Does this mean

Dallas is still working on the 4/01 cases due to heavy 245i filings in CA and TX. Occasionally, a 5/01 case will get into the queue when the 4/01 cases get worked down but a definite progression to 5/01 or later has not yet occurred. One reason this happens is cases closed prematurely by PBLS will get re-entered (generating a new D-05xxx number) and will go to the top of the queue due to the earlier PD.

That Dallas is nearly at the end of the 4/2001 cases (245i cases) in the RIR queue? If you say that occasionally you are getting into 5/2001, that means you are running out of the original bulk entered 245i cases and only the ones closed by mistake are left..

Also, here is another listing of cases pending by month.

This time I have taken out all pending cases from CA with RD (RD mind you) from May 2002 to Apr 2003 (since CA has processed or will finish whatever is left of these cases in SF DOL) but they left the 245i case alone, so I started from May 2002 RD for the excluded cases.

So now here are the new numbers, if you want more accuracy, I need to know by STATE (not regional) where the current processing of cases stands at the DOL's, please post that info and I will take those cases out of the queue.

Does these include cases at Philly or these are only for Dallas.
If philly is included you can assume 90*2 (Phily*Dallas) /day are analysed.

HI ZB

I appreciate your work, its phenomenal but I have to say I doubt few assumptions. I think you should be hearing from Dallas BEC much earlier than what you are expecting. My PD is 10/03 and I seriously doubt that I need to wait for 10-12 months to hear from BEC.
We also have to think that these are just regional cases, so I feel with my PD , I will hear by August-Sept05 and all regional should be over by Nov-Dec05.
Well I might be wrong as this is just my assumption.

in my application for RIR the lawyer didn't mention the amount of yr of experience. it just asked for MS in geotechnical engineering. when i asked my lawyer about that, he told me it will be assumed by DOL as MS+0 yr experience.is that right?would this be a problem when BPC will process my application?

and when usually an RIR application is changed to non-RIR?

As long as its MS+0 I think it should be OK! Its still good for EB2. In My case it was considered as BS+0

Icarus and ZB,
How sure are you from this? from the data available in this forum (and others) I don't see any of the BECs processing cases in respect to their PDs. for example, the latest approval we know about was to someone whose PD is Oct 2002 while others who filed before that date (including ZB and myself) are still waiting!!!

Also, according to some older posting in these forums, BEC won't start the actual processing before they finish data entering all cases by the end of summer 2005. However, I see ZB's report assuming a processing speed of 180 case/day (90 each BEC) and a start PD of April 2001. According to these assumptions, I should receive a reply around June of this year. Exactly 3 years after filling.

I pray to G-D that these data are correct but also I don't want to stick to a false hope for what troubles more than no hope is a false hope!!!

Also Icarus, GP111 and other Gurus, I need a word of wisdom regarding this situation:
My attorney filled my case as RIR/EB-3 for salary issues (of course, what else could be an issue). She told me at the time that it doesn't make any difference and indeed the case made it through the state. But now I am worried that filling under this category might screw the case up. Just a feeling but I need your honest opinion. And multiple thanks.
P.S. I am not from India, China, or Philippines.

Found this BEC update in Philly forum

This post on Murthy's site confirms that processing has started at the BPCs.
http://www.murthy.com/news/n_perbac.html
Specifically this section below :
Cases Pending at BPCs
The DOL reported that the Backlog Processing / Elimination Centers (BPCs) received approximately 250,000 pending cases by mid-March 2005. Many of these are still being data processed. A small number of BPC personnel are now processing labor certifications, though the DOL did not have a processing time estimate since the majority of the BPC personnel are still working on data entry. As of this writing, we at The Law Office of Sheela Murthy, P.C. have not received any substantive action (approval, denial, Notice of Finding) from the BPCs.

The Labor Predictor (TLP)

Based on the data by Zany_Brainy, I have created a spread sheet: Labor Predictor. You can see the estimated number of days or months remaining in your labor clearance.

Assumptions: 180 cases/day are cleared; 22 working days in a month.

Caution: All Models are wrong. Some are more useful than others

Thx.

Good prediction but...

Let me point out that the data Zany uses do NOT
include SWA cases that never made it to DOL and
therefore are not in the database. Up to May '02 your
numbers on cases are valid but after that you have to
factor in SWA cases, which will bring the number of
months up. BTW, you have done a great job on this!!!

Also don't forget the few thousands cases with PDs earlier than 01/2002 that were immaturely remanded back to state by SFO DOL (though I doubt anyone knows where they are now)

u mentioned that u filed EB-3 RIR because of wage problem. what do u mean by that? would your qualification allow u to apply un der EB-2 but u r not getting the wage for such category? is the prevaling wage that important ? i think that the PW is for future employement, so it can be paid once u get the GC. pls clarify .

she filed my case as BSc+0 experiance because the wage my company offered at that time did not meet the wages guide line. That was 3 years ago. Now I had many raises (about 30% more than the wage I started with) and I also got a US master degree

DOL estimated to clear the backlog in 24-30 months IF THEY GET ENOUGH FUNDING. They also promised to keep both RIR and TR tracks in synch.
Your prediction tells less than a year for the latest cases. So multiply the waiting time by 2 or three.
