Concurrent Filers (140/485) CSC-TSC: Waiting for 140 Approval

perm_faq and others, I've noticed that scanner reports some cases in "received" state as "Other" cases. I have a version with that fixed and updated so it does not refresh approved and withdrawn cases. Let me know if you want me to post it here ...

Actually, -refresh does not take much of time. Hardly it takes few minutes. So I think its ok even if the script polls the approved/withdrawn cases. It would be lot helpful if some one can fix or enhance the script for the following:
- It should not exit, when all the "proxies" are failed, rather it should wait ans ask for new set of proxies. That way, it saves LOT of time in creating the database.
- Masking of lower digits of WAC receipt number, with "-report" option. So we don't need to run other scripts to mask it off and re-print it.
- "-suck" option should allow multiple websites, rather than one that currently it takes.

Iam not a JAVA guy and thats why Iam helpless. Let me know if you want clear explanation, I can PM/email you.

(1) is also kinda easy, but I'm not a fan of freezing the process and waiting for an input. BTW avoding scan for the cases that are not changing will remove load from proxies. For your set (256-007) you'll need to scan ~750 cases instead of 1500. So you need 8-10 proxies instead of 18-20. For me it's not about time, it's about using proxies wisely...

I have the same RD as you do but have no clue where the application currently is. No update or email stating that my I140 has been transferred.

sorry for not being more prompt. my case was transfered from CSC to TSC on march 23, 2006. I did receive emails from USCIS that my I140 and 485 had been transfered.
 
Ok vitale. Thanks for the help. Go ahead and PM me once you are done updating scanner for 1,2,3 and not scanning approved/withdrawn cases. Fixing 1 is kind of more important, atleast for the new comers who wanted to created and run database for their cases. Ofcourse, for me/us, whatever the database I have is sufficient. To be honest, I have never found problem with proxies while -refresh the database. So its up to you, to fix for "scanning approved" cases etc.

My analysis shows that they are working in the weekends too. May be 1 or 2 adjudicators are working in the weekends.

I don't have database for 013. And you know, it takes 1 full day to create database. Please look at my other message earlier in this thread, regarding of how to run/create the database.

Can this touch of case on 20th mean that adjudicators completed there work and fed there analysis in to automatic system which generated its results on the website on 20th? Alternately there are some other group of people who handle data entry for the online system who entered the data on the relvant date? I am just seeing possibilities...
 
Certainly, we don't know or we can not predict whether the updates taking place over the weekend is really due to adjudicator or the data entry personel. But, to my knowledge, much of the data entry work is done in the initial stages when the petition is filed with CIS. That takes longer time to manually enter the data into their system. Once the case is in their system and adjudicated, it should be really quick to update the "online status" as it involves little or negligible amount of data to be entered to the system. Anyways... it is atleast the best thing to see things are moving. Correct?

Anticipated News: Premium Processing for I-140 Petitions

Although the fact that premium processing will begin was discussed in the April meeting, there was no firm indication as to when. There could be an official announcement as early as May 2006, however. It was mentioned that premium processing of I-140 petitions could mean the end of concurrent I-140/I-485 filings. Additionally, I-140s filed using the National Interest Waiver (NIW) provisions will probably not be eligible for premium processing. Presumably, this is because of the complexity of NIW cases, which means that this limitation could also be extended to somewhat similar Extraordinary Ability and Outstanding Professor / Researcher cases.

Pros and Cons of I-140 Premium Processing as Proposed
=========================================
The premium processing procedure in the nonimmigrant context has been a valuable tool in many cases. The elimination of concurrent filings would mean that certain benefits that result from concurrent filing would also end. Included among such benefits are: earlier AC21 portability, earlier Employment Authorization Document (EAD) and Advance Parole (AP) eligibility, and, for some, the ability to file the I-485 at all because of status problems that sometimes arise while awaiting an I-140 approval. The concurrent filing of I-140s/I-485s has been permitted since July 2002. As a practical matter, however, it has not been possible in many cases for the last year, since retrogression hit the EB3 category in January 2005 and moved to the EB2 and EB1 categories in October 2005. It is not clear if the proposed elimination of concurrent filing in connection with I-140 premium processing is reflective of insufficient help at the USCIS, or if it is an effort to create an incentive for those who can to use the premium processing service.

One of the greatest benefits of using premium processing for I-140 petitions may be to avail oneself of §104(c) of AC21 to obtain 3-year extensions of H1B status. Under that provision, if a beneficiary has an approved I-140 petition but cannot complete the green card process due to retrogression, s/he can apply for a 3-year extension of H1B status at the end of the six-year H1B limitation period.

1) Submit experience letters on company'S letter head.
2) Submit ability to pay from 2002 to present. I only submitted financial statements for 2003 and 2004. They asked it for 2002 also.

I40 RFE: Feb 28 th 2005 Response sent on May 15th.

My attorney didn't file I140 properly. You won't even believe if I say who my attorney is.
