CSC July Cases Tracker

Does anybody have idea when the July applications for EB3 - I140 & I485 ( concurrent filings will be taken up? or what would be the procedure /process in genral be?

I heard there are presently processing for April I 140!!! one of my friend got it.

My original labor was filed in May 2002. I have recived my AP/EAD on July 27th .
Actually I am in similar line as lifeislife except that i am in EB3.

please comment.....

2 LUD's on 140 app

Just fyi for the group, I have 2 LUD's (one on 11/1 and one today, 11/2) on my 140 case on uscis.gov.

Will wait till I see some emails to take next steps.

I received an email yesterday stating that an RFE was sent and more details will be available when I receive it in the mail.

I have similar dates, only I haven't filed I-765, and I-131.

I-140/I-485 concurrent, NIW
ND: 7/27/2005
LUD: 7/28/2005
Nothing afterwards.

I guess your LUDs are related to 765 and 131.

The LUD for my I140 and I485 was changed twice recently (09/06 and 09/08), but the message is not changed. I am wondering how many LUDs before the decision is made.

Anyone filed 140 and 485 in July and got approved? Thanks.
 
Details of my RFE

My lawyer emailed me today. Here are the details needed...

1. Needed my transcript for Master's degree

2. Doing Business - The USCIS wants the following documents to
establish that the company is a valid business entity:

a. Business Bank Statements for the last 12 months.
b. Color photographs of the U.S. business premises. These should show
the inside/outside of all factories, production, warehouse and office spaces with equipment, merchandise, products and employees clearly visible.
Also, include any company logos, emblems or signs displayed on buildings and products. Provide addresses, directions and telephone numbers for each facility.
c. Current valid business license (city, county, state and federal).

Ø As we begin Fiscal Year 2006, America’s long-term economic health must be at the forefront of our nation’s legislative agenda. I am writing to alert you to several issues that we believe pose a significant threat to U.S. competitiveness and economic security. Leading business and scientific organizations recently warned that the United States is in danger of losing its innovative edge. Lagging student interest in math, science and engineering, coupled with a pattern of reduced government investment in basic research in the physical sciences are troubling indicators for the future. These disturbing trends must be reversed.

Ø As we continue efforts to grow our pipeline of American scientists and engineers, we need to enable U.S. companies recruiting at U.S. universities to have access to all the graduates – including foreign students. For example, in electrical engineering, 56 percent of master’s and 66 percent of the PhD graduates of U.S. programs in 2004 were foreign students. We should open the doors wide to these talented individuals. Unfortunately, current U.S. Government policies are going in the exact opposite direction. If U.S. businesses are not able to hire or retain these employees, our overseas competitors will.

Ø The green card process also needs reform to enable employers to hire and retain the best qualified individuals in sufficient numbers. We believe that those individuals with the education, experience, knowledge and skills critical to U.S. competitiveness in the 21 st Century should be granted priority permanent resident status. Such reforms would significantly assist U.S. employers in retaining that talent, as well as alleviate the overwhelming demand for H-1B visas. USCIS’ efforts to reduce application backlogs have created another problem – unavailability of permanent visas, frequently called “green cards.” As of October 1, 2005, the State Department has set the clock backward – adding years to the wait for a green card for thousands of foreign professionals from countries such as India, China and the Philippines. The impact of the new restrictions will make it nearly impossible for these highly educated and skilled workers to gain permanent residence in the United States in the foreseeable future. Moreover, the recent unavailability of visas will force thousands of professionals to put their lives on hold, with the inability to change jobs, locations or employers.

Ø To make matters worse, many of these professionals – including researchers, scientists, teachers and engineers – will see their wait for permanent residency drag on for many more years. Our system of backlogs, delays and unpredictability is discouraging and unwelcoming, forcing many valued employees to seek employment in other nations. This is not only disruptive to U.S. employers and our economy, but exceedingly unfair to hard-working, valued members of the American workforce. Access to this talent keeps innovation and jobs in the United States. Tapping America’s Potential and the National Association of Manufacturers’ 2005 Labor Day Report are available at www.competeamerica.org and www.nam.org.

Ø The U.S. Senate passed S. 1932 which includes Section 8001 and Section 8002 to resolve the foregoing problems which this nation faces. The House bill, H.R. 4241, failed to include these important parts of the budget reconciliation legislation. Please support Sections 8001 and 8002 of S. 1932 in the conference process.

Oh sorry, I forgot to add that date to my signature. The lawyer sent the response on 12/1.

I 140 Approved.
Here is my detail.
First I 140 and 485 I filed Aug 2003 That was denied April 2005 and we decide to refile new petition.

I 140 and 485 File:
EB1C Multinational Exe.

Rd 07/06/06 ND 07/20/06
LUD:I 140. 8/25/05 case first came online.
8/27/05 (Saturday)
12/13/05 RFe issued ( may be also on 12/12 I didn't check)
Rfe mail and received 1/17/06 9.30 AM to CSC
Received email 6.15 pm on 1/18/06 Lud change message change
After that LUd change 1/19/06 morning
1/20/06 morning
1/21/06 2pm Saturday. all this without message change
again lud change on yesterday 1/25/06 1.45 pm without message change.
I worried after that what is going on.
I login in account 8.45 pm and I check 140 lud same because 25 Jan only message change and after that 15 to 20 minutes I received Email about approval. Today also lud change may be mail approval.
In a week I saw Lud game.
Anyway My case approved and all of you will approve soon.

***LUD time I check every 15 minutes.
Lets see about I 485.
I get very useful information from this forum and from all of you.
 
Can anybody help?

I got a letter from Sandia National Laboratory for my I140 RFE (NIW CSC). It is a very good letter , except for the following paragraph.

"As a manager responsible for hiring decisions, I can attest to the difficulty in finding engineers and scientists with Dr. XXX's unique qualifications. I believe that the shortage of such qualified individuals in this country amounts to a national crisis. Furthermore, because Sandia is a national security laboratory, we normally require that our employees be US citizens. Therefore, I believe, it is in the best interest of this country to support Dr. XXX's petition for permanent residency."

My laywer thinks that the above paragraph states about labor shortage and is harmful. But I think that it says about the shortage of top scientists in this field, not the "labor shortage".

Could anybody share with me your opinion. Thank you very very much.
