Concurrent Filing I140 & I485 Nebraska Service Center

My I-140 got approved on 01/03/03. No news of EAD and AP approval so far. Hopefully we all should get them by the end of the month.

Does the financial condition of the company matter in taking the decision over the 140 application.As in the RFE it clearly says that "firm has shown a net operation loss for the last 3 years"
"current liabilites are far exceeded the current assets in 2000 and 2001" .

And asking for the evidence that company had the financial abillity to pay the offered wage as of April,2001(date when I filed my LCA) and continue to have that ability,asking for submitting latest annual report etc as an evidence.

My concern is ,if the company shows the loss ,will INS consider that as company's unability to pay the offered wage? But my company always paid me on time.


Please provide my information.I have very little knowledge about this whole thing ,only think I want is my approval .

485 Processing Time

Can anyone estimate how long it will take to get I485 approved? My case was filed on August 15, 2002.
 
Hi Dolly75,

Since yours is a complicated case, instead of depending on the forum members' advise, I sincerely suggest you to take the advise of a competent attorney. This case really needs to be handled by an experianced attorney.

You have to be very careful in putting your papers together and building a strong case to win. We can say so many things with our pheripheral knowledge, but it is going to be the attorney who should play the real game for a possitive result.

Use this forum for time pass and do not take everything that is said on this forum seriously. We all say something going by our own experiances. Every case is unique in its own sence and has to be handled depending on the merits and de-merits of that perticular case. That's the precise reason why we engage an attorney for this purpose.

EAD Approved - Please update the tracker

Online status says that mine and my wife's EADs are approved today.

Concurrent Filing

RD : 09/27/02 (I-140/I-485?EAD/AP)
ND : 10/17/02 (I-140/I-485?EAD/AP)
RFE : 10/31/02 (I-140) ( Experiance and educational evaluation)
RFE reply RD : 12/19/02
AD (I-140) 01/03/03
AD (EAD) 01/14/03

EAD Approved

EAD is approved for me and for my wife online system update today.

Dolly75: My belief is that paying salary in time and bills on time (for the company) is a good sign, but i am not sure about the PL statement showing LOSS for the last 2 years. As sachdev mentioned in his post the best thing is to let the LAWYERS present it in a nice manner to INS so that your I140 will be approved wihtout any problems. Never the less having said all this i still believe that there will not be any problems good luck buddy. We will pray for your I140 approval.

Congrats Manju on getting the EAD approved. I was sleeping as usual. So aftrer seeing Manju's post that their EAD is approved I checked my case status and LO BEHOLD !!!! MY EAD GOT APPROVED TODAY ALSO.

Thanks Manju for waking me up. Now like Sachdev said the only thing to wait is the BIG DAY when 485 gets approved.

ALthough it is not fair but I really really hope that 485's for concurrent filers MAY get approved sooner than normal.

Lets see if this prediction comes true.

after approval u will get the card within 5-7 business days.

BUT..make sure u have ur name written on ur mail box. and also let post office know that u r name is so and so and u live in this address and u r expecting this mail. It would be good if u inform perosnally to the post man who drops the mail at ur place.(I am really sorry guys to bug u with this info posting over and over ...but believe me the trauma I went thru for this stupid mistake...)

m2002 - With all my sincerity thanks for your good advise,I will talk to my attorney in details.I hope he will be able to provide justice to my case. I am really happy to hear abpout your approvals, sincerely hope and wish/pray you hear something soon on your i-485 approval too.

How did INS know about the firm net operation loss etc?

I got a similar RFE but simple one 'Co. ability to Pay'. When
I talked to my attorney they told me that this is a very common
RFE for I-140 and should be an easy one to deal with.It was
approved in 4 working days after they received the reply

Dolly - Thank you. Other than wishing you good luck and praying for you, there is very little that we can do for you. I reiterate that you should very carefylly document for your RFE with your attorney's help and reply. Something tells me that your case will go through.

Parshu - I wish evewryone pays attention to what you said about mail delivery. It is very important. You know what ? When I saw your post about this first time, I immediately went to post office and gave them all the names in the family. All of us have the same last name so tha post office said that there is no need to worry. But spouses who have differant last names should take care of this. "VERY IMPORTANT INDEED".

Thanks for your wishes ,now that I have so many good folks on my side praying for me,I am confident that I will have my 140 approval soon,thanks for building that confidence.Honestly these good words really help in keeping up the morale,and I know we all are in the same boat ,just need some good luck and patience.

Thankyou very much for your response ! Your approval gives me a some hope .
I just talked to my attorney and he is saying the same thing too , that this is a very regular RFE and by providing all the information asked in the RFE we should just be fine.My attorney does good work ,so far I have no issues with him(other than just to keep pushing him all the ,but thats normal ,its a priotity for us not for them)

He sent me the copy of the RFE in the e-mail attachment.Is it possible for to provide your e-mail id ,I will sent that RFE doc to you and may be then you will be able to answer ,if mine RFE is same as yours ?
if you are not comfortable providing your e-mail id , due to some reasons, that will be fine too,I understand?

Will the online system change the status after the EAD card is approved, please let us know your experience on this parchu.

Right now the system says "approved and ordered a plastic card"
