I spoke with the woman from the DOL today and she said that she is working on applications received in Nov. So if yours was received Nov. 8th she is currently working on it now. She said she will have it all of those applications processed by Dec. 16th. And she told me to call another woman on Dec. 16th to find out your status of approval or denial. She said she could not give me an update today on your case specifically, only that she is working on cases received in November.

The bottom line is they are definately processing Nov also Jem was also mentioning the same. So yours and Prasad's cases might have already been
processed. Be aggressive man. Do not loose your time. One day makes hell lot of difference. Hope this helps you guys.

Thank you very much for your imme updates,I really appreciate your genrous info,As I saw your msg, I called imme to my Attorney and said the Above that Now they are processing Nov,SO she said as of now they didn't recieve anything ,but probably find it out with your company sometimes they will recieve first and then we,
So after she said I called up my employer and asked ,he said he will find out .

Iam done with all documentation and documents are ready,only needs to get the Experience letter from my Employer and proof of income from Aliens employer.

My DOL receive date is Oct 12th. But I am hearing some rumors, that Denver is already transforing the cases to Dallas. Is that true? Anybody has any updates please share here.

Hi Prasad,
My Federal also went on the Same Date Oct 12th ,and I haven't yet got any updates? by the way do you what is the Salary quote to be in Wyoming ,My Employer gave 34000PA to me in the Documents for designation SOftware Engineer, is that my W2 also shld have above= 34000PA,

and one more thing, Is that once Federal is cleared who will receive the documents first Either Attorney or Employer,
Pls let me know

Hi Krish,

Is that we can get as many Extensions on our H1 once State Labour is submitted (condition,only when state labour is pending for 1 year) even though our visa gets expired

Is that true?
Because I was have an idea that only we can get Extensions once only 485 is applied and it gets pending for 180 days, then only we can get Extensions

Pls let me know your valuable suggestions

Can you let us know , that once your federal is cleared and the documents has been received by your Attorney or by your Employer First ?

because I don't know whom to trust ,My attorney says it depends sometimes The Employer will receieve the documents first and then we .
is that true in your case ,Pls let us know your valuable updates.

my case, my employer has in house attorney..they will take care of GC expenses

Hi Tula/Prasad,
Did you guys see the retrogression cut off date? The cut off date is January 1st 2002. So you need to apply 140 and 485 by Dec 31st. My priorirty date was 20th December 2001 and I just got out with 11 days. My attorney is saying I will know for sure about my case by 16th of this month approved or denied? I will keep you posted.

My labor was filed on Nov 17th 2001 from Denver. Got done with the ad process. The recruitment summary has to be submitted by Dec15th.

I just called up my Attornery as usual ,There is no Updates Yet,I hope we shld get it now by this time ,I don't understand when JEm got and why we are having delays ?

Retrogression

I have been seeing messages in other threads that further retrogression may be possible. So if a 140/485 is filed considering the cutoff date at a point of time and then it retrogressed further after some time, then what happens? Would that 485 petition be processed or not?
 
Hello Krish,

You have written that your attorney is Stern and Elkind. How did they tell you that you will know about your labor petition decision by Dec 16th?

Hi Usha03,
Yes my attorney is Stern & Elkind. They did not tell anything about 16th. My HR and I tracked the denver dol number and Hr called a lady. She was very responsive and gave the details more than what we have expected. She told us to call another lady 16th to get the information about my case. So Just keeping fingers crossed. Hope this helps.

Can you give me the contact details of that person (one who was very responsive?).

Actually we (employees) cannot call them. Its your hr or attorney needs to call 303 844 1575. They wont provide you the information to us. Ask your hr to call them. I did not ask my hr who is that person is..

Hi Krish,

Now My Employer is ready to give me a Pre approved Labour for applying 140,485 before dec31 ,Iam also in thought of buying preapproved labour ,What will be your suggestion? ,If I get the Preapproved labour now,will I be in a safe side,I think now The time is also not much for us to still wait for my original Federal labour to come up and then submit,
Iam in confusion,If I buy the federal and state labour and Apply for I140 -485(before dec31'04) , will i still have any effect from the 2005 retrogression ,
If you then i think it is waste to buy the Labour now .

Pls give me your valuable advise
