DV 2023 AOS (Adjustment of Status) Only

I'm filling out I-824 and I'm having doubts about some field like
Part1. at point 4, 5 and 12 ?
Part2 at point 1c ?
Part3 at point 1a, 1b, 1c and 1d ?

Do I need to fill out I-130 ?
I typically do not provide guidance on how to fill the I-824 as it is not a part of the standard DV process guidance which I provide here. However I took a look at the form and I do not understand precisely what doubts you’re having about the sections you listed:
Part 1. Q4: You should know whatever your current immigration status is
Part 1. Q5: You’re not a USC, so you wouldn’t have a naturalization certificate number, correct?
Part 1. Q12: You came across this same question on the I-485 you submitted for yourself, correct? So same answer.
Part 2. Q1c: I can’t help you figure out the embassy with jurisdiction over the country where your family is currently based, you need to figure that out yourself.
Part 3 Q1a: I-485 (Pending Adjudication)
Part 3 Q1b & 1c: You should be able to find the information on the acceptance receipt (NOA) for your I-485.
Part 3 Q1d: The case is not yet approved, so you have no approval date.

You have no basis for filing an I-130 at this point since you’re neither a LPR or a USC.
 
The steps involved in processing a DV based AOS application are well laid out on the AOS Process Spreadsheet. You need to spend some quality time reviewing each sheet of that spreadsheet to enhance your understanding of the steps involved.
1. If you file before your CN falls under the numbers listed on the VB, your application will be rejected. If it manages to make it through without being rejected by the Lockbox, it will subsequently be denied by the FO.
2. See response one above. Stop wasting your time by calling the USCIS, you will not be provided with an accurate information regarding the process. So, familiarize yourself with the AOS Process Spreadsheet.
3. Medical exam validity is covered on the AOS Process Spreadsheet - familiarize yourself with the tool.
4. Yes you may make the payment now if you like, as long as you’re aware the fee is non-refundable if your CN ends up not becoming current. So again, familiarize yourself with the AOS Process Spreadsheet. Spend some time going over the FAQ sheet/tab of the spreadsheet.

I just have two more questions regarding my case,
Since I have entered US less thank 3 months now, is it the violation of F1 rule if I file I485?( I already got denied for my F1 at my first attempt due to the d260 That I have filed and got approved at my second attempt, so i dont wanna make another problem) So, if I wait to pass the third month of my entry , would I be ok with this matter?
Secondly,, I already emailed the KCC about my relocation to US from Canada, and they responsed me about teh possibility of being eligible for AOS, But should I email them again and ask them to transfer my file to USCIC ?
I mean, should I first ask them to transfer me to AOS and then file my 485? or can I await their interview letter and file my i 485 simultanealy to see which one goes through faster? ( is it either or? or I can have both options?) I am asking this because my case number is still not current and we are getting close to the final months of FY.

Update ! I’ve got letter from USCIS request for evidence , my question is do I need to submit all documents to response this request or just only one document that they asking for ?

1. The answer to your first question is “it depends”. Since your first F1 application was denied on the basis of having submitted your DS260 form, how did you overcome that denial? You’ll need to be specific as to the questions they asked you at the embassy about the DS260 and the answers you provided both during the first and second F1 applications. The solution is not as simple as waiting for the 3 months before filing for AOS.
2. No, you cannot pursue both options at the same time. You’ll need to select one and stick to it. If you wish to process AOS, you’ll need to contact the KCC and specifically inform them of your plan to do so and request they switch your case processing from CP to AOS. This means they will not schedule an embassy interview or forward your case file to the embassy. The case file will need to be forwarded to USCIS instead. But before you pull the plug on CP, we need to know the answers to my above questions first to determine if switching to AOS could be a good move or not.

You need to provide more information as to what the RFE is about in order to get the appropriate response on what you need to do. Without you stating what the RFE says, I can’t tell you if you submit all or just one document.

They need copy of original foreign Birth Certificate of me which is Thai birth certificate so should I submit Thai one and translated one or just Thai birth certificate , Thanks

I would submit both in this case if it was me. I agree they've acknowledged receipt of the translated version, but personally I would err on the side of caution by submitting another copy of the English translated version with the copy of the requested original Thai version.

my J1 visa will expire in August that’s what I’m worried about possibly vary depends on case I understand but do you think my card will come before September?

1. No one can tell that other than your IO. I see you haven't had your interview yet, so let's first wait for that.
2. There is nothing to worry about, other than not being able to be employed. You can stay in US as long as your AOS package is not adjudicated.

The copy of the original version you submitted, is it the long form B/C which contained your DOB, place of birth, both parents' names and annotated by the appropriate authority indicating that it is an extract from the official records? Is the document you have (which you previously submitted) the "Sutibat"?

Yes , Thai Birth Certificate that’s called “Sutibat”
