Concurrent Filing - Using Cross Chargeability

Hi All,

If all of our 485s have hit a stalemate because of H1B apps, any idea when will the H1B load get over? By Oct end?

Another question: What happened to the bi-specialization thing that was started with so much of a fan-fare in April that all immigrant-related stuff(I-140 & I-485) will get processed in TSC and NSC, while CSC and VSC will do the non-immigrat stuff?

Hope to see something on our 485s soon.

Still no response

since my Mil and FIL were born in two different countries but they lived in india for some time and then my mIL moved to singapore but my Fil could not
because of some medical reasons

Ins Cross chargability rule says that alien parents should not be residents of the country where the child is born(in this case india).

My MIL side is fine she born in singapore and lives in singapore how about my father in law who was born in burma but now lives in india.

I have another legitimate queation , how about a lady officer visiting to india and gave a birth to child
whose father is not known.( I am making ture blind love story here)

then how do they consider both parents?

no father right , what will happen in that case?

I140:: Perm regulations regarding experience with current employer

Folks,

Please help if you know the answer:

My priority date is Nov 2005 but I have been with my employer since mid 2002. So, I have about 3.5 yrs of exp. before the priority date with the current employer. Can I use this exp. in satisfying the labor requirements ?

The labor requires 3 yrs exp while I have only 1.5 yrs before joining my current employer. But if I add my exp with the current employer (who filed my PERM) before the priority date, the total exp. becomes more than 5 years. Will that work in satisfying the labor requirements?

Pururwa, yes I believe so. Did you find out what the second RFE on the 140 was for?

Folks, anyone checked out immigrationwatch.com recently? They've got a nifty little prediction page that estimates when you could potentially see an approval based on filing date and service center. I don't know what kind of an algorithm they are using to make their predictions, and I am not sure how accurate their predictions are either, but its a good way to kill a few minutes.

2nd RFE is asking to provide W-2 and paystubs for my university employments. Since its been more than 7 years, I don't have any records, neither my univ has any.
Also, My univ allowed me to work part time (20 hrs/wk) in a company. At the same time I was employed by the univ as a research assistant. CIS wants to know why I was working full time (both jobs combined) while attending the school. My univ allowed me man, what should I do?

Also, they suggest in the RFE letter that the current employer may submit a letter documenting beneficiary's exp before the priority date to satisfy I140 requirements.

Now I wanted to know if there are any restrictions on the job duties if I submit a letter from current employer. I am with this employer since mid of 2002, so I have about 3.5 years of exp before priority date with this employer.

I would double check with a lawyer.

Coz when I applied for perm my lawyer never counted the exp I had within the current company and I could use only the past experience. Not sure if this is "a normal process" or being extremely "safe" process.

Well, i did checked it out. but it was showing my approved I140 pending.


but it definitely kills time......

VSC seems to be back working on 485's the past few weeks..the approvals
so far seem to be for folks with older PD's 03/04's - maybe be they r strictly
following FIFO ?
This is pretty cool. I took a peek. If I get some free time, I'll take a stab at running it. I suspect the immigrationwatch folks use something very similar.
Yes, I've seen some approvals come through VSC of late. Why would they go FIFO now? I've seen approvals seemingly at random RDs.

my PD is 2002 and I was stuck in PBEc for a while.. and this has been one of the major discussions there..

you cannot count your exp with the filing employer as exp required by USCIS for labor... It's the prior exp you gained before joining the filing co.. Hope this helps.. However check with your lawyer on this too..

I have a PD of 03/2002.. What happened to my file!!??!! How hard is it to approve a straight forward file?? the crab they give about checks not cleared are all BS... so that we would not bug them.. What are the possibilities of all 4 of us mar filers (VSC) getting stuck in the checks??!! Only USCIS can answer..

I doubt that they have any approving system going there... They actually approve what's on their table or whatever they come across...

Their claim of FIFO is laughable... Like I said I have a PD of 2002... I should have been out of labor years ago and probablly even with GC couple of years ago... The situation in PBEC was pathetic before and when I left... I'm sure VSC is just as bad looking at our status..

Starting 140/485

Hey Guys,

I have been on this forum a couple of days back in anticipation of my labor gettin approved so I could start with my I-140/485. My labor finally got approved under EB2 after 210 days , so am all ready to start with my I-140/485.

Ill see you guys soon as I start collecting my paperwork and after I speak to my lawer!

I agree with you. Things just don't add up, especially when you see cases filed at VSC in Jan of 06 being approved. They're definitely not following any established procedures, take the example of the RFE response. Not to beat on a dead horse, but the 60 day adjudication guideline is something established by USCIS. Seems like all other service centers are meeting or exceeding those expectations. Its 74 days and counting for us today, with nary a whisper. I'd even settle for an LUD at this point.

Congrats. Make sure you ask your attorney about the 140 premium processing, if I am not mistaken it went into effect a couple of months ago.
 
How to revoke 485s ?

As most of you know We filed our 485s concurrently thru my employer. Now that my wife's I140 is approved from her employer and mine is still pending with several RFEs, we want to revoke our 485s to refile them thru my wife's side?

Please let us know if there are some specific things we have to do in order to file 485s from my wife's side.

Is there a way we can keep pending 485s alive and attach them to my wife's 140 instead of filing new 485s?

Hey All

Got our fingerprinting notices yesterday but there were a couple of things that seemed to be off the norm as I understood. First, the notices were sent to us and not to the attorney and second, there was no LUD on the case. The last and only LUD was on 8/31. Anyway, point is, nothing seems to have a pattern at all.
