Concurrent Filing I140 & I485 Nebraska Service Center

Post offlice put the last_names on the mail box .I mean just after we informed the post office. Postman put the last names.
Still i put the full names now.

Note before i got the EAD first time there were no names on the mail box...no full names or lastnames
 
AC 21 rule

Hi all:

I need some inputs from people who may know the answer. Now, I have I-140 approved. I understand that I am able to take advantage of AC 21 portibility rule after 180 days of pending I-485. I am not switching job on my own, just in case I get laid off in the future before I-485 is approved. My question is that do I have to find a job has exact function as the one I am having. For example, now I develop software for accounting application. On my Labor Cert, it is required have at least 2 years of accountuing experience. + BS in computer. My job code is 030-061-010. Can I get job develop software application for other type of application without the requirement of accounting experience ? Also, can I do the job as DBA or network engineer, both of these jobs have job classification of 030-061-010 (software Engineer)

It's possible a manager job with accounting job code in Lab Cert.
I think there will be no problem if you keep job title (manger) AND job code (account job code) in ur Lab Cert. with no change.

Hi haibo,

All that you need to ensure is that your future employer has to give you a letter discribing your job content as it is given in your approved LC. What you actually do hardly matters. It is basically your understanding with your employer. If you really find a job which is same or similar....nothing like it.

Today murthy.com has published an article on AC21 portability for concurrent filing. Go through it....looks interesting.

I was just checking the lin numbers randomly and found that one 485 application was approved yesterday,few days ago when i checked the same lin number ,it said the application received on 11/13/02 .
I don't know if INS still has the freeze on the 485 applications.

Dolly 75. The case no for 485 which you checked couldnt possibly have RD 11/15/2002. It must be 2001. Did you type the wrong year by mistake. Otherwise it would just have been approved in 4 months.
 
Dolly75 is right. I tracked LIN0303252620(the case is I485).The both systems(phone and online) say that the case has been aproved.
That's either a mistake or that fellow is some big friend of George W. Bush

Finally the good word from INS my I140 has been approved on Jan9th 2003 and the approval notice has been mailed to me. INS online system and AVM was updated yesterday.

Great News m2002 ,many congratulations on your approval.

Unfortunately I got the RFE on company's financial situation.I have no clue/information/knowledge of the company's financial statitsics.

RFE is to provide the following information:

1. My (beneficiary's 2001 and 2002 ,w-2 wage earning statments) ---I have them all

2. Petitioner's 2002,and 2001 ,federal income tax statements.

3. Copy of firm's complete annual balance sheet for calendar year 2002. --No clue

In addition sbmit evidence to establish that company had the financial ability to pay the offered wage and continue to have such a ability.




Questions:

1. I have no information about my company's financial condition.I am geeting my paycheck on time and thats what really matters to me.I know my company wasn't in a good shape .

How will this situation effect my 140 application.I have all the pay checks to confirm that I got my salary on time and there was no pay cut ,is it sufficient enuf to convience INS that company has the ability to pay my wages .Please correct if I am wrong here.


2.Recently company(31 dec 2002) is merged with a new company (has good financial condition). Please provide any pointers if that will going to impact my case.



Please provide the information,at this point of time I am totally confused and clueless.

Dolly75:
1. Provide your w2 and your pay check for the past 3 months to your lawyer
2. Ask your company to provide your lawyer with 2001 & 2002 tax returns that should be fine. (also check your I140 application and see how much is your company annual income) guess the total income should be 10 times of your salary for the I140 to be approved.
3. Getting your salary on time is a good thing and this is enough to show that your company is able to pay your specified salary
4. Company merger should not be a problem, as long as that compnay exhist it should be fine, do not worry too much about this.

Good luck and i am sure you will have your 140 approved very soon. It only takes about 2 to 3 weeks after INS receives your RFE reply to approve the case.

Congrats Manju !!!! This is excellent news indeed. So INS processing for 140 has gone back consistently. I am still waiting for EAD and AP approval. Hopefully both of us should get EAD's in the next couple of weeks.
