DV 2023 All Selectees (Consular Processing - CP)

Many Asian families may have multiple generations living under one roof and the occupancy may be in multiple digits, it however doesn’t mean it is officially sanctioned or that it was disclosed as part of their immigration process. It’s like saying because person A engaged in an illegal activity and got away with it (not saying 11 person occupancy/household is “illegal” in this case), person B should not be sanctioned or prosecuted when the applicable authority gets wind of what person B did. The CO is a government official who made a judgment call.

Sorry if you misunderstood my earlier response. I was saying, unless the CO determined how big the residence is, it is unfair to deny someone's application based "overcrowdness" without determining the size of a residence. For example, a 2000sq ft 5-bedroom home can easily have an occupancy in the double digits...and it is perfectly legal in most (if not all) US jurisdictions. I also think that this is in perfect alignment with the building codes as well. If you use the widely used "2+1" rule, a five bedroom home (e.g. with one finished basement bedroom...which is very common for most single family homes) can have a double digit occupancy (perfectly legal).

So, unless the CO has more information than we do in this case, I still think this is an unfair decision. I could cite the building codes and Federal Occupancy Standards here, but that does not help in the situation at all...except unnecessarily stretching an endless debate. Not sure if these decisions are appealable, but if it were me, I would save my energy and look for an alternative host.

when should I start worrying about not getting an interview? I am AS20XXX, Asia region current numbers did not move last month, I hope they do this month I am not that far away!

Hi everyone

1. I am trying to register my appointment but I am seeing an error saying that my case is not ready to schedule even though I have received the 2NL a week ago , would like to know what to do

2. I did not receive a notification from the embassy on the instructions about the list of documents that I have to bring . How should I contact them for that or is there a specific list that I have to use ?

Thanks in advance

2. Check your embassy's website. Most embassies do not send out a follow-up communication regarding list of documents or what you need to do.

Hello

1. I would like to know if it is sufficient that the sponsor bring only the i134 form or if other documents are needed .

2. Can he send the documents is mail or physical signed documents by post ?

Thanks in advance

Thank you to all the angels for your previous answers. I was able to get my police certificate from Canada on time, I have an interview in two weeks.

I would like to know how I should proceed to change the host address (address where I want to receive the green card).

I know that I will be able to do it during the interview or at the point of entry.

I saw, from previous interview experiences, that the CO will ask you if the information provided is true at the start of the interview, should I answer:
"Yes, and I would like to change the host address, here is the new host information [name of the host and address] sir."

Or do you suggest another way to introduce the address change? I might be overthinking it but I better be safe than sorry.

1. The sponsor should provide you with a copy of their IRS tax transcript and government issued ID in support of the I-134.
2. Email is fine.

Yes, you’re overthinking this. Use your discretion on how to approach the address change when you go for the interview. Preparing an exact speech of what to say in advance is a waste of time IMO.

1. Probably depends on the embassy as I have heard different requirements. The embassy should specifically tell you want is required. In my relative's case they wanted " Completed affidavit of support form I-134 by your U.S. sponsor and the sponsor’s current tax returns. ... Completed affidavit of support form I-134 by your U.S. sponsor and the sponsor’s current tax returns, form 1040 and W2s. " The sponsor must send the documents to you and you take it to the interview. Some sponsors are reluctant to do that as the documents contain very personal income-related PIIs (personally identifiable information).
2. He can scan the documents, email them to you. You can then print them and take them with you to the interview. At least, that is what my relatives have done, and it worked.

Did you get detailed instructions from your embassy?

Hi, after reading the conversation, I'd like to suggest not to be so quick in dismissing the different experiences at different embassies. Yes it is indeed possible that the CO would ask more details about the address holder/host/sponsor. Some embassies, ESPECIALLY in African countries, have been known to conduct interviews with more scrutiny. For example, These days we are even hearing interview stories (people giving their own accounts on YouTube or Facebook) of people being asked to solve math questions. This is because some embassies are suspicious of fraudulent high school documents.

From the African groups, we see that people are asked a lot of detailed questions about the host because the CO wants to ascertain that the applicant knows where they are going, in case the ds260 was filled out by an internet Cafe worker, which happens a lot of the time.

So although a lot of interview questions might seem bizarre, we can't discount real stories about experiences that happen in some countries but not others.

Thank you.
Yup, I’ve now used the block function twice already since I’ve been back. It’s a sanity preserver lol.
i don’t get people who come for help then continue to insist their misinformation is correct…thankfully these people are in a very small minority.

Thanks for sharing.
I did not get any instructions from the embassy ( Dakar embassy ) .

I’ve kind of asked this question before apologies

Can my sister file form I-134 for me if she is still a non-resident but will be getting a green card through her employer in the next year? She has bought a house in the USA and earns a high salary. I am a DV 2023 winner Africa Johannesburg. If not how many months bank statements will I need and how do they scrutinise those statements and will 10k be enough? I will also have two properties to sell if I get a get a green card as well as a car. I will present proof of those bonds and valuations + ownership of vehicle at the interview. Does the fact my sister has a place for me to stay on arrival count for anything if she is a non resident working towards a green card? Thanks

Ideally, it is preferable for a LPR or a USC to provide the the I-134. But if you have no other choice, you might as well obtain it from your sister as a backup option. The CO may be willing to consider personal savings of $10K adequate for one person.

Thank you for your quick reply, could I pick your brain a little more? So by saying I have place to stay with family on arrival even help then. I won the green card last year I applied for a holiday visa in October and was given a new 10 year visa with a 2 minute inteview. The officer also confirmed with me she can see a DS260 filed on the system and just asked me if I know how the visa works and I said yes I must leave after my holiday this was Dec 2022 Is this a good indication of how the embassy views me seeing as they gave me the holiday visa while acknowledging they see the DV status on their systems.
will 3 months bank statements and properties to sell help. Apologies, I see on xarthisius site there are a high number of 221g for Johannesburg and I have a high case number and any delays will almost definitely ruin my chances if I even get an interview with such a high case number.

I see on the form there is space for non resident sponsors or am I reading it incorrectly.

thanks again appreciate your help

How the embassy assessed your NIV application has no bearing on how they will assess you IV application. The most important thing for a NIV processing is for the CO to be convinced an applicant has no intention of overstaying their authorized stay if given the NIV. That is not the same thing they will be focused on when it comes to an IV - which will mainly have to do with if one met the requirements for the applicable IV and if they are unlikely to become a public charge. If in doubt, plan on taking along 3-6 months worth of bank statements to demonstrate you have enough savings to support yourself and ensure you're unlikely to become a public charge. More weight is accorded to liquid assets (money in the bank) compared to other forms of asset such as properties.

Some embassies require NIV applicants to fill out the I-134 to demonstrate they have enough personal money to support themselves should their visa application can be approved - that section you're referencing is for such applicants.
