DV 2022 AOS (Adjustment of Status) Only

So I have a question related to AOS ,
My case number became current June and I applied end of April, I had my interview last week but I didn’t get a decision, the IO said my background check still not complete yet,
I was on F1 then I changed my statues to TPS after I completed my school, the thing that is concerns me is that they used my biometrics from my TPS extension application that was approved in 2020, the afterwords TPS application also used the same biometrics I took on 2020 and At this point I paid two biometrics fees without doing one, and this case still shows “Case is being actively reviewed by USCIS” which in my experience took more time than the previous times. And my case for AOS is still stuck at “Case Was Updated To Show Fingerprints We’re Taken” since I applied.
In my understanding the background check from my TPS extension application is what’s holding my AOS from DV application. My question is what would be best doing at this point, file an expedite request to poke the background check lag from previous application, or initiate congressional inquiry? Which sounds less aggressive and more understanding that this is not USCIS fault maybe it’s the third party responsible for background checks. “ the only thing changed legally on my situation is that I had a case expunged from my record to get better employment opportunities and I have submitted with my application the court document related to that case. Please advise as I have been worried since every time I read someone experience is that they most laikly getting the decision on the interview.

Your background check clearance, (regardless of if you had done a new bio or they used a previous bio tied to your TPS application), is what is holding up your AOS decision, you cannot do anything to expedite the clearance unfortunately. You just need to be patient for now.
 
Thanks for confirming. You can still go ahead and submit the I-90, as already stated/planned. There’s no charge for a USCIS “typographical error” related replacement request. USCIS will will let you know officially after reviewing the application if indeed it is a typographical error or not. Bear in mind though if it is determined to be a typographical error from their side, they will require you to send in the current GC in other for a replacement one to get issued.

Do you know by experience how long they usually take in the process? I am expecting to travel a few times in and out of the country for the next months for business so I will need to plan accordingly because I guess while they have the old card and until I don't receive the new one , I will not be able to travel, right? In the past, it’s taken between 6 to 9 months to get a replacement card (a bit longer in some cases). The solution to not having the plastic GC during the processing has been to visit the FO to obtain a temporary GC, an I-551 stamp on the passport to enable international travel. Of course you’ll need an INFOPASS appointment in order to visit the FO.
 
6 weeks after my interview, still no notice :( Someone suggested making a FOIA request since that’s probably what the IO is waiting for - wise or no?

Follow these steps first before going elsewhere:

1. Did you ask IO if your bio and KCC file was received?
2. If yes, have you initiated a tier 2 call-back request?
3. If yes, have you initiated a congressional inquiry?
4. Have you initiated an online case inquiry?

1. I haven't talked to the IO since the interview - she said she needed to wait for my official records to come before she could make a decision (she said I should receive a notice within 2 weeks).
2. I've called a lot, every agent says to wait longer.
3. Yes - no luck so far.
4. I can't submit an inquiry because it says I am within processing time - I think this is because there is no DV-based i-485 option, only family-based, employment-based, etc. which have much longer processing times.

Initiating a FOIA will not lead to a case adjudication, you can initiate one if you like though.

Your interview was on May 10th, when did you initiate the congressional inquiry and precisely what was the outcome of the inquiry? We really can’t help without having the details (albeit a concise one) of the steps taken to date.
 
Hello everyone...what a greqt group of helpful people. We are about to send our application and will add to the timeline. I have a question.
If I add my tax return to show evidence of financial support, what section of the return should I include? My current return is 60 plus pages. I don't have a W2, so it seems I should include the return, but don't want to send it all if most of it isn't relevant. Thanks for any help.

An IRS transcript solves the problem.

I submitted a congressional inquiry on June 8 and got a response a day later. They forwarded me an email from USCIS saying that my case is still under review and that they can't supply a decision date. I responded to the congressional team asking what my next steps would be and if I could expedite due to my EAD expiring, but never got a reply.

Luckily I was able to expedite my i-765 through EMMA last week and got it approved. Still super annoying that they haven't made a decision on the green card though.
 
Hey guys, I wanted to let you know that my status has changed to "New Card is Being Produced". It is odd to me that it was changed on Saturday, but hey, it should be great news hopefully! If I understand correctly, I didn't have to do fingerprints or the interview. I will update the spreadsheet early in the week because I'm traveling now.
It's still hard to believe that it's true after all these years.
From what I was told at the ASC, some of the USCIS staff work on Saturdays to resolve the backlog issues, although the offices are closed.

On June 2nd, I received the first interview letter for July 14th, and on June 4th, I received the second interview letter for July 12th. I received a cancellation letter for July 12th on June 10th. I haven't gotten any other mail from USCIS since then. Last week, I contacted a live agent on the USCIS website, who informed me that the 14th of July was canceled but the 12th was not. I attempted to contact another live representative to obtain further information. However, it seems that connecting to the live agent for the second time is not possible for me (I tried all the words like "live agent","live chat," etc., also calling 1-800-375-5283, always suggesting Emma).

BTW, in the case tracker or USCIS website account, it does not say which date is canceled, it just says interview canceled.

In summary
The first interview letter is for July 14th.
The second interview letter is for July 12th.
A live agent said that July 14th has been canceled.
The last letter from USCIS stated that July 12th has been canceled.

So here are my questions:
1- What is the most effective term or approach for connecting with a live agent?
2- Do you believe my interview will still happen on July 14th?

If your FO is saying they’re unable to make a decision one month after your interview, it most likely means your background check clearance is still pending. In that case nothing you can do, but to remain patient. Good thing you already got your EAD expedited, you can at least continue working while waiting for the GC approval.

Based on the conflicting information you now have, I suggest you show up for the July 12th appointment without saying anything about receiving a cancellation letter. If indeed, it has been canceled they will inform you and ask you to come back on the 14th for the new appointment.

I know I am extremely late to the game, but I am considering starting the AOS process for DV2022 and am after some advice.

A bit of background:
– I am currently on an E3 visa (which has only just been renewed)
– I have not received my 2NL yet
– My case number is 2022OC23##
– Currently granted green card visas for DV 2022 Oceania (OC) are sitting at 481
– Average number of granted visas for OC each year is around 850

Question:
1. Is the visa allocation for AOS associated with each area of the world? (I.e. Oceania will still only have around 850 visas?)
2. Or is it unlimited allocations when doing AOS?

3. Is it too late even to try and do this?

My concern is starting this process to only be denied if all the visas have already been allocated.

Thanks for any offer of advice.

1&2. Maximum number of visas available per region includes both CP and AOS cases.
3. There’s only one way to find out. You wouldn’t know if you don’t try.
