Now I am confused

You are saying its on country of birth and the person before you says on passport, Which one is true?

And isn't it that if you are citizen of that country , you have to have that passport to come here. So which one of you is true?
Please let me know.

Country of Birth counts when applying for 485. Hence, retrogression for India doesnt matter in your case. So, in short you are LUCKY! Good Luck!!

PD= Priority Date (the date when your LC case was submitted to state )
RD= Regional Date (The data your case was submitted to FED(regional) after it got approved in state)

Hi Guys,

I have not recieved any approval about my LC, I have seen couple approvals in this forum beyond my PD date. I would really appreciate if you could let me know your suggestions and moral support.

I just thought of going and browsing the I140/I485 forums ( maybe I wanted to wander in dreamland thinking my labor is approved and I need to see what's going on in I140/I485).

Over here, we are talking 3-4 years wait for lobor as if 1 year is a small blip in the our dictionary (it is actually really a small blip for DOL/BECs). Man - this sucks really big time. I wonder if all these delays/laziness in processing is intentional. My friend told me 5 years back, the labor certification used to come in 3-4 months and Sept 11 changed it all.

Reading all this would make you think that you somehow get out of labor mess, the next stages are really nothing as compared to what we've already endured.

I do not think that the reason for delay is September 11,

I think that the real reason is opportunity for illegal people (which they got due to the life act) to apply for GC.

The second reason is money.

BTW: In 2000 I got my first labor certified just for 2 weeks,
2 weeks NOT MONTHS, in Califirnia RIR/EB3 (not special handled)
 
Yes, the information about birth country is correct. Even though your wife is an Indian citizen, the fact that she was born in a different country counts for 485.

You are eligible to use your birth country's quota if your country of citizenship quota is backlogged. I am in the same situation as your wife. Born outside India, so might be able to concurrently file 140-485 even though I am in EB3, but my PD is Dec 29, 2004, so I don't think i am gaining much at this point. Bout the Middle east, even I am not holding the passport of the country where I was born snce my parents are indian passport holders, but it doesn't matter.Your wife was born there. that's all that matters since the birth certificate is proof.

The other scenario is that one of the spouses is holding a passport other than indian, but was born in india and is married to an indian passport holder. Then also you can use the spouses non-indian passport by the Cross-changeability feature to apply for 485 in that country's quota...

this info has been verified by couple of lawyers, so relax.. enjoy.. you will be able to use your wife's country of birth

I would like to thak you all for giving me all the information you have. I really appreciate it.
I would love to accept as majority of you are saying that it is " Country of Birth" and not only on "Citizenship or Passport".
I talked to my lawyer , he did mention to me its country of birth but I wanted to confirm it.
If anybody has anything more to add, you are always wellcome.

you can't file concurrently right now - your best bet is get your papers ready though and see what the visa bulletin for Oct says! you might have to file I-140 seperately and wait for your dates to become current..

miindia,also do post your details in the Dallas BEC approval tracker as well as the Dallas BEC for Chicago cases - there are too many of these out there but oh well,this info should help someone

Sorry if this is slightly off topic.

I filed at the California Service Center in Laguna Niguel.

My H1B experience almost matches my LC frustrations.

My first 3 years of H1B expired 31st Dec 2001, My second 3 years expired 31st Dec 2004. My lawyer filed an extension in October 04, we got a notice of receipt about 21 days later, then silence. In Feb 05 CIS contacted my lawyer wanting justification for the 7th year, luckily my 45day had arrived that week and was submitted as evidence. 6 weeks later on 25th March CIS approved my application but with an expiry date of 1st Oct 2005. Just for 9 months.

This is where this forum has been so valuable to me as has the sharing of information…kudos to all.

Through the forum I learned of the “Yates memo”, got a copy and forwarded it to my lawyer. My lawyer challenged CIS, CIS agreed that 9 months was incorrect, however they wouldn’t extend that notice and I had to reapply in July. With the additional fees.

It goes to show that CIS get it wrong sometimes too.

I got the approval notice by the email subscription Tuesday morning, I haven’t seen a hard copy yet but anticipate CIS will issue a full 12 months to begin when my current expires.

Gurus/All,

As I see few applicants have received there case status as 'Final Review'.
Does anyone know, how long does it stay in this queue? I searched this forum in/out; I didn't see anyone predicted the time spent on each queue. If some of us get involved and do some homework perhaps we can come up with some approximate numbers?

If your PD is Nov'2003 and has already cleared regional then you should receive it by early 2006. I think your immigration lawyer is misleading you by telling that LC is granted within 5-6 months from the date of letter... Currently the RIR queue is somewhere in March'2003 and looking at the trend it will take another 3-4 months to reach your case.

Maybe you can tell your lawyer to join the forum and find out for himself. ;)

The Department of Labor has received your Labor Cert and sent a 45 day letter to our immigration attorney. The 45 day letter is confirmation from the DOL that they have received your Labor Cert and will begin working on it. Do you know where this take me to: Am I close to getting my labor cleared.

we are stuck in labor for so long and I know someone who applied for labor in May 05 in PERM and got the hardcopy in 25 days flat!!! he had eb2 application and applied for 140/485 and last i talked to him he had his EAD too. by now maybe he got his GC. talk about frustrating situation!! imagine getting your GC in JUST 6 months. how lucky is that!

I am also in the same situation. Atleast you got the screen shot, for me there is no info. My lawyer does not want to send the enquiry. Please let me know, when you get the approval by mail.
