Concurrent Filing - Using Cross Chargeability

Did the latest 'Now processing' dates for I-485 TSC go back by 1 month or am simply mistaken! :eek:

I haven't been following TSC, so I can't say for sure, but I just wanted to point out that such behavior, unfortunately, is to be expected. The massive PD movement has caused quite a few cases stuck in the service centers with RDs before ours to move ahead in line, and so I expect the "Now Processing" dates might move backwards over the next month or two. I'll be thankful if it moves only a month or two, and not more.

I too will be applying for 485 within a couple of weeks, waiting for the PERM labor to be approved :mad: . BTW i have a cover sheet for cross chargeability
i have created after going thru all the forums.If you think i need to change anything based on your past expereince pls let me know

Your cover sheet looks great. I found one official CC request form posted by one of the user from this thread itself. To be honest I didn't use it because by the time I found it my AOS was already applied.

I do see that the 485 dates at TSC have moved back a month :-( i do not think this may be due to the PD movement. PDs moving ahead will be eligible to apply only in June (since all that info came out from the June Visa bulletin) and though they can apply in hoards, us CC folks are ahead in line (that is if they move forward with the RD for our apps)
The processing center dates have to be taken with a grain of salt. I know somebody who send all the packets to TSC under CC early in Jan this year and got their physical GC last month (yes everything in 4 months).

Yes, the new people who file because their PDs became current will be behind us because of RDs, but don't forget that back in 2005 or so, before retrogression went into effect, anyone who had labor cleared could file 140/485 concurrently, so there is a bunch of people (and it may be a substantial bunch) who filed at that time with earlier RDs than us and whose cases were subsequently not processed because of retrogression. It is this group that will move ahead of us in line, not the new filers in June.

Urgent help - your comments please

Guys, I feel I will get some inputs here so I am posting my concurrent filing issue. I am using my old I140 PD (from 2000) porting with new I140/485 filing. Just now I talked with my lawyer and I am little surprised what I hear here. My I140/485 is filed in April last week with cover letter claiming old I140 PD. My I140 PP is accepted and recieved email is sent to laywer in April last week and he also received I140 receipt but has not received other I485/ead/ap receipts. So my I140 got approved and approval notice is received yesterday but it did not have my old PD. So today my laywer called back USCIS and talked, he just now said me, officer will mail again today new I140 approval notice with correct PD and expecting to get in two days. Now about I485 he is telling me, they do not have it received in USCIS data base and he say it could be misplaced. SO he suggests once we get this corrected I140 we will file again I485. But he has not received I485 packet back as rejected. But he is telling there are examples USCIS oftenly misplaces the rejected application and he him self got application sent by mistake for different attroneys. In that case I may have to again get the medical report and sign the new I485 forms ?? Do you heard this kind of things. I can't belive this ?? should i wait for another week for I485 rejected package or receipt and then decide ??

Thanks for helping me out with my doubts earlier. I have been travelling and that kept me away for awhile. I just noticed that the dates of your I-485 & other applications are pretty close to my application dates.....My lawyers have received the AP. However LUD for my EAD remains unchanged [March 10th]. I am very worried about it.

Don't worry too much yet; you are still within the statistical time limits for "normal" EAD approval (~90 days). If you don't hear about it by June 15th or so, you could make an InfoPass appt. and see if they can tell you what's going on. BTW, which service center have you filed at? NSC?
 
Confusing, please advise.

I took infopass and met an officer today. She simply saw the online status message and saying that
my security clearance is pending. And she gave me a fact sheet, asked me to read it.

My status message online is: "Review of the fingerprints taken relating to this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS has been completed. Processing of this case continues."

For my wife: "On October 29, 2003, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case."

Based on what she says so? Any idea? I requested them to approve my case using CC on May 02nd.

PD: 09/2002 (India)
Renewed 4 EAD, 4 AP. Gave 4 times FP.

Ok, do keep us updated. I'm sure it'll come through soon. Everybody has different experiences. For example, it took me over a month and a half to get FP notices, whereas almost everyone else here who filed around the same time received it within 1-2 weeks.

... also has taken a backwards leap, as expected. Now it's August 2006. If I recall right, it was up to November 2006 a couple of weeks ago. Darn.

you people rock!! Probably ks it wont be a bad idea to start an immigration consultancy as suggested by alot before...
I have been closely following this thread since last 2 weeks or so...and tried swallowing max info loaded on this thread over 128 pages....once again ks you have answered every possible answer..n still thanks alot for maintaining the tracker...
To cut the story short...I just applied for my LC EB2 and got the A# from DOL
I am definately thinking to go ahead with CC since my wife happens to be from a non-retro country
Well have nothing else that still can add to the tracker...but will surely keep you people posted!!

welcome way2gc. Just make sure your wife was "born" in a non-retro country, not just a citizen of that country

Apparently CC is more prevalent now, since the service centers haven't been overlooking CC packets and sending them back...I'm not sure what the epiphany was in the mailroom, but hopefully your case would be smooth sailing. This regression is probably attributed to the bispecialization shuffling of AOS cases, and the next regression might be due to the movement in priority dates across the EB categories. I'm at the point where, with a RD/ND of Mar/Apr 2006, I don't really think about the 'now processing' anymore.
On the good side, before the "this is not amnesty" bill gets implemented (if it does), they're stipulating that they'd clear the current AOS backlog within 8 years before working on Z visa AOS filings...so I hope to get out of this anytime between now and 2015. Splendid.

Has anyone done labor substitution for 140 using CC . Is it better to wait for the PERM labor to get approved ?

Thanks for that......but yes she is born in a non-retro country....and I do have all the supporting docs for the same viz.birth certificate,passport and also she was up there working for last 3 years...so I can also present her proof of employment..

All you need is a birth certificate. She needn't even have ever lived there since birth
