- Is it safe enough and advisable to leave the current GC process (labor, basically), and start afresh?
- Does MS + 5 years satisfy PERM EB2 reqs?
- Is anyone in similar situation thinking of the same? (please send me a PM if someone is in similar situation and wish to discuss)
- Could someone point me to a compiled list of disadvantages of PERM?

If I were you, I would jump to Company B. Considering your PD, it is going to be a long wait without an end just for LC. I don't believe BRC is actually reducing backlog. It is simply a creative way of manipulative governance.

NOT SAFE YET, LAWYERS ARE NOT ABLE TO UNDERSTAND PERM YET, THERE ARE 100% DENIALS IN PERM - NOT ONE APPROVAL AS YET, ALL DENIALS HAVE BEEN TECHNICAL IN NATURE SO FAR, BUT LAWYERS EXPECT TO HAVE SUBSTANTIVE DENIALS NEXT.

THEY EXPECT 6 MONTHS OF LEARNING CURVE ON PERM.

YOU DO HAVE THE LUXURY OF TIME BECAUSE OF YOUR H1-B 2+ YRS.

THEREFORE NOT SAFE, IN GENERAL BUT PROBABLY ATTRACTIVE ENOUGH AND IN YOUR CASE YOU HAVE THE ABILITY TO TAKE RISK.
- Does MS + 5 years satisfy PERM EB2 reqs?

YES - ACTUALLY BS + 5YRS PROGRESSIVE EXPERIENCE QUALIFIES FOR EB2. ONLY MASTERS OR BS+5YRS IS EB2...

I DID THINK ABOUT IT, BUT NOT READY TO TAKE THE RISK. MY 6YRS EXPIRE NEXT YEAR.

Hi LaborIL,
If I were you, I would immediately join company B. My thinking is based on the following:
1. As you have 2+ years left, going for PERM sound safe and perfect
2. As it is going to be EB2 PERM, you will come to know about the result in just few months (2 month paperwork(AD's etc) +2 months max of PERM adjudication). If in case something goes wrong, you will have enough time to correct the problem.
3. Salary is good too (a bonus)
4. Older LC process is taking a heck lot of time, not sure when it will be approved.
5. There are problems in PERM but if your lawyer is good and your employer is helping (your education and experience seems good) there shouldn't be any problem in PERM. or they should get resolved soon. They are workign to resolve all technical problems, hence by the time you r ready to file for PERM (after AD etc) you might be all fine.

Again, these is solely my thinking and presumptions....act wisely...always take second opinion. Per PERM questionnaire/FAQ there is a seperate thread that you may want to visit. Probably you might find all the answers and scary stories there.

7th year extension

You can get 7th year extension based on pending LC (provided your LC case is more then 365 days older). You would get 8th..9th.. year extension onthe same basis.

Backlog Vs PERM

Guys,

I am a silent follower of this forum , last time i posted is when i got 45 days letter from BEC.

I am not sure this issue is totally related to this forum, but some parts are.

I am with company A from last 4 years, applied for EB2/RIR labor from Texas in Nov 2002, made to regional in May 2003, replied to BEC 45 days letter on Dec 22nd 2004.

I entered 6th year of H1 in March 2005.

Questions?

1) If company B offers me new H1 and PERM processing, what are risks involved in applying 6th year H1 and PERM?

2) Company A is very flexible, I can come back to them if my labor got approved from BEC, What are risks involved in leaving A at 6th year of H1?

Any response will be greatly appreciated.

Any approvals further?

Though many members are NOT liking the approval news from other than the candidates – but are we missing potential news as there were many comments - personally I would like to see even friend’s friend news is even better than NO NEWS..now getting serious doubts about the working pace of BECs

I apologise for my foul language in previous message.

The reason I get pissed with people like GCCOVET is because this guy try to get applauds from others by calling me Hypocrite without knowing the facts.

Yes I did try to provide information which is not relevant to this portal but when some person advised me not to do so, I provide these information by personnel messages.
Even when I was requesting people not to write irrelevant messages I requested them and told them to write personnel messages. What the hell did I do wrong.
But this :mad: :mad: :mad: GCCOVET has problems of not getting recognised by people in his life so comes to this portal and try to change what I said or I did.
I won't tolerate it.
