DV 2023 AOS (Adjustment of Status) Only

Thank you! But, I think my question was not clear. I have original document which contains two languages-- Nepali and English. Still do you think it is necessary to translate and certify?

Hi, In my birth certificate, birth registration date mentioned is of two year after my birth date (i.e birthdate is 1990 but registered date is 1992). Do I need to submit any additional documents with my birth certificate?

As long as your B/C is the long form B/C issued by the recognized issuing authority, whatever is written on it does not matter. So make sure you go through the Visa and Civil Documents Reciprocity page, click on your country to confirm what you have is the same as what is listed there

Can I fill these items manually by using a black ink pen (N/A to all items), as I can not do it using the PDF?

Is it normal not to get receipt number today 2 weeks passed . Also had form included in application g1145 with phone number and email . Or should I be worried getting rejected and application coming back to me

Do take a look at the Timeline spreadsheet to get an idea of how long on average it has taken others to get an update after sending in their AOS package. Worrying about the package being rejected and sent back at this point is pointless (IMO) considering there’s nothing you can do about it until the package gets back to you.

Your sponsor fills and sends you the I-134 (NOT I-130). Take a look at the AOS Process Spreadsheet for a list of the recommended supporting documents.

I am DV 2023 winner (AS15xxx). At the time of winning lottery I was in my own country (9th may 2022). Mean time I was selected for masters degree and came to USA on 5th of August 2022.

USCIS website says,

There are, however, a small number of lottery winners each year who, at the time of “winning the lottery,” are residing in the United States in a nonimmigrant or other legal status. For these winners residing inside the United States, USCIS processes adjustment of status applications.

Can you advise me if I am eligible to go ahead with AOS application even though I was in my own country at the time of winning the lottery. My case is now current in February.

I am in Michigan and in wake of the shootings bit scared to take uber for my bio appointment ...
Just wanted to know is there no way they move the appointment (in case there is too much snow or something unforeseen)
 
Hi again, (this might be a silly question) but my spouse and I received our interview letters in the mail recently, and I noticed we're scheduled for separate interviews 1 hour apart (New York FO). I'm the principal applicant and my interview is scheduled first. The letter directs us to ask for the same IO by name.

1. Can we both arrive to the FO for my appointment time or should we stagger our arrivals?
2. I had planned to prepare only 1 packet with original documents (documents like our original marriage certificate we wouldn't be able to provide in duplicate) - should I prepare 2 packets or attempt to pass the packet to my spouse after my interview concludes?
3. Am I overthinking this and will we both have our interview at the same time?

I recall you previously asked this question and I responded by saying you should be okay to proceed with AOS.

I do commend your observation and concern with the carveat re residing in the US at the time of the DV selection. I’ve only come just one case where the IO applied this “clause” and subsequently denied the case, even then it was wrongly applied IMO as that selectee was already based in the US on F1 but had brief gone home on a visit when the DV results got released. They returned to the US as previously scheduled to continue with their studies and subsequently filed for AOS when the CN became current. There have been several selectees who were not residing in the US at the time of selection but later entered on a NIV who successfully completed the AOS process.

That carveat IMO is meant to discourage folks who intentionally try to use a visitor’s visa for the sole purpose of coming to the US to file for AOS upon DV selection.

You can always contact the USCIS to reschedule your appointment if you feel you’ll not be able to make it, although not something I would recommend. Without trying to make light of the recent mass shooting which recently occurred, I think you need to find some means of overcoming your fears and not miss out on this potential once in a lifetime opportunity. Missing your bio appointment could lead to a denial eventually if they’re unable to reschedule your appointment. And yes, USCIS office could be closed due to inclement weather for instance, in that case all previously scheduled appointments gets canceled and rescheduled.

Getting two separate interview slots is quite normal. You however should both plan on attending the interview together. Since you’re scheduled to see the same IO, you most likely will be interviewed together.

While filling i-485 form, should I put the middle name into the middle name section, or needs to be included in the first name as it appears in the passport?

I have mailed my i-485 form and didn’t got receipt number yet my I-94 expires on March 4,2023
Will it be an issue if I file I-539 extension for visa , in case if my application gets rejected and sent back to me after the I-94 expiration. . Then I will be sure that for sure it’s rejected I just don’t want to fly out knowing maybe I will receive a receipt number and don’t want to abandon application.

Note the actual visiter visa in my passport expires on June ,2023. And I know I-539 takes a while ? What will happen if visa in passport expires and I am still waiting on process of I-539.

List the middle name as middle name on the I-485.
