Job Title is not as important as Job Description, my ONET LC code is 17-2072.00 and underneath of the Sample of reported job titles is says: Engineer, Electrical Engineer, Design Engineer, Product Engineer, Test Engineer, Electronics Engineer, Engineering Manager, Integrated Circuit Design Engineer (IC Design Engineer), Manufacturing Engineer, Application Engineer
This includes Engineer and Engineering Manager!!
So, in this case I think I have to come up with a combination of "RF Engineering" and "Project Manager of RF Engineering" Job Description in my new position.
- The question is, when we notify the USCIS after using the AC-21 do we really have to mention the details of Job Description and Job Title or we just say, " I am currently employed in the same field as my previous employer, ABC Inc., and in a similar position" ? Or, down the road USCIS might request an employment letter?

Could he give us some statistics? How many cases are pending? What's the average turnaround time, how many need manual intervention etc..

I think, If you don't submit a employewr letter you may get RFE & USCIS might request an employment letter. I think new job should me in similar job classification so that means you don't have to match 100% of your LC requirement to your new job as long as your new job falls under same job classification.

Getting a higher salary in your new position should not be an issue. But I believe your new job description would be different than the one that your LC is filed for. So this would disqualify you from using the old LC in the new position. So, you would need to start from scratch. If you have at least 1 year of H1B available from the first six year period, then you may want to give it a try and join the new position and do the GC processing from Perm LCA. But if you have crossed 5 years in the first 6 year of H1B period, then my suggestion would be to wait until you get GC from your current job. You may want to explain this to your new employer and ask him if the new position would be able to wait for you until you get the GC.

I got an offer with same title and duties but the salary is about 95% higher, that has a lot to do with the fact that cost of living in the new location is approx. 132% higher than where I live right now, will that difference in salary pose a problem if I invoke AC21?

Hi Nelsona and others,

While I see the point, with all due respect, I beg to differ with you. It is good to have some thing going on in the forum than to keep it so quiet.

Further, AC21 is completely relevant to I-485. With the long delays in I-485, majority may end up thinking about AC21 one day. I am learning a lot regarding that as the discussions are going on.

I totally agree, once we pass 180 days and not seeing our

approval we'll start to think about different options since NC sometimes might take more than a year.
 
Don't get me wrong, you are more then welcome here, it is just that you may get even more info quickly if you check out those other threads.
As for 180 days I have 20 more to go to get to that point. I am hoping to get the answer within these 20 days. When they go by I'll pick some other significant number like 200 to hold on to - baby steps, baby steps :rolleyes:

What is the point of having categories of threads if we can ask anything anywhere?

This is the NSC I-485 tracker thread. Not EAD, not AC21, not H1 portability, not TN renewals, not removal proceedings, not consular interviews, not the weather in southern california.

Those fine topics have their own threads.

Beleive me, you can ask the tracker that he has enough activity on his thread without any other extraneous posts. There is even a sticky to that effect.

Take a look at Murthy Forums in probably AOS and CP threads. Some with RD of 5/26/006 filed WOM and got approval. Look for disk786

If true then this is interesting case of WOM success with less than a year of waiting.

Gurus and guys who have been in this forum for a long time, could you comment on the letter to my service request:

The status of your service request is:
Service records show that your case is still pending due to backlog of cases in our system. Because of this, your case has not been assigned to an officer and a decision has not been made yet. Your case is still active and you will be notified when a decision is made.


I have never seen this kind of response in the postings here. Granted, they will tell you anything to get rid of you, but no background check is mentioned. That seems to be consistent with what the officer told me during my infopass, that my background check is completed.

What do you guys think? What do they mean by "the case is still active"? Is this the same as "waiting to be assigned to an officer" that I have seen in previous posts? How long does it take for a decision from the moment his excellency mr. officer bothers to deal with it? Anyone, any thoughts?

....that even though you were able to initiate a service request, the 30 days had not passed beyond the processing date and therefore they were able to give you the response they gave you.

I would suggest you wait until the next processing dates are published. I think that will be later this week. "definitely" next week.

If they have in fact passed the 30 days beyond your RD I would take another InfoPass trip.
 
I have filed on Dec 29 2006 and received receipt Notice with date as jan 4,2007.But still I have not received any biometrics appointment.is there anything I can worry about this or is it normal?

A gentle request. Please do not post in such big letters. I know everyone at some point of time belches out their frustration but the fonts and style of your post is at best eyestraining and I wouldn't comment on other extreme. ...

Congratulations on clearing name check. Open an offical inquiry to add to your WOM documentation.

There are people whose name checks have cleared according to Infopass and other sources (service request, senators ...) and they are still behind the processing curve. Iak65 is an example and I'd say WOM can help there. It seems actualy more straight forward then when NC is involved. It would be complaint against USCIS forcing them to make the call. They really do not seem to have excuse. They published those numbers (it seems like they are realy into fitting the 6 months time frame.
When stuck in NC you need to name FBI in your complaint so it get more comlicated.
In this particular case I have a feeling that they will resolve iak65's case within few weeks so WOM could be an overkill and extra expense but I also understend his frustration.
It it funny how USCIS is subjecting themselves to all this hustle. People are willing to throw money at WOM laywers to make things move and USCIS is going through all the commotion that must slow them down even more. Why, oh why don't they just institute premium processing, charge top top dollar for it. That is a win win solution ... But I guess it is too much to ask.
