DV 2023 AOS (Adjustment of Status) Only

I received a letter from the San Francisco field office this afternoon for my I-485 interview. Hopefully, the remaining SF applicants get their letters within the next week.

I also received a call from a Tier II officer this morning. The officer mentioned that they're aware of the timeline for DV applicants and to not worry about the potential visa exhaustion. The officer mentioned that once you've submitted the payment to the KCC they will allocate a number to you for your I-485 application. He told me there was a glitch in their system where in a previous year under the Obama Administration that applicants who had already paid the DV fee, I-485 fee, and had been interviewed were denied due to visa exhaustion. He told me that this is something we should not worry about. He said that if we do not have an interview or anything by September 15th to make sure we get in contact with USCIS to ensure we don't miss out on this opportunity.

Interesting. What's the significance of the number that gets allocated to you when it comes to remaining visas? If he's saying visa exhaustion isn't anything to worry about then that implies a visa is reserved once you pay the fee, which is contrary to what everyone has been saying. Or was he only talking about those who have a decision pending, rather than those waiting for their IL?

He said that the Kentucky Consular Center basically allocates a visa number for an adjustment of status candidate once the payment has been made. The letter you receive from KCC advising you to adjust status when your case is current is their way of telling you that they're allocating a visa number for an adjustment status candidate. This is what the officer told me this morning. He seemed very knowledgeable about the DV program AOS.

According to the timeline section, most people have received their biometric appointment letters less than 20 days but in my case, 37 days after receiving my first status update on the first NOA letter, I have not yet received any biometric appointment or any letter to inform me in what step my case is being processed now. I asked for live chat 2 times from Emma but both agents only told me:
“From what I can confirm at this time, this case is within the normal processing times and is pending a decision from the USCIS office that has jurisdiction over this case. You will need to continue to wait for further updates regarding this case.From what I can confirm at this time, this case is within the normal processing times and is pending a decision from the USCIS office that has jurisdiction over this case. With no more explanation, they disconnected the live chat quickly after their answer. I am worry about the end of FY. I asked them for an expedition, I also mentioned that my case is dv lottery but I was told that I am not eligible.
Would you please kindly advise me about what to do to follow up on my case status before it gets late?

Similar to how you request for case status or Tier 2 call back through Emma, I explained my long wait after the interview. I then requested the officer to submit an expedition request on my behalf to my FO. I was asked the reason for my expedition request (similar to the list of reasons you see on the website), to which I answered "other reason" and explained it.

PS. I was informed there's no guarantee my request will be approved and in case of further requirements, I would receive an email.

4) Could you also explain to me what the Lawfully app you are using is and what it is for?

My AOS package was delivered on July 5th but I haven't received any e-notification or NOA, my cashier's check has not yet been cashed and I'm afraid something has happened. We are less than 70 days away from the end of the fiscal year, so I need to know if it is possible to hear about my case and/or make an expedite request.

How did you contact Tier 2 and get a phone call? After 16 days my cashier's check has not yet been cashed and I can't just be patient and wait.

Wow, what great news to hear! Especially as many have asked about where the AOS visa allocation comes from.

Someone told you what you wanted to hear. You can all familiarize yourselves with analogous thread from dv2017 and see why it's not true.

I use lawfully app i got notification and my I-765 said case closed benefit received by other means do you know guys what is it mean?
1. Is this for your AOS based EAD?
2. What does your I-485 online status say?
3. Do you currently have an approved EAD card?
 
Hi @naksvegas can I contact you privately? I didn't quite understand what you did (I didn't know it was possible to request an expedite through Emma or use an app) and I would like to know how to do that too because I am still waiting to receive my e-notification and NOA and I am going crazy :(

You think if there’s some way of following up with a yet to be processed AOS package (which is pending for less than 30 days) I wouldn’t have share that information with you by now as against telling you to be patient because there’s nothing you can do about it for now?
 
Hello everyone!

I’d like to start by saying a big thank you to Sm1smon and other forum members who help me throughout this process. This journey would’ve been tougher without your support and help, again thank you from the deep bottom of my heart.
So, here’s my timeline from the Portland, Oregon FO and my case number was current in January (I’m line 19 on the spreadsheet):

- January 04th, 2023: AOS package was delivered
- January 28th, 2023: NOA letter was received
- February 14th, 2023: Fingerprints were taken
- May 30th, 2023: Status online changed to “RFIE was sent” (while another member of this forum from my same FO had her status online changed to “new card is being produced” that same day)
- June 2nd, 2023: The RFIE was received, asking for my birth certificate, it seems like what I sent in my package wasn’t an official birth certificate
- June 16th, 2023: The RFIE was delivered to USCIS
- June 23rd, 2023: Status online changed to “We received your correspondence for Form I-485 and USCIS is reviewing it”
- July 11th, 2023: Status online changed to “New Card is Being Produced“
- July 21st, 2023: GC was received in the mail!

I hope my journey helps current/future AOSers, especially since there’s not many members from Portland, OR Field office in the forum. But overall, thank you very much for your help and support Sm1smom, and I wish all the best to anyone in the waiting!

What files does KCC send to USCIS upon request ? Does KCC send Visa number for Applicant along with KCC files or how does it works ?

Hi Sm1smon, I did my fingerprint on May 8th; after that, I have no update from USCIS. I did contact the congressman's office for my case inquiry (July 8), but they have not received an update from USCIS, as they say. Do you think my case is in AP? We don't have many cases in the timeline spreadsheet for the Providence field office to compare. What do you suggest at this point? Just keep waiting or I should proceed with any other actions? I'm just confused because here people are talking to Tier 1 and 2 (I don't know who they are), going to offices (I don't know if USCIS or not), getting calls (I don't know how and from whom), using apps, and it seems to speed up the process... :(

By “most people”, are you comparing your timeline to everyone in general or to folks assigned to the same ASC as you?

Could what happened in 2017 be due to the glitch that @DIESEL1337 mentioned? Obviously last year they went over the cap including AOS cases.
If all remaining DV2023 visas are already allocated then where will the visas given out to AOSers between now and Sep 30 be drawn from?

If I were you I would take some good time to read the well-structured Excel sheet prepared by @Sm1smom. It has beneficial links and simplifies the process.

1. Emma is a chatbot on the USCIS website. She can connect you to the live chat agent.
2. Tier 1 Officer is Emma and the agent you chat with through Emma, from what I have learned you make a request to speak to the Tier 2 officer.
3. Please refer to Mom's Excel sheet.
4. It is a third-party app for tracking your case.

Let's just wait and see what happens. It's a valid point that they f'd up once so they might do it again.
