case status closed

Mine existence check says "FAILED" which i obtained long back

If i understood your problem correctly

Existence check=Overridden (NO Worry they have set right s/w bug)

But If your case status = "Closed" you should immediately ask Attorney to contact DBEC as Icarus said in earlier posting.

"Closed means just that...processing has been terminated, usually for the lack of response to a 45-day letter or by employer/atty request. And they can send a letter to BEC requesting that the case be re-opened if it was closed in error."

for mnhrdc, pardesi and nov 2002

there are two separate fields, one is 'case status' and the other 'existence check' (whatever that means). anyway, my case status said 'closed' and my existence status said 'overridden'. i called my attorney and she gave me a new case number starting with Dxxxxx-xxxxx, which is more normal looking than what i had before. I have sent email this morning to dbec for another screen shot with new number. i am still waiting...
funny thing just happened. while writing this i got the screen shot email from dbec and now the case status says 'RIR' and the existence check is still 'overridden'. Hope this answers y'alls questions.
I could look into previous messages to see what does case status 'RIR' mean and how long before it is approved or one of y'all reading this could tell me. My PD is 01/31//03, EB2, RIR, TX. Dt. Submitted 05/04/2005, correction letter generated 05/04/2005, correction opitions returned 02/11/2005, correction letter printed 02/05/2005, date signed 01/23/2003. I dont know what any of that means but if someone does do share it por favor. thanks fellows

If i remeber correctly the att said they received the 45dl in first week of jan and immediatley replied to it. now immediatley could mean 1 day, 1 week or even 2 weeks. my att is an ind so you can figure.

Thanks BobbySingh,

i was trying to figure out the meaning of those dates in data review section. If you had replied the 45 day notice in early feb/05 then these dates make some relation here.

correction opitions returned 02/11/2005

thanks for your help.

I tried forwarding but there is no email body. I checked in both hotmail/gmail as an inline text/attachment - no luck.

No 45 day letter and case status "CLOSED"

Hi all,
Without receiving the 45 day letter, Is any of you are having case status "CLOSED"?

ETA CASE NUMBER: P-04320-XXXXX a valid no?

Thanks

Nov_2002,
My att was suggesting that, we should wait till we get a confirmation letter and we cannot do anything else. But, she has sent another enquiry about this.

to nagaraju: My case was closed as well

Nagaraju,

My case was closed as well, without a 45 day letter. My attorney has sent a request to reopen the case. It has been 20 days now, no reply back from DBPC.

Thanks

Sincerely,
WellWisher007

US plans 'guest workers' visa

US plans 'guest workers' visa

T V Parasuram | August 04, 2005 12:31 IST

A fresh legislation proposing a new 'guest workers' visa category that would allow foreign professionals, including Indians, to take up temporary jobs in the US, which cannot be filled from within the country, has been introduced in the Senate.

Texas Republican Senator John Cornyn introduced the bill entitled the 'Border Security and Immigration Reform Act of 2003'. The legislation is similar, but much more expansive than the H-2B temporary worker category.

The visa proposal is part of a comprehensive bill that aims to tighten American immigration system.

Apart from the visa issue, it also includes provisions to strengthen the US visit entry-exit system to identify those who enter the US illegally and those who fail to depart on expiry of their status.

"This bill strengthens enforcement and comprehensively reforms our immigration system. We need stronger enforcement and reasonable reform of our immigration laws," Cornyn, who is incidentally one of the chairs of the India Caucus in the US Congress, said while introducing the bill.

The bill has now been referred to the committee on the judiciary. It would only be available to nationals of countries that sign on to participate in the guest worker programme and which satisfy certain conditions of standards of eligibility.

A foreigner would be admitted under a new 'W' non-immigrant visa category for two years and on completion he would have to leave the US and remain in his home country for a continuous period of one year.
The total period of admission for a 'W' non-immigrant would not exceed six years.

any non-RIR cases here?

I have been reading for most of the times, and notice that not much information about non-RIR/EB2 cases.
Could anyone share your experience if you are in the same bucket?
My case was filed as non-RIR/EB2 in 06/2002 in Colorado, but have not yet received 45 day letter. Is it just me or something is wrong?

Hi Nisra -
Please forward that email response from DBEC to a hotmail account and you should be fine.

Thanks
