DV 2023 AOS (Adjustment of Status) Only

Hello mom, I have a initial consultant with lawyer tomorrow and I believe this will only help me with bunch of information on how to proceed ahead. I called USCIS and the lady told me that there is no way to meet IO until a judge says to do so but she says I can refile if the denial letter doesnt say so and they may also waive my medical report but I will be including it and my biometric fee in AOS application.

4. How am I supposed to know that? I was not on the call with you or the other folks, right?
2. In the previous post you told me to start with the House of Rep person, not the Congress person-so who should I write to?

It is basically a bunch of nonsense she told you. She could set-up an INFOPASS appointment if she wanted to help. Saying the medical report may be waived indicates she does not know one thing from the other.

If all you're waiting for is information from the lawyer on how to proceed, I will tell you right now you're basically wasting your time. You should either be preparing to send in another application or be looking for a lawyer who is willing to visit the FO with you ASAP to get the current denial over-turned.

"Congress" is made up of both House of Reps and Senators. So if I say initiate a congressional inquiry, it basically means contact your House of Rep person (which is usually the first level/step) or your Senator.

Hello mom thanks for your input. I tried asking emm live chat for infopass appointment and she told that USCIS doesnt schedule appointment with field office to discuss case decisions but she did requested for me and told that someone will call me in 72 hours. Given the situation and time limit, I think refilling is less risky here.

May I know how you got a chance to be called back by a Tier 2 agent? After typing Infopass what did you write? Thanks
 
Hi mom. is there any tracker spreadsheet for non-DV AOS cases? I am trying to see if my FO waives interviews, but so far I could only find two cases that were scheduled in my FO from all the past DV AOS trackers.
 
You need to ask for infopass appointment and explain why you need it. Then they will request it for you
I typed in Infopass, then selected "Make an Infopass appointment", and when she asked me "Briefly Describe the reason for your appointment:" she showed me USCIS pages with information and/or she put me in touch with a Tier 1 agent who never allowed me to talk to a Tier 2 agent :rolleyes:

Do you have any idea of how many non DV based AOS applications exist in general? If there are two reported cases of scheduled interview on the tracker, that means your FO does not waive DV based AOS interviews, it is really as simple as that, so no need searching all over the place for how now DV cases are treated.

Anyway, I have no idea, and I don't see the relevance of that information to DV cases. The mere fact of some FO are waiving DV based AOS interviews does not mean they do the same for non DV based cases. They're waiving those interviews because DV based cases are usually simple and straight forward, and doing so helps them better manage their workload.
 
Care to clarify who the "none" that did not believe you are? I was the only person that asked you in this post to back up your "there were lots of cases that were rejected for early filing" claim considering as at the time of that post, there was not a single reported DV2023 denial in this forum based on early filing. You think I'm not aware of possible case denial due to early filing, yet I put that warning all over the AOS Process Spreadsheet?

p.s. it is nice to show compassion/empathy to other people in their time of need. I find it quite distressing that your immediate response to someone whose case has just been unjustly denied was to jump on it and claim it as some sort of evidence. Your post appears as "gloating" over someone else's misfortune, just so you know.

Thanks to the senator, I received an response from Brooklyn FO:

U.S. Citizenship and Immigration Services (USCIS) records confirm that Mr. Vega2000's case is currently awaiting a related alien file that is needed to proceed with the adjudication of this case. Once the related file has been received, the Brooklyn Field Office will make a determination on the I-485 application and will inform the applicant of the next action taken on his case.

I gave my bio and fingerprints at June 28th, I will open a ticket on August 28th. Yesterday I went to the FO and left an inquiry letter about my situation.

Is there anything else I can do at this point?

Yes, we know there are other DV based AOSers who are not in this forum or sharing their information in this forum, even though they are in the background consuming the information being shared in this forum. Nonetheless, it would have been more helpful if you had backed up your previous post by simply stating I know of 2, 3, 4 (or however many specific cases you know of) with X, Y, or Z FOs who either got rejected or denied due to early filing. That would have been a lot more useful, and maybe folks who fall within those same FOs would have been aware of such outcomes and would therefore not have proceeded with early filing. That is the essence of this forum, sharing useful information to help one another. Instead, you kept quiet and waited until one reported case from this forum got denied and then you came out to say "none" believed you. That is why I called out your post like I did.
 
Hello mom also when refilling is the only change in form I485 is to include alien number?
I cannot out-rightly say YES or NO as I'm not reviewing the I-485 from the POV of someone who is re-filling. You will need to ask about any specific section of the I-485 which you may not be clear as to the applicable answer (like you did yesterday).

I already informed you about one week ago that your FO seems to be bunching up DV based AOS applications - there are a couple of other AOSers from your FO who filed way before you did who are still waiting, not sure what else you expect me to tell you you need to do considering those folks already did everything you've done to date.
 
Hi mom, i received my interview decision today after 10 days. USCIS has denied my case on the ground of not maintaining an immigrant status and pending asylum doesn’t guarantee a status just like you explained earlier. My lawyer wants to file a motion and we will give it another shot just in case. Everybody here has been really helpful and especially you mom. Thank you for this platform where thousands have benefited and more to come. God bless you and God bless America . I’ve attached a letter just incase if anyone wants to go through and i suggest people who are in pending asylum please do not lose hope as there are cases where pending asylee with DV lottery winner has also been able to adjust status. Follow the guidelines here and give it a shot, you never know. Cheers

Hi mom! Today I recieved my bio notice, and interview notice at the same time.
1. is it normal that my interview date is the day before my scheduled bio date?
2. If I attempt to walk in bio, can I use the interview date as a reason for my attempt?
