DV 2022 AOS (Adjustment of Status) Only

Hey Y'all. I am almost done with I-485 but I have a couple of questions. Your help is greatly appreciated.

1. Should I fill out the A-number on all top of the pages?
2. Have you EVER been denied a visa to the United States? I came here on having a student visa but I got that visa a second time. My student visa was denied on the first attempt.
3. Have you EVER violated the terms and conditions of your nonimmigrant visa? I had student visa for four years and I applied for asylum before my OPT expired.
4. Have you EVER received any type of military, paramilitary, or weapon training? Do you intend to engage in any of the activities listed in any part of item number 48a.49? As I said before, I had a few months of compulsory military services which I've never intended to attend but it's mandatory in my country to do.
5. Have you EVER served in, been a member of, assisted, or participated in any military unit, paramilitary unit, or police unit? My mandatory military service was only 3 months and it was only training and I didn't serve per see. Should I say No or Yes to the question?
6. having been unlawfully present in the United States for more than one year in aggregate? As I mentioned before, I've had F-1 status when I entered the U.S and I've applied for Asylum when I was on OPT but right now for more than a year I am waiting for my asylum interview.

1. Yes you should provide the information everywhere it asks for it. If you were filling out the form on your computer, I believe you only need to type it in once and the rest of the form (top part) will auto populate.
2. You should obviously answer YES if your first application was denied.
3. This should be a NO if you applied for asylum while you were still in a legal status.
4. I already answered this in a previous post, this should be a YES regardless of if the training was mandatory, compulsory, or voluntarily done or not.
5. Mandatory military training translates to being a member IMO. Answer YES to both 4 & 5 and provide additional details about it being mandatory training, duration, etc.
6. You're not yet accruing an unlawful presence while your asylum application is pending (since you filed while your F-1 status was still valid), you just do not have a current valid status. Answer NO.

@Sm1smom Hi, in my case I am on an F1 visa, and my wife, which is on an F2 visa won. I read the AOS package, but as my wife cannot work, she only has her bank statements. As I am the one who works as a research assistant,

1. should I include my pay stubs, taxes, etc? or it does not matter?
2. is it okay if she presents my paystubs in her package?

What's the best way you think we can handle this.

1&2: Your financial documents are applicable to both of you.

I’m sure I’ve asked some obvious answer questions but wowsers, no idea how you have the patience for us/this forum (in general).
 
Hi all,

I’m a DV2022 selectee AS8xxx.

I already sent out my AOS package on 03/01/2022 and received the NOA on 03/15/2022 I did my Biometrics on 04/18/2022. So far I haven't received any Interview Notices.

My wife is currently in Japan and is planning on doing FTJ after I complete my AOS. I added that in my cover letter hoping they would expedite the interview.

I am worried that I won't complete the interview process soon enough so that my wife can complete FTJ process. Any recommendations/advice from previous FTJs / forum members? Do you recommend contacting my congressperson now to try to expedite the process? If so how do it?

Really appreciate any help/advice.

Your case does not seem to be outside the standard processing time frame IMO. I honestly think you just need to be a bit more patient for now. However you can initiate a congressional inquiry at this point if you like. Take a look at the FAQ tab of the AOS process spreadsheet for instructions on how to contact your Congress person.

I’m always amazed by the number of people who will copy and paste a “Have you EVER…” question (keeping the “ever” emphasis), ….. and then ask if they still need to say yes to the thing in question because of when it happened ‍…

In our country, our high school diploma means that you went through 6 years of elementary school and 5 of high school,

1. would 11 years of high school be enough? we have the High school diploma/certificate

The question is would the HS diploma/certificate from your country be enough on it's own to get an admission into a US college? If the answer is yes, then you should be okay (assuming you do not have any other higher degree diploma/certificate).

As far as I have understood in the AOS package spreadsheet, my wife (F2 visa), my son (F2 visa), and I (F1 visa) should prepare the documents with our information.

1. Does each of us separate our files with binder clips? is this recommended?

Regarding the financial support part in the AOS package, as my wife cannot work, she only filed the form 8843 to the IRS, our bank accounts are separate, she has funds in her account and I have funds in mine. And I would like to add that I did my tax returns as "single" as I wasn't able to add my wife and son because of the lack of SSN/ITIN

2. Should I include paystubs, w-2, and taxes transcripts in my files? or is it only necessary for the main applicant? in this case, the main applicant is my wife.
3. If the answer to question 2 is positive, should I add my paystubs and taxes transcripts to her files or should I include them in my files?

Hello Everyone,

Just got out of my interview at the Fairfax, VA USCIS location. I got there about 10 minutes early and went through security. I then checked in at the reception and after a few minutes the officer came out and called my name. She led me to her office then proceeded to me taking an oath to tell the truth. Once that was over, she verified my identity using my ID then went through my previously submitted i-485. I was basically reiterating all of the information I had provided. Finally, she asked if there were any documents I wanted to add to my file (to which I said no) and then asked me to sign on my application. She told me that she would contact the Kansas office to validate my application which then they would release my Diversity Visa. The whole meeting took about 5 mins, I hope you find this helpful. Again, thank you all so much for the continued support and guidance in navigating this complex AOS process. I would not have made it without this forum.

1. Take a look at the "AOS Package Assemble" tab of the AOS Process Spreadsheet to get an idea of how to put your packages together.
2&3. Please use your own discretion. I already stated your financial documents are applicable to both of you, including your son by the way. You can decide if you want to separate by using each person's financial documents for their specific package or include the same set of financial documents for each package.

p.s. you need to amend your IRS tax filing. You shouldn't have filed as single if you were married during the applicable tax year. Lack of SSN/ITIN does not justify filing as single while married as there are correct ways for married people in situation such as yours to correctly fulfil their tax filing obligation.
