Like I mentioned earlier this came out of the blue! Till Nov 30, on the eve of retrogression, I had no clue what would happen. At 3.00 PM I saw the email. 3-4 days prior the IO had maintained that NC is pending. If you see my previous msg. I have mentioned my opinion on this s**t ! Do't go by the NC thing...just worry about this damn retrogrssion...remember there are lots of people, who have been placed in the queue in July/aug. Hopefully you, Nelsona and many more come out this rut fast.

Now my next goal is find a better job! Troubles never end for a man!

Confusion with Priority Dates

I recieved a forwared email from Congressman to whom I requested to check my status. The email says that " My case is 2nd preference with a priority dates of 5-4-06.It appears from the Visa bulletin for Dec'07 , that for India, Visa's are available for those 2nd preference cases with a Priority date of 1-1-02".

5-4-06 is my I485 Priority date and where as my labor priority date is 06-03-2002. I am really confused with this mail. I dunno if USCIS is considering my 485 PD as labor PD. If that is the case I am screwed up..and have to keep buzzing this USCIS.

Do any one of you any idea on this and faced with similar situation ??

When you wrote your letter to dumb politician, you of course included all the salient information, like what your priority date was, no?

Contacted local senator in June of 2007, received a letter from them in Oct 2007 stating that my namecheck was complete as of Sept 24th 2007 and the results will be fwded to USCIS

Got RFE of 485 on Nov 15th 2007
Received the RFE on Nov 21st Nov 2007 (Employment verification letter)
Responded to RFE on 30th Nov 2007
Got LUD on my case on Dec 4th stating that the evidence was received
I received regular LUDS from 4th till today

I have almost same situation like you, MY PD EB2 2003 Aug and got RFE on 21Nov as we did not submit the medical and we sent medical reports on 28th and the message change on Nov 29 saying evidence recieved and saw couple last updates after that till dec5. but nothing after that.

did you got last update every day till your message changed to card production ordered?
I m checking every day to see the message change.

The letter was written by Congressional Liason Specialist from(Dept Homeland Secuirty,USCIS,NSC) to the Congressman. They forwarded the email they recieved from Congressional Liason Specialist. They have all my information.
 
Yes I did get the LUDs till my msg changed to card ordered.

Wrong Priority Date on I 140

Here is what happened in my Case. On my I 140 approval petetion PD is mentioned as 05-04-2006 which is my I 140 notice date and Recd date. My Priority date is 06-03-2002. My I 140 was approved a year back and neither My attorney nor my self noticed the mistake on the 140 approval.I was stupidly assuming that PD is for I 140 and not a labor PD. When I got a letter from congressman saying that my PD is 05-04-2006 and visa number is not available then I called IO officer and he told my PD on I 140 is 05-04-2006. My attorney contacted NSC and requested to correct the PD and send a new petetion.

I think this will not happen to every one, but once plz check ur 140 Petetions to see the correct PD on that. Anything can happen with USCIS.

This is beyond belief. Are there ppl in EB2 still stuck from 2000? That just sounds too unbelievable!! But then its your draw of luck. I have friends who filed after me didn't, get stuck in PBEC, or those who did get in PBEC still got approved GC without hitting retrogression. I think I am getting hit hard by every roadblock in the process.

Really Sad to note all EB 2 filers, that in 2 Months Nov 07 to Jan 08 it retrogressed 4 years. We can all pray, God Please give us Strength. Every month we hope to see Ray of light but still the tunnel becomes longer.........
Only a legislation to utilize the Visa's of 1990 can help. Keep Praying...........

Just got a reply from Senator's office: FBI has replied that namecheck is still pending. Damn.

How long did it take the senator to get you the response.
I am in New Jersey state. Any idea who the best person is to contact?
President/First Lady/Senator/Congressman....
 
Do you know how much time it will take after the name check clears

Guys, I am a silent observer till date. I am one of the name check sufferrers. My PD date is OCt2002. I 485 reciept date is June 28th 2006. It's been stuckin name check for past 18 months. Recently when i called USCIS nov 20 i came to know my name check is cleared from FBI. The lady told that my case is at the officer. Today i had gone to the local office to make sure if the name check is cleared. The OI at local office told that my NC is cleared on Nov 16th and waiting for approval. Any idea how much time does this process take. It's close to a month since my NC is approved. She also told me that my finger prints are OK. But to my knowledge finger prints are valid for only 15 months and mine was given is august. Should ask to schedule for finger prints or just keep quiet?

Any suggestions? Does anyone know how much time it would take for approval?

dont say anything about your fingerprint because your fingerprint didnt expired because of uscis got your fingerprints alot later than you gave the copy.. I am definitly sure you will get approval this week

I think they should bring a legislation, saying everyone who has been here legally from the past XX years and paying taxes, just apply for citizenship with proof of your status and taxes paid!! may be collect 5k for citizen fees??
