Hello all I am new to this forum.
I am working as a consultant. My employer agreed to apply for my GC in KY. I have given my papers to lawyer. He said he will apply for my labor in few days. I know this employer very well. But my project may end in 1 or 2 months.

I heard I can buy labor certificate if some one has it. I want to go for it. Since my project is uncertain.
Is it required to get one more H1 to apply for I140 & 485 if I get labor clearace form someone?

If you know some one who has labor clearance I am ready to pay.

Please help me in this.

Looks DALLAS DOL is processing some December's Cases.
 
What is the phone number to talk with DOL personal I tried both these number but they are for automated phone retrievals 214-767-9384 or 214-767-4975? My case was received by DOL August 9th 02 under RIR and nothing has happened since then. Is there any other way I can go. My case was self filled by my company without the help of lawyer. Does that make any difference? Is their any way to get my labor approved fast?...:confused:

it should be 214-767-4989. Better your employer/boss/HR talk to them directly. Usually they don't talk to you in detail. if your case is classifed into problem-case, then you have to wait. some website indicates that DOL is processing June 2002 RIR-problem cases.

My case moved to Dallas mid Jan 2003. I called the Dallas Automated # and still the same update about the case being in Regional office.
Any body else has other updates to share on Dallas cases processing?

One of my friend’s NON-RIR Labor applied in Nov-2001 in Texas. His company is saying attorney is received a letter from DOL that says they need to give advertisement.

This is non-RIR case. Does non-RIR cases gets similar NOF? Does it make any sense?
 
Guys, I have a question of Labor certification. My employer makes employees pay for their Green cards. Recently I saw that a guy 'A' got his labor approved though my employer.
The employer saw an opportunity for a project and found a suitable candidate 'B' whom he hired with a promise of fast green card processing. With 'B' he is getting lot more money in comission compared to 'A'. Educational qualifications for both 'A' and 'B' are similar. Looking at labor delays 'B' wanted to leave unless employer arranged for preapproved labor and did substitution. Now my employer played a game and fired 'A' while he was still on project and used his approved labor for 'B'. I want to help 'A', since he paid almost $3,000 towards lawyer fees and application fees, waited for four years, is about 5/6 months from getting 140 cleared and now has to leave without anything to start the whole process allover from scratch. Is there a provision where he can get the approved labor application ported alongwith him or cancel it and not let the employer misuse it?
 
this works only if an employee is placed on a client site right.. ( no client to work with, there will be no salary! )

Am I right?
 
I"m not really looking for RIR. I"m very very very happy with my company! My boss is paying for the whole thing!

I was just trying to dig out more information about all this humbo jumbo crap that is moving around!

attactive title. unbelievable approach. pls shed more lights on the company and your offer details. it may either be helpful for potential candidates or labor and immigration departments

(1) No cost to you
(2) You can join any time
- before Labor filing
- after RIR Labor approval

d&b does not certify anybody. they are like credit bureau for businesses. it can provide a company financial details, lawsuit details and payment delay it made to its vendor etc. this is not helpful for potential candidates. one needs the approval of the person to access their personal credit but for business anybody can get it without a company approval.
potential candidates will feel good if all your current and past employees certifies the company in good taste.
potential candidates will be interested if you are a member of naccb and mainly if you were not investigated by the dol for labor violations.
would you be willing to give a pledge in writing that the company never violated any labor or h1 laws in the past?

(2) Worldwide employees - 65
does this count represent overall persons ever worked in the company till date or the existing employees. how many of these people hold h1 (to make the count simple and less, how many of them are non-visa holders - should not count company owners or the one who hold more than 5% of the share or control).
What does the "worldwide" represents - the company have operation in multiple nations or you employ multinational people in h1? generally "worldwide" operaton in software consulting represents 2 nations - usa and the owners native country

(3) 2003 revenues - $3.6 million does the company have direct clients? how many? end clients are not your clients.
(4) Year to date approximate revenues (Jan 1, 2004 - April 15,2004) - $1.95 million
a company may not come down to give this level of information unless there is something!!!!!

How much will be my salary?

is it hmo or ppo?
is it fully paid by the company or what percentage is potential candidates responsibilities?
the insurance may be valid (known) in all the states of america but is it acceptable? it all depends on the coverage - hmo or ppo or the hospital/clinic itself.

other questions.....
1. should the potential candidates bring their current clients to you? are you ready to protect the potential candidate from any litigation arising due to breach of contract for bringing the clients to you.
2. do you operate the company from home or commercial residential property?
3. do you have onboard marketing people? or should the candidates search for job themselves.
4. how long were you in business. who is the first revenue creating employee of the company - h1?
5. do you have (claim) international branch office or offshore development center in other country (mainly in your native place itself). if its true then is it properly registered in that country?
6. do you pay the corporate taxes on time?
7. does the company have direct deposit policy?
8. does the company have proper website?
9. last but not least: will the company provide offer letter ?

kind advice.....
do not misuse this board by posting this many messages in unrelated categories. the company seems to be more desperate to recruit h1 candidates than the potential candidates looking for so-called pre-approved labor. red flag. reg flag. red flag. the company may be genuine but the message and the number of post does not give good picture. posting date and time indicates that the company may not be in operation from commercial office space. if its posted from your home then you have mingled your personal assets with the business.
