DV 2023 AOS (Adjustment of Status) Only

I would like to add few things for future AOS applicants , despite all my attempts to have an interview from Brooklyn office, I couldn’t manage to get it before Semtember 8th. Seems like I missed my chance with few days. Brooklyn batched up other cases like mine and waited until September even though we sent our packages 3-4 or more months before, after many calls with Uscis, infopass requests, senator and congresswoman inquires, even a inquiry letter and walkin attempts.

My officer today, probably didn’t even have any idea about the quota cause when I mentioned it she didn’t even response.

Mine was batched like that. Current in June and ended up with Sept 2 interview. They shouldn't do that, but hopefully this year will teach them.

I hope they will learn something from their mistakes and won’t repeat it again for future applicants. The process entirely is overwhelming yet some FO’s make it worse.
 

Filled Ds 260 form online for dv lottery 2023 with no UCIS interview scheduled, can I go to my home country for J1 visa renewa.​

I am in USA in J1 physician visa with 2 year home country work requirement. My name was selected in DV lottery visa 2023 . I applied Ds 260 online form but I got to know that J1 are not eligible for Status change in USA through UCIS . So for J1 you need to renew it every year if you go to your home country. So will this DS 260 form will effect my J1 renew considering I just fill Ds 260 without any further work up for interview or anything.

It is not true that J1 is not eligible for AOS. Even with a pending 2YHRR, provided they’re able to obtain a waiver of no objection, J1s are eligible to file for AOS.

Now to answer your question, you demonstrated an immigrant intent with the DS260 submission, this may come up when you apply to renew your J1. You’ll need to be prepared to demonstrate the expressed immigrant intent no longer exists and that you plan on departing from the US at the end of your program. I cannot tell you if you should go home or not, you’ll need to make that decision on your own.

Sadly, I think it will continue into DV2024 at least, maybe longer.

If this is going to be the new normal, ending of fiscal years will be chaos from now on.

As you mentioned stop scheduling for new interviews would help people to save some of their time and money at least.

I understand it sounds ridiculous cause all of us were waiting for interviews yet ending the year this way is lot more travmatic.

When you add lawsuits, and the idea of making money out of this make everything more and more chaotic.

The law does not state each country has to receive 7% of the total number of visas, it only states no single country may receive more than 7%. So it doesn’t matter if your country only received 1% or 2% of the total number as of visa exhaustion. Once there’s visa exhaustion, that basically is the end for all pending selectees.

I wanted to know if the social security number will be sent by USCIS or if I will have to process it at the local administration?

Congratulations and thanks for the additional updates. If you requested the SSN be issued on your I-485, the the SSA official will send you the SSN card.

NOTE: If you currently have a SSN with DHS restrictions, they will still automatically send you the same thing. You’ll need to visit the SSA office with your GC if you wish to have a SSN card without DHS restrictions written in it.

Thank you very much Mom, I never had a social security number. On Monday I go to the SSA office with my GC to have an SSN card with no DHS restrictions written on it.

Please Mom, I'll send you the dates to help me fill in my timeline, I'm always having trouble doing so. Sorry.

September 1, 2023 Card Was Delivered To Me By The Post Office
September 1, 2023 We mailed your new card your Form I-485, Application to Register Permanent Residence or Adjust Status, directly to the address you gave us.
August 30, 2023 We approved your Form I-485, Application to Register Permanent Residence or Adjust Status.
August 29, 2023 We ordered your new card.
July 17, 2023 The fingerprints relating to your Form I-485 Application to Register Permanent Residence or Adjust Status, were taken.
May 16, 2023 We accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or Adjust Status. Our National Benefits Center location is working on your case.

On September 7th I received the approval letter
On September 8th I received the GC

What happens to work permits (EAD) received temporarily with form I-765 if they are not approved at this moment? Do they lose their status after September 30th or can they keep their status until those permits expire?

Was the EAD on your DV based i485?
