Thank you for your responses, I have contacted my lawyer and she informed me that she would be contacting the BEC and that she would take care of it

in any case check with your lawyer to get proper answers. your 45 day letter was sent recently. may be they got the response but havent had the time to update your status. My case (started with 008XXXXXX) was closed and I got just as worked up. Called my lawyer and she sent me the new case # which started with DXXXX-XXXXX. My 45 day let was sent out in first week of jan/05 and replied immediately but screen shot says case received may 05, which means there is a significant delay before update.

dude: your case received date is Jan 05 and your PD is apr 05. Which makes your case received date ear;ier than your pd. is this info correct or is there a typo?

There is something wrong. Your Filing state is Michigan & ur DOL is Chicago. All(100%) cases from Chicago were transfered fto DALLAS BEC.

No question that Philly BEC will handle your case. And if you did get something like this, your lawyer needs to contact Dallas BEC and not Philly BEC.

ICARUS is telling about analysis queue. Once case is moved from analysis it goes to CO Queue where the status of case is determined as "certified", its taking anywhere from 1 week to 2-3 months as we have seen many cases.

So yes, Alaysis must be in Feb 2003, but your case status will remain RIR for some time now.

Hope I understand correctly, ICARUS can clarify if I am misunderstanding.

pending labor - PERM filing thru other company

Hi Gurus,

My labor was applied in oct'03 eb3 and now it is with DBEC. I am going to complete my 6 yrs by Jun' 06. Now my vendor is forcing me to join thier company and they would file my labor in PERM EB2.

My question is Can they apply 140/485 without joining them after PERM approval. If so, can I join them after 140 approval by using EAD (assuiming EAD will be approved before 140). The reason for this is I don't want to file H1 again thru them.

I read from this forum that EB2 also may retrogret some time in Sep 05? Is this true? Is there any official
news on this?

Icarus, based on the above, can we say that CA - PD - Jan2003 - RIR cases are completed by DBEC. Pls comment. This is a general question which will help many of the Jan 2003 PD candidates. Thanks for your time.

This is just my understanding:
1) PERM for future employment category is dangerous=> for Proof refer PERM FAQ from this portal.But then this is always not true,might work out.
2) If labour is cleared its better to join the company before filing 140.
3) for more information post ht esame question under PERM section.

Dont worry, call your employer/attorney immiediately and explain the situation.Ask them to contact BEC and if by mistake the case is closed they will reopen the case and assign a new ETA number.But act quickly.
