DV 2022 AOS (Adjustment of Status) Only

Your background check clearance, (regardless of if you had done a new bio or they used a previous bio tied to your TPS application), is what is holding up your AOS decision, you cannot do anything to expedite the clearance unfortunately. You just need to be patient for now.
Thank you, is it very abnormal to have the case statues at finger prints while the case continues?! Like in my case I completed the interview but case statues sill at fingerprints.. ??
 
1&2. Maximum number of visas available per region includes both CP and AOS cases.
3. There’s only one way to find out. You wouldn’t know if you don’t try.
This seems like a different answer to what was posted earlier in the forum (pg 155 and copied below). Which is correct?

Regions don’t hit hard limits. If a hard limit is reached - the 55k total or the 7% country quota - then yes it will affect AOS applicants.

My interpretation is that the first reply states that there is only a country cap (7%) and total cap (55k). But the second reply indicates that there is also a regional cap. I'd like to clarify if there is:
1) a country DV visa cap
2) a regional DV visa cap
3) and are AOS applicants subject to the caps in 1 and/or 2?

Oh boy! This is why I prefer answering questions directly related to processing as against getting into available number of visas and all these technicalities, I’m not even sure where to start from with unwrapping this. Okay, bottom line is both CP and AOS applicants are subject to the same cap number, be it country or region.

1 & 2: I’ve never heard of one single case where someone has had a previously scheduled CP interview rescinded, or not been given a visa number via AOS, because a regional cap has been reached (because it’s not a hard limit). On the other hand both those things have happened for both overall quota (55k) and country quota (7% of total). Both overall and country quotas are outlined in the DV information by the way.

You have had 3 consistently answered that AOS falls into any relevant caps. Why would you think it doesn’t??

Question on the issuance of a new Social Security. My SS card has a language that says "valid for work only with DHS authorization". I understand that by answering yes to point #16 & 17 of the form i-485 I should be getting a new card without the "valid for work only with DHS authorization" language. Is this correct and I should only patiently wait (I got my GC 2 weeks ago) or should I visit a SS office to get it issued? Thanks!
 
@Sm1smom hello and thank you for all the efforts on this forum, I have to say I almost read every thread so far and have some questions for you.

Thank you already.

1) About the IRS transcript, I had worked in the US last time was about 15 years ago and filed my taxes back then. But since then, I did not work at all and do not have paper work. So, I do not need the IRS tax transcript, right?
2) I know I can pay the KCC and USCIS with money orders. I was going to do the USPS money order, but they have a limit up to 1000 USD for each money order, so for the USCIS payment I do not want to send 2 money orders 1000+the remaining. I want to send money order from Walmart, I guess they sell MoneyGram money orders, is that acceptable?
3) When I was last in the US, I had applied for OPT and had a EAD card which I did not use at all. On the card, there is a number called A# in the format of ABC-XYZ-FGH. This A number is the one I should use on my I845 form right? (I guess it is a unique number and does not change over time)
4) I had J1 status almost 20 years ago and F1 status about 15 years ago. Must I find my DS2019 and I20 forms to send with my AOS package?
5) Finally I just want to confirm 1 thing, if I will be the only one adjusting status in the US, and other family members not doing this, I will have to pay for KCC and USCIS only for myself, right?

A bit of background:

– I have not received my 2NL yet
If you have already submitted your DS260 and put CP down, you’re going to have to contact KCC and let them know you are switching to AOS anyway.

The 2NL for AOS and CP is different, AOS 2NL justs acknowledges your intentions to go the AOS route, for most folks it comes after paying the fee (although I got mine after submitting my DS260, I selected AOS… didn’t come for a few months though), then it’ll be another month to get your payment receipt after you submit the KCC payment, then another few weeks to get your acceptance text for your package (maybe more), then waiting on biometrics appt, then interview appt.

I was current in June, sent doucments in April, began preparing in October 2021… and there’s plenty of people waiting to be interviewed in Aus/ going to Suva. Probably should make a decision asap.

I don’t know the answer to your question but, in the 6+ years I’ve been living in the US… I can count on one hand the amount of times I’ve had to show my actual SSN card, and mine has the same wording. I want one without too but, it’s the number that’s important.

The wording on my SSN hasn’t impacted me at all, and that wording hasn’t been relevant to my situation since 2016.

That’s the whole idea, for them to issue a new or a replacement SSN card without a DHS restriction (as the case may be). You can wait a couple of weeks to see if the replacement card shows up, if it doesn’t (someone else in a similar situation reported theirs didn’t), then just visit your nearest SSA office and apply in person.

1. That means you will not have (different from “need”) an IRS transcript to include with your AOS package.
2. I’ve read of a couple of folks who used Walmart money order in the past.
3. Yes.
4. The I-485 instructions says to include those documents as evidence of continuously maintaining a valid status.
5. Correct.

Money order from Walmart (Western Union) have same limits that USPS does, you can't buy money order more than 1k per
I would suggest buying Money order from USPS because it's easier to track (online immediately, takes seconds) comparing to Walmart (you need to call ~ takes 1-2 minutes)

I am on a H4 visa and am the primary applicant for DV AOS . My case number will be current in August. We have submitted the DV Admin fee and are waiting for the receipt to send the AOS package. My visa is expiring on September 18, 2022. My spouse and I have filed our H1B(premium processing) and H4 visa renewals last week. What should we do to show the updated proof of maintaining valid status in our AOS package if:
1) We don't get our H4/H1B renewal confirmation by the time we send the AOS package.
2) My spouse gets the H1B renewal confirmation but I don't get my H4 confirmation by the time we send the AOS package.
3) Both of us get renewal confirmation (but won't have the updated visa stamped in the passport) by the time we send the AOS package.

1, 2, & 3: Nothing. Your current status is still valid as at the time of AOS filing.
