sertra2002 : Thats a very long time for approval..I would strongly recommend you of talking to NSC through your lawyer.
 
Frankly speaking, sertra2002, I am really tired of checking the online status everyday. Hate to see the same words on it everytime,:(. But since you are one month earlier than me, I feel much better now,:D so I decided to go out for dinner tonight!:D

I got a RFE for my I-140 (EB3, RIR) before my EAD and AP are processed. Does anyone know whether they will suspend the processing my EAD and AP until the RFE is replied and a decision is made about my I-140?
---- you are correct, I think they found something missing with I-140 or your I-140 has a concern that is the reason for RFE I think if they agree with RFE response then your I-140, EAD, AP all will be approved at the same time

So before processing EAD and AP USCIS is reviewing the I-140 petition and if they find every thing is O.K then they are approving the EAD and AP. That is the way of working and makes sense. But why we are seeing in some cases, after approving AP and EAD, USCIS issue RFE for company financial statement? Does it mean that they did not do their job properly when they reviewed for EAD and AP approval? Even if we get EAD and/or AP, we are 100% of sure that we will get our I-140 approval, without RFEs.

I feel that some thing must be corrected here.

---- Even if you got EAD, AP you can get RFE for I-140, I-140 can be approved, can be denied and they may send RFE. This is USCIS and anything can happen
 
Is it me or for everyone the times/time zone handling is messed up ???

I see Last updated 'March 3 7:24 PM,' where as it's only 1:55 CST of March 3rd..
 
Never mind... It's fixed now.. May be I wasn't logged in and that's why the env wasn't getting set properly..

mine is the same situation. NCS received my RFE response on 2/04/04 and expecting to see the approval since then. It is almost a month now...

NSC received my response to RFE on 1/27/04, but it's still pending. My RFE is a simple one and I replied the next day after I received it, expecting to see the approval in one week, but.........:confused: Anybody has the same experience with RFE?

Did you guys checked Processing time at NSC at aila.org. After months it says processing time for I-140 for EB2 8/27/03. Seems encouraging. Any comments

Here are my details for my concurrent filing:

I-140:

Receipt Date: December 4, 2003
Status: Pending

EAD:
Receipt Date: January 13th, 2004
Approval Date: February 28th, 2004

AP:

Receipt Date: January 13th, 2004
Approval Date: February 27th , 2004

I-485:

Received Date: January 13th, 2004
Status: Pending

Since I have got EAD & AP approved for me and my spouse, Do I require the extension of H1B as the secondary backup in case my I-140/ I-485 denial occur. MY six years H1B is expiring this April, 2004. Please help me with your views and suggestions, if any.

Suppose if I have to leave US after expiry of my Six years H1B, can I come back to US with L1 Visa from some Indian Company at any time? Or will I have to wait for One year in India??

RFE for company's ability to pay

I see some case got denied because applicant's educatioin background issue. But none in I-140 appeal thread becase of company's ability to pay. Does is mean as long as we provide the information required about company's ability to pay, we should be safe? My company has not made any money since its establishment in 1994. We are constantly looking for new investment but my pay is the prevailing wage mentioned in LC now. How is my chance to getting my I-140 approved given the fact that I got a RFE about company's ablility to pay?

I am pretty much sure that you will have to wait for one year once you leave after your h1 years limit.. L1 is for 5 years, and since your 6 years are completed through H1, it is not useful. however L2 visa is for 7 years, and you can add one more year, but you have to leave after one more year and come back after one year gap.. but L2 visa is given only to senior positions..
