Hello,
I apologize if this is the wrong forum to post this. My wife is from Peru and we just got married 2 months ago. She has permanent residence status. She came to the US under political asylum 6 years ago. Now that we are married do I have to fill out any forms to make her a citizen and how long is the wait. I also would like to find out if there is anything I can do to help her brother out as far as getting permanent resident etc. He is beyond his limit to be here so he has no papers. Thank you.

She can do it herself based on length of residence. Better than based on marriage.

As to her brother - she could have sponsored him.
Not sure how screwed he is after they didn't take any actions.

1. PRs cannot sponsor siblings - only U.S. Citizens can. So she will have to wait to sponsor him. However if he overstayed his visa and is illegal, he risks being banned.

2. Although she was granted Asylum 6 years ago doesn't mean she has been a PR for 6 years. Asylees must wait one year after getting the asylee status before they can adjust status. Also, the wait time was incredibily long for asylees to get the green card. Short answer is that she can apply either 5 years after the "PR since" date printed on her green card; or she can apply 3 years after marriage to you - which ever comes first. Now keep in mind that you are allowed to apply 90 days before either the 5 or 3 year anniversary.

don't want to doubt you, however, I do remember that when I got my GC, I could sponsor. May have been special circumstances back when - been a while (2000).

Double checking is always a good advise.

A PR can only apply to sponsor - file an I-130 application - for the following categories:
- Husband or wife;
- Unmarried child under age 21.
- Unmarried son or daughter age 21 or older

And the form I-130 is only a petition to establish the relationship to certain alien relatives who wish to immigrate to the United States. Even if approved, it does not confer PR status. One will have to wait for the visa number in the category of sponsorship to become available and then they can file a form I-485 to adjust the beneficiaries status.

Therefore as a PR, the individual in this post cannot help her brother out until she becomes a US citizen. Even then she has to file I-130 and wait until a visa number becomes available. Currently the wait times for that category is 10+ years.

My assumptions from original post are:

He is U.S. citizen, so she can apply for citizenship either three years after your marriage, or 5 years minus 90 days after she obtained her Green Card, whatever happens earlier.

The brother situation is rather hairy. My blood boils a bit when I hear politicians getting their mouths full saying that people should get at the back of the line. They never mention that for some people there is no line at all where to queue themselves, and many queues are 10+ years long :( I wish someone in the media would point this out every time a politician talks about getting at the back of the line ;)

Thanks Huracan - its good to know I am giving advice/information that is helpful. I see how you're always helpful and getting thanked by people. Most disappear once they attain their goal rather than sticking around to share wisdom.

I've been around other forums for a few years now...slowly inching my way to this forum as I got ready to become a member of the greatest country in the world! :-)

The law has been for at least 30 years that green card holders cannot sponsor silbings.

Are you saying that her brother is here unlawfully? If he is then he is for all intents and purposes not eligible for a green card under current law.

As it happens, I'm not Indian or south Asian, but I am English, and do understand the subtleties of tone in written words. This is a public forum and you were rudely questioning someone's nickname, so I called you on it.

When someone has an id like coffin dancer why does it bother you if anyone asks what it means? what is rude in that?
 
I am south asian but I indeed have a question. You can question someone's choice of handle, but when boatbod asked you about yours, you asked him to mind his language? What is good for the goose, is good for the gander.

Pardon me Sir, I made a mistake.
You are not an indian. But a pakistani. We are 2 different people.
Yes Sir, We are a different people with different history and culture. From my experiences with people from pakistan, I can tell you overall I don't have a good one. For instance:
One Pakistani invited me to her house and gave me samosas to eat. After I had eaten them, my host said She was sorry it had beef in it. Eating beef is no no in hindu culture. She had basically slapped me.
Later after talking to several Indians, I came to know She had pulled the same act with them.
That reminded me of medieval times, this trick was used to dharmbrasht - if you know what I mean.
There were other pakistanis who made fun of my religion, telling me how superior they were. I think except for 1 pakistani professor all the pakistanis I met acted all superior. They had a habit...but no worthwhile accomplishments to show.
So Sir, I don't have a very good impression from my experiences.
As for my being curious about an id like - coffindancer. I beg to say that the name itself is enough to arouse such curiousity.
Perhaps you can better explain Sir, what question arises in your mind about my id? A humble person like I am, will try to explain to the best of my knowledge, Sir.

I have no question with regards to your handle. My last post was meant to show you that boatbod was doing exactly what you did with regards to coffindancer. However I realise that my point didn't make it across to you. Good luck for the future.

now that sentence 'What kind of id is coffindancer?' is a rude way of asking someone, could be taken as 2 ways,

1. you are mocking the other person for having suchan id/handle.

or

2. you genuinely are curious to know the story behind it. then you could rephrase the question differently/politely.

I am curious about your id, if i may ask, what is coffindancer?

something like that. you get the idea.
