DV 2023 All Selectees (Consular Processing - CP)

I received 2NL with appointment next month. Currently, I am on H1B visa with i-485 pending ( employment based , could take several months to be approved) .
Is there any issue with following consular processing and attending DV interview, knowing that another process is pending ?

No issue with going for a DV based CP interview while an employment based AOS application is pending. The only thing you need to be aware of is if you, for one reason or the other, are placed in a prolonged AP, you may not be able to return to the US (depending on what the reason for the AP is) until that clears up.

I’m not talking about an Advanced Parole AP for your pending employment based AOS application - I’m aware an AP is not required for a H1B status needing to leave the US while their AOS application is pending.

Having a valid H1B visa wouldn’t matter if there’s an inadmissibility that requires an extensive AP (administrative processing) that needs to be resolved.

1. For CP should we have the tax returns from US since we worked here on H2b for many years?
We have filed with Turbo Tax and also received the stimulus check.
2. If we meet the Presence Test we are considered "residents" for tax purposes and we don't have to amend them?
Am I understanding this right?
2017-2019 worked year round
2020 - 5 months
2021- 8 month

Hi, I would like to ask if there are any forms I would need to fill out for the U.S. Border and Customs, something like the U.S. customs declaration form (6059B)?

1. Take anything and everything you feel could positively impact your case and only present if requested/required, it's not like you'll get charged for taking along extra documents to the interview. Better to be over prepared than be caught off-guard.
2. If you met the alien residence test for tax purpose as at the time your income tax filing was done, there's nothing to amend at this point.
 
Hi, quick question, is it normal to wait for like 4 months and still have your ds260 at kcc? I mean it's kind of a long time for a form to be processed and I was wondering what's the medium time to wait on these, just by curiosity. Thank you !

When did you submit the DS260? September-October?
From what I've read on BritSimon's blog and here on the forums, KCC is processing the DS submitted early (May-July),that's the bulk of it. And now slowly getting to later submissions.

Actually yeah the beggining of september, because I had to solve some things with the wedding, but from what I heard from other people they process them like all the time, I know that it will take some time due to the big volume of them but 4 months and still nothing is kind of weird.

Unless the pace has changed for 2023, I know people who submitted in September 2021; their DS260 was only processed in May 2022.

Yeah, I didn't put in my perspective the 2020 and 2021 due to the pandemic and I assumed that the rythm will be very very slow.
 
Do they only process your DS260 once your case number is current? I submitted mine in May last year a few weeks after the lottery was drawn but I have a higher case number and mine hasn't been processed yet.

How do you know that yours hasn't been procesed yet? If we email KCC, they reply with a standard email, I believe. Is this how you know whether it has been processed or not?

I submitted mine in May but asked to unlock my form twice (in Nov and Dec 2022), do we know if they process such forms based on the initial submission date or based on the date when it was resubmitted? Thanks!

Your forms have been received and are currently processing. Allow several weeks for processing. Interviews are scheduled numerically based on case numbers that have completed processing.

Hi guys, so I submitted my ds-260s on July 1st,yet they are still currently processing. Is this normal that it take more than 7 months to be processed? I'm worried with regards to AV queue. I'm afraid 69**
