2- 4 weeks ?

Hello mom,

i'm writing you a follow up email. thank you for your response and patience.
1.what is the 2nl from KCC? I paid and received a receipt.
2. regarding the $330 fee, i have a family of 6 and i sent in the full amount $330 for each however, i got a receipt for only "two persons", im not sure where the rest of my money went. i sent kcc an email however their response wasn’t relevant or helpful. What should i do?
3. What is the meaning of the " current status" ?
4. i am under ASIA and for the past two months we have been at 18,000 and my number is within 28,000. is that normal? what is the likelihood that it will change? and if the numbers become current for may, does that mean, only 18,000 people are eligible ?
5. just to make sure, i have to wait till my visa bulletin number to submit my AOS?

1. Take a look at the “Abbreviations” tab of the AOS process spreadsheet.
2. How much did you pay and how many people did you list on the AOS Payment form which you sent in with your payment? The payment form/receipt which you earlier on posted shows you only listed $660 for 2 people on the form, or where you not the one that filled out that form?
3. Your status in the US, e.g. F1 status (student), H1B (worker), Parole (Humanitarian Parole), etc.
4. Yes, quite normal. I don’t know the likelihood of if when and it will change, I don’t make predictions. If Asia becomes “current” in May (unlikely IMHO), it means all CNs (assuming there are no exception countries) become eligible to apply.
5. You may decide to take advantage of the early filing option if your CN falls under the listed numbers in the advance notification section of the VB.

Regarding number 2, i found another email, with an updated amount of 990 for 3 people. now in total i paid 1650 for 5 people. i had to go back at look at emails to refresh my memory, sorry! i remember just sending the money orders with the case number and thats it. im not sure what to do next.

i mistakenly wrote you current status, i meant the word current that appears on the VP, why does it show that and what does that mean? does it mean that they're not going to update it?

I already explained the meaning of when a region is shown as “current” as against listing a cutoff number. The AS region is not yet listed as current, so you’ll just have to keep on monitoring it.

Hi Mom,

1-My daughter provided Biometric for an F1 visa seven months back. She filed her AOS and received the acceptance receipt on 15/02/2023. How does she know whether the Biometric requirement is waived for her or about the Bio scheduled date? Will she receive an email? Or does she have to open a USCIS online account to get all this information?
2-If all the documents are front-loaded, is there a possibility for an interview waiver by FO?
3-As per your experience with previous similar cases, will she be able to receive an interview before May? (Her Case number is AS19XX). She is eagerly waiting to spend Summer with her family :)
4-After she gets her Visa stamped, does she have to wait until she gets the Green Card to exit the US?

Thank you.

1. USCIS will send her either a waiver notice or a bio appointment notice by mail.
2. It depends on the FO. A front loaded package does not guarantee an interview waiver.
3. I can’t predict when she’s likely to get an interview. Use the Timeline spreadsheets (both current and past years) to get an idea of (a) if her FO has a tendency for waiving interviews and (b) how long on average it’s taken other filers from the same FO to complete the process.
4. If she gets an I-551 stamp (not a visa stamp as USCIS does not issue visas), she doesn’t need to wait for the plastic GC before she can travel as the I-551 stamp is a temporary GC.

Hi Sm1smom,

1. I recently got promoted in my current team. Should I list both the old and new title in the employment history? I am thinking of listing it once and clarifying it in page 20.
2. Does the spouse (derivative) need to provide evidence of financial support? It is not in your spreadsheet but the i485 instructions do not make it sound like it is required only for the principal.
3. Are all the items listed under Evidence of Financial Support required?
4. Don't laugh on this one: I need to include i797 and current i94. H1B approval notice has them both i797 and i94 attached to one another. Should I detach them or include the copy of the page as is twice?
5. I found my A# and will include in i485. I did not have it when medical exam was completed. Is that fine or should I re-do the exam?

Thank you!

1. I think you should be able to figure this out on your own - please use your discretion.
2. They can, if they like.
3. The spreadsheet contains “recommended” documents to be included as applicable, or as each applicant wishes.
4. Just use your discretion on this also please.
5. No need to redo the medical for that.

I am not really sure if it was because of the early filing. My case number showed current in march but I submitted my documents on Jan 23. I got accepted and have my biometrics scheduled already. I didn't even attach a memo. #ChicagoLockbox
