DV 2023 AOS (Adjustment of Status) Only

Hello, I realized that one of the affidavits i submitted as proof for completion of J1 requirements had a mistake on one of the dates. Instead of saying 16th June, it was saying 6th June. Is there a way I can send a corrected affidavit to USCIS ? Or Should I wait when I am called for interview to submit the version with out a mistake on it .

You cannot send a follow up document to USCIS without having received a RFE first. Hold on to your document and present it when you go for the interview, or send it in IF you receive a RFE for it.

My question is: when filling i-134 can I be both the beneficiary and the sponsor? I have all documents to show financial support of myself both salary, taxes and bank statements. Thank you in advance!

You do not need to submit an I-134 in this case. Just include your financial documents with your AOS package.

Thank you so much for your response, that makes a lot of sense! I should add some more information as well. I already sent my application package to USCIS at the beginning of February (knowing my number would be current in March) and they rejected it unfortunately saying I should apply only when the number is current. So I am going to resubmit. My question is:

1. Do I use the documents they sent me back (my original submission, which they have added a scanned number at the bottom/some other hand written notes) or do I create a completely new packet from scratch and send that?
2. Whether I do the former or the latter above, with the rejection notice, I also received the attached letter that asks me to put this with the resubmission. Should I put this letter in?
3. Should I put in the resubmission the I-797C rejection notice + other rejection materials they sent to me (i.e. a letter explaining the rejection in detail?). Should this also be part of my cover letter explanation?
4. And finally, in my original packet I had I-134. Is it ok if I do not put it now with the new packet? Or should I put it provided they may have already scanned it?

The reason why I am asking is a bit complicated... In the original submission, I had a sponsor for my i-134 who cannot be my sponsor anymore (as they are unemployed right now). That means that my i-134 has to change, and information on my i-485 such as household members and income has to change. If I send the original documents, this info will be incorrect. So am I allowed to send a new packet?

And if I do send a new packet, do I include the rejection letter still?

Wait, how's your sponsor part of your household member on your I-485? Does that sponsor claim you as a dependent on their tax filing?

Well based on the above, it seems to me like your I-485 was wrongly filled out in the first place as I do not get how your sponsor ended up being counted as a member of your household on the form. So yes, you might as well fill out a new I-485. Resubmitting the previously rejected forms is not a must, it however makes processing the new package easier for the Lockbox folks. One can always send in a completely new set of forms following a package rejection, not something I would do if the rejection is simply due to early filing, or missing signature for instance (and there is no other issue with the information on the previously submitted forms).

As a result, I was told by others to update I-485 to have 2 in the household number and count our total income as updated household income. I guess this was incorrect?

I should take back what I previously wrote regarding filing/claiming each other on tax filings. If you live together and share expenses year round, I guess they could qualify as household member in that case. I however wouldn't have listed them as my household member since they're not filing for AOS as my dependent. I would have listed just my income and half the expenses on my I-485 - that is what I would have done. Having your partner provide you with an I-134, and listing both of your incomes as required does not mean they needed to be listed as a part of your household on the I-485 IMO (I could be wrong).

And stop overthinking the new submission, just follow your instincts please. You can submit new forms for the entire package if you prefer. Remember, you may not need an I-134 if your current income alone is enough to demonstrate you're not likely to become a public charge. I'm assuming your income is above $21,850 (which is the applicable 150% above poverty guideline level for a household of 1) as shown below
