DV 2023 AOS (Adjustment of Status) Only

Hi mom, i received my interview decision today after 10 days. USCIS has denied my case on the ground of not maintaining an immigrant status and pending asylum doesn’t guarantee a status just like you explained earlier. My lawyer wants to file a motion and we will give it another shot just in case. Everybody here has been really helpful and especially you mom. Thank you for this platform where thousands have benefited and more to come. God bless you and God bless America . I’ve attached a letter just incase if anyone wants to go through and i suggest people who are in pending asylum please do not lose hope as there are cases where pending asylee with DV lottery winner has also been able to adjust status. Follow the guidelines here and give it a shot, you never know. Cheers

Hi mom! Today I recieved my bio notice, and interview notice at the same time.
1. is it normal that my interview date is the day before my scheduled bio date?
2. If I attempt to walk in bio, can I use the interview date as a reason for my attempt?
1. Yes, that is not unusual - this is covered in the FAQ section of the AOS Process spreadsheet.
2. Yes you can.
 
One more question, the interview notice says to bring an i-864 to the interview, and I see that most people in the forum bring an i-134 instead. Is it okay if I bring an i-864 instead of the i-134? Or for DV cases you have to use an i-134?

On top of each page of I485 there is alien number. Do I need to fill my alien number on each page on top?

Second since I am refilling do I also need to include my alien number both on medical form and declaration of financial support form?

Because I needed to redo my medical yesterday. I dont think I can file before August 22 and I am afraid would it be significantly late given the deadline is september 30. I am hoping they will waive my biometrics.

Yes, they most likely will waive the bio appointment this time.
How long ago was your previous medical report done? And how did your legal consultation go?

I did my last medical one May,2023 but CS denied me to reissue a sealed copy so I needed to redo my medical yesterday.

You advised me to either reapply or consult with lawyer. Given the time and riskiness, I just wanted to refile my application and no lawyer consultation at this time.

Hello @Sm1smom once I finished filling up the I485 form isn't the alien number supposed to appear on top of each page automatically? Or did I fill up the form I485 wrongfully?
Typing the A# (on page 2) at the top of the form normally gets the rest of the pages auto populated. If they’re not getting populated, you can just type them in yourself. No big deal.
 
Hi i got news 5 min before me and my husband card approved without interview.. actually everybody told be my husband could not take greencard because he was lost his f1 visa and he did aslyum but they approved his greencard too..this is hope for everyone. I hope you all get good news.

Need to set the records straight though as it is not true that “everybody” told you your husband your husband could not get the green card because of he was out of status. I believe I clearly pointed out the possibility of his OOS being missed and he gets approved with you as shown in the below response to your question back on July 18th to be precise:
So he was OOS for roughly 3 months before filing for asylum, the OOS may be hard to overcome in that case. But stranger things have been known to happen, there’s a possibility the IO may miss that detail and he ends up being approved with you.

Your husband case is not the first of such we’ve seen to get approved. We actually have a reported DV2022 case listed on the DV Tracker Unique Cases Spreadsheet

I am confused on number 20 and 22. Given my denial letter should I choose yes or no?
Not sure why you’re getting confused about those questions. Was a “final order of exclusion, deportation, or removal” ever issued against you in the first place? The answer to that question determines the responses to the questions you’re confused about.

As a result, everybody said that there was a possibility of not being taken as a result, and I was talking about my lawyer and the people in the environment I consulted. I did not write here for accusation purposes, but as a result, everybody said that there was a possibility of not being taken as a result. If I wanted to say something like that, I would have tagged you. Thank you for your current and previous responses.

Yeah, maybe I’m being too sensitive, you’re entitled to your opinion. And my post never said anything about you targeting me or this forum to start with.

However, if you come to this forum and post about “everybody” telling you something (without clarifying who those everyone are), and that something isn’t what you were told in this forum, I have a duty as a moderator to set the records straight which is basically what I’ve done! My concern is about the information shared in this forum, it really is as simple as that.
 
I can't make any corrections to you or I didn't make such an allusion in my article, and please let's not forget that everyone here (I say this as a generalization, maybe there are people like me, please don't get me wrong) or that we do not speak English very well and do not know some formal correspondence (language barrier) ) . Some words or sentences may sound to you in such a way that I told you in my above article that I am not targeting anyone. Hello @Sm1smom as I am preparing to refile, in the spreadsheet under AOS package you have suggested to include I-797 notice of action for current and past visa status. Do you think I need to include? Like my notice of action for receipt number and biometric appointment or am I also good excluding this notice of actions into my new AOS package?

No. Those do not demonstrate evidence of current or past status.

hope you are doing well.
As I understood from earlier messages, interview waive is mostly based on FO's preferences.
How about Bio waive? what factors are related for a bio to be waived?

(btw, I received my NOA letter finally, its now been 16 days and I am waiting for the bio letter now.)
