Concurrent Filing I140 & I485 Nebraska Service Center

I-140 Receipt Notice

My I-140 (EB3) petition was filed by my Attorney last week. I'm planning to go for Concurrent filing of my I-485, EAD and AP petitions. But the Attorney says that my I-485 can only be filed after getting the "Receipt Notice" for my I-140 from NSC. How long does it take to get I-140 Receipt Notice?

No need for 140 Receipt to file 485


The word "concurrent" is self explanatory. you can file 140,485,765,131 all at one go with all appropriate documentaion and fees . but plese ensure that if your service center specifies a seperate mail address for concurrent filing. Go to the first few pages of this topic and you will be clear. May be your attorney needs Continuing Education......

I think your attorney is right, there are two ways of concurrent filing
1. File 140, 485, 765... all together in a single package
2. File 140, wait for receipt notice and then file 485... in a second package. Some people choose this due to the time taken for the 485 paperwork

I guess you come under the second category. I have done the same after getting the 140 receipt in about 2 weeks

Receipt notice of I -140 is needed to file I485 later if you want to enjoy Concurrent filing. Read the release what have been published by INS when they start concurrent filing.

I called NSC regarding my I 140 update........They told me following sentence..........

" They said the I-140 is matched up with the I 485 and is in the data entry area."

Its just a wild guess but might be they are just saying that your I 140 and I 485
ae aligned just like they would be in case of concurrent filing.

Thanks for your comment......but people got approved I 140 ,who applied I 485 while their I 140 pending ........I am just wondering.......Is any body in same boat........

From my experience, it is advisable to get your I140 approval receipt and then file I485 and things move faster.Even though the flexibility of concurrent processing does exist , we still have not seen the benefits of this option.There are my friends who filed their I140 without a concurrent processing and were approved in less than 6 weeks(one had his approval in 2 weeks) and on the other end there are concurrent filers who have been waiting since eternity to even see their I140 move.
 
I am beginninng to agree with APTIVA. I am not sure if i made the right decision by doing concurrent filing. Because just to save 2 months we are sacrificing the Portability OPTION as their are no Regulations published by INS about portability.

If we go for a job change after 6 months and then INS comes with a rule saying concurrent filers cannot use portability then basically we are screwed so I think concurrent filing is NOT the best option.

Moreover looks like INS has not approved any new 140's for quite a while now and I am not sure why. M2002 is still waiting for his approval and we are all behind him in the line.

I filed I485 based on I 149 reciept but no response yet, but i did get an rfe
my details are I 140 sep4th
rfe on oct 16th
reply to rfe recieved by ins on nov 8th
no descion yet
I hope I 140's start moving again they have almost come to a stand still
i have not seen any approvals this week

The last couple of I-140 EB-3 cases filed by my Attorney in October were approved in 10 days (!) by NSC. I know some of you have been waiting for your approvals for quite sometime. I hope they start speeding up 140 processing again...but with all the Holidays coming...it might be sometime before we see quicker approvals again. I wish you all the best in your cases.

I will post my details once I get my Receipt Notice for I-140.
 
AP approved

I thought NSC was sleeping because of holiday
But today when I saw the status of my AP, it says approved.

I140 filed RD - 08/06/02
I485 RD - 10/30/02
I140 AD - 11/21/01
FP - 12/05/02
AP AD - 12/05/02

EAD not yet approved.

u mit want to call the IIO to see the EAD status. I talked to IIO and EAD is approved on 3rd december. But the online STatus still (even now at 12/06/02 11:58 am EST)says application recieved blah..blah.....AVM is updated promptly in my case...

Is it OK to call IIO multiple times....... meaning once every two or three days?

I called INS day before yesterday and they said that my wifes EAD is still in pending status. So I was just wondering if I can call again, because I agree with Parshu INS is not updating the online status everday. My I-140 approval status was not updated for 4 days and my AP approval status was not updated until my lawyer called to inform me about my AP being approved (thats like a week).

So guys post your experiences on calling IIO many times.

I140 Status Check

Hi Friends (MNEW, HAIBO, PUNEET_GCARD & Other)

It looks like NSC is approving all the RFE cases for I140.

People who received RFE should get their approvals now.....check out the I140 NSC thread.

My I1240 status is still the same.

I do not see any approvals like you said except for one I 140 approval on dec2nd
I am still waiting I hope nsc wakes up from its festive slumber

Still it's on same status, I haven't seen any new approval for I-140. Waiting for some good news in future.
