I read some of your post, looked like you didn't use any lawyer for your Lc application...is that true?

I tried and the system told me my case number, DOT code and my received date which is April 15th, 2004. So its a long way to go. What is this DOT code.

Alan chen was charging some thing like $5,000 for the whole process (From starting paper work to getting the green card). He is quite reasonable and per housr he will charge only a minimal amount for your doubts (some thing like 30-50 $ if you are going for a consultation).

The other guy, i dont know how much he charge. For me, my company is doing with a firm in NJ and i wish i could have done it here. For those guys who applied before from my company, it was with this Jospeh Perry and all of them got everything cleared without any problems.

No My company filed my case without a lawyer. I guess that was the problem :mad:

asked the reason why they rejected it and how long you will get it.

the DOL date for dallas has moved from 12/2002 to 1/2003 (see processing times at immigration.com) Did anybody get a approval whose received date was in 12/2002??? Guys, please rise up and update the thread.

Yesterday I got my letter. The problem was in advertisment dates which were not in the 6 months from the date of application to TWC. My company talk with a lawyer and lawyer told them that they have to readvertise for 3 to 4 months and then will apply a fresh application for RIR. :confused:

1) Can we do a RIR as they have denied? As per lawyer he said that they have not denied the job description etc only the advertisment process so he said we don't have to wait 6 months and neither we need to worry about the other application which is converted back to regular, He said let that one stay their and they will file a fresh one.

Is he right? Can we do that ?

As per the DOL letter it reads as follow:

The employer request for RIR has been denied; therefore, hte employer's file has been returned to the TWC. The employer should note that this application will be processed along with other applications received on the original priority date. SINCE THE APPLICATION IS BEING RETURNED TO THE SWA TO BE PROCESSED UNDER THE BASIC PROCESS, THE EMPLOYER IS BEING OFFERED A ONE TIME OPTION OF HAVING THIS APPLICATION PROCESSED ACCORDING TO THE REMAND DATE, AS OPPOSED TO THE PRIORITY DATE :confused: (What this mean) AND IS DIRECTED TO NOTIFY THE SWA WITHIN 30 DAYS OF RECEIPT OF THIS DOCUMENT, AS TO WHICH DATE THE EMPLOYER WISHES TO USE.. (THE APPLICATION DATE IS 05-24-2004 AND WE GOT THIS YESTERDAY :( )

The employer should note that the employers min job requirment and business necessity documentation have been reviewd. It is the determination of this office that the employer has submitted sufficient documentation to support the job requirment :eek:

By the way, Did you notice, case numbers are going down instead of going up.. May be they are working on backlog.

Dallas DOL RIR cases have two category.
one is RIR-recommended cases, which they are processing those received in Jan 2003 (but I didn't find any RIR-IT-related cases got updated from AVM).
another is RIR-problem cases, which they are working on those received in August 2002 right now.

I heard when the cases transfered from TWA to DOL, either TWA classified cases as RIR-recommended case and RIR-problem cases or Dallas DOL classified them in one mintue, but no one knows the rules for classification. they will not tell you the classification of your case until they are processing the cases for your month, which is published in the DOL website.

Need Advice! Please urgent

Folks,
I have a approved labor from dallas, TX based company ,
and my present labor has moved from state level of (NH) to
federal level (boston) on 06/2004 with my present company.

I have better pay offer from the TX company and approved labor
(salary on labor is 77K).
My current company or the labor process is not bad either
(salary on labor is 62 K).

Please give me an honest opinion on what would be a good idea to do?
Take the approved labor and better pay at new company at TX or
Stick with present compnay where the labor is going thru smoothly
(i hope) based on the the difficulties one would have to face either at
Texas / Vermont service center to go thru I-140/485 i.e.,
the rest of the GC process.

I guess, you should get approval at any time as they are processing Jan 2003 cases for some time. I also saw postings about Jan approvals.. So, you can expect any time..

Does anybody has any updates on Labour backlog center? My RIR case went to Dallas DOL on Sept 12, 2003. I read in this forum that DOL has boxed up all RIR applications in anticipation of a backlog center.
When will that center be operational ?
Will I get approval this year ? :confused:
 
Labor Certification Backlog Reduction Regulation Release Imminent, 07/21/04

AILA has learned that the DOL will release this regulation probably on July 21, 2004. AILA has also obtained a copy of the regulation which will be released as the Interim Final Regulation. The regulation will be implemented in 30 days from the date of publication in the federal register. The regulation is very short and does not go into the details. The skeleton of the backlog reduction are as follows:
The Chief of Foreign Labor Certification, William Carlson, is designated as the "National Certifying Officer." This Officer has two authorities under the regulation:
Determination of which existing cases at the state offices and the regional certifying officers offices should be transferred to the national reduction processing centers, involving obviously the decision to transfer when, how, in what sequences, etc. The regulation provides that the details on this issue be stipulated and released in the form of "Directives."
National Certifying Officer will perform adjudication of certain cases which the processing centers deemed necessary because of the issues involved. These cases will be handled and decided by the National Certifying Officer.
The backlog reduction centers will perform the jobs of the current state offices and the regional certifying officers offices for the cases which are transferred to the backlog reduction center. In this regard, the backlog reduction center changes from the current two-tier (state-regional) system to one-tier system just like the upcoming PERM program operation.
The details have yet to be developed and announced by the DOL as to how this regulation will be actually implemented. It is, however, important to learn that the backlog reduction job will go into operation in a month or so from now. Good news, indeed.
