DV 2023 AOS (Adjustment of Status) Only

Hi Mom! What could this status mean/lead to? It doesn't look like RFE. For the record, the previous status was "RFE sent" which I replied to.

Notice Explaining USCIS Actions Was Mailed

On July 11, 2023, we began reviewing your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number ###. We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials.
I have no way of knowing - it could be anything. So you'll just have to wait and see what shows up in the mail for you.

yes i did thank you, however do they need to be transcripts or can i just send the tax returns?
Again, what is recommended is listed on the spreadsheet. You however can send what you have/wish to send in place of what is recommended on the spreadsheet.

Good morning/afternoon/evening to fellow AOS applicants, BritSimon, Blade_, and, of course, special greetings to
Sm1smom!

First and foremost, I'd like to express my gratitude for the forum and for the tremendous amount of effort you do, thanks a MILLION.

My case number is EU28***, I've sent all the necessary documents as soon as my CN became current (April), a week later I received my receipt number, then my biometrics were taken, and since then (Apr 12), unfortunately, I haven't gotten any updates.

Recently I called USCIS, and a tier 1 agent mentioned that my case at the NBC, a bit later I was able to get a Tier 2 agent, and he mentioned that my case has moved to Queens FO, the location is in NY (Manhattan), NY.
I requested a Tier-3 callback from USCIS just to remind them about the DV deadline and ect.

Would it be ok if I address my concerns to a Tier 3 agent with these:
As you might be aware, there are some specifics in DV category due to the deadline of September 30th.
Would it be possible to submit an inquiry to my FO office to review my case ASAP and schedule an interview If necessary please?

Also I'd like to add my data to the timeline spreadsheet please.

Have a wonderful day ahead.

I would like to thank the creators of this forum for all advices and help. It would be impossible to make AOS without you. Yesterday my status was updated to your new card is being produced. My feild office is Portland. Please let me add data to the timeline spreadsheet. And another question, I received all the letters to PO Box address without problems, is it worth changing it to a physical one or will a new card come without problems?
Thank you so much!!!

Just for your information: my FO was NY Queens - they are fully aware of the deadline for DV AOSers, and the process is already expedited

Also, they have a tendency to batch DV cases together for processing/interviewing.

I haven't seen cases where interviews have been waived by FO NY. If You want to, you can take a look at my timeline which I think is very standard/normal for NY

Thanks for letting me know about these specifics of FO, NY. I really appreciate that.

Hello. I attended my interview last Wednesday and i have not heard anything response. No update on the uscis case tracker and no mail yet. What should i do because i feel like cases are decide within a day or two??

Hi @Sm1smom,
I have received a response from the congress office as follows:

"We have confirmed that this case remains pending and will be scheduled for an eligibility
interview when an interview slot becomes available. U.S. Citizenship and Immigration Services (USCIS)
will contact your constituent directly when an interview is scheduled or if additional information is
requested prior to the interview. Case status may be monitored online at
We hope this information is helpful. If we may be of further assistance, please let us know."

I did indicate that I have already attended my interview in the submitted form.

1. Does the congress office send the inquiry to USCIS or the local FO?
2. Do you advise I clarify this with the congress office and continue to follow up?

It looks like a USCIS Tier 1 agent responded to this inquiry. They entered your case number on the USCIS website and generated a generic response.

Maybe your background check clearance is still pending, hence the non-approval for now. You just need to remain patient for a while at this point.

1. Local FO is part of USCIS.
2. Follow up with your congressman's office to clarify the sort of assistance you're seeking

I will do that.

In relation to the submitted Service Request through USCIS, the feedback is: "We researched the status of your case and found that your application,***, is currently pending review by an immigration officer at the Boise Field Office. You should receive further information regarding your case in the next 30 to 90 days. If you do not hear from USCIS within 90 days of receipt of this notice, you may contact our National Customer Service Center using the information listed below."

We have less than 90 days to the end of the fiscal year. What do you suggest I do concerning this feedback?

I filled form G-28 on July 1st.
Do i have time to get an interview ?
I don’t understand the correlation between your submission of form G-28 (you authorizing USCIS to correspond with your attorney on your behalf) and being scheduled for an interview.

I will do that.

You cannot do anything about it except be patient and remain hopeful. It’s possible your background check clearance is pending. The IO can only will adjudicate the case after the background check clears.

Hi,
I received from USCIS Request for evidence. Despite I noticed that I have a College and a University diploma, and more than 13 years of qualifying work experience, which requires at least two years of training they asked me: Submit proof that the DV principal applicant has a high school education or its equivalent, or two years of qualifying work experience as stated in U.S. law.

What documents I should submit? Only a high school certificate, or is it better to send all educational diplomas?
And another question - I graduated from medical college and medical university, but for more than 18 years I'm working in IT. In the U.S. I'm working since this May, but in a position that usually requires at least a bachelor's degree and 2+experience in management.
Are a Job Offer and W-2 forms will be evidence of this?

The list of documents I sent to USCIS:
- i-485, G-1450, G-1145
- 2 photos
- NL1, NL2
- DV fee reciept
- birth certificate
- marriage certificate
- children's birth certificates
- passport pages copy
- i-94
- confirmation of sending DS-260
- i-693

Please advise, should I send any other additional documents to avoid further RFE?

Thank you.

Hello @Sm1smom so today I‘ve received a denial explanation letter . As I thought the reason for denial is failed to maintain lawful status since my J-1 expired and I received TPS. It’s the one and only reason for the denial. I did not accrued any unlawful presence. Also they stated I was lawfully present in the US as non-immigrant in the time of filing I-485 application. I will file a motion for reconsideration. My failure to maintain status was through no fault of my own. I timely applied for an asylum and my case was not ultimately decided on until it was administratively closed by BIA.
I will write an explanation brief along with i-290B. Mom, I would really appreciate any suggestions from you! Thank you!
P.S. Do you think it would beneficial to obtain an I-601 waiver. My mom is a US Citizen.
