Please consider the following.

1. I just verified the processing time for Wisconsin, They are now processing Feb 2002 for regular and January 2002 for RIR. Either way it will not take more than 9 to 12 months to get your Labor certified.

2. Please see if there are any lay offs in your current company in the last six months. If they have any, RIR is ruled out for you. File in regular since regular LC is fater than RIR in Wisconsin.

3. How strong is your current company financially. If it is strong enough, there should be no problem.


4. Look into all other relavent things to make an informed decision.

5. Go through all the FAQs regarding LC in Immigration.com and Murthy.com

6. Discuss with your attorney all the pros and cons.

7. Don't get into money paying business for GC. You are a good consultant and you don't need to take this route to get your green card.

Good news

my case finally get certified today. The problem with
my case was all the paper related to my case was stuck
in some pile, in other words was misplaced. Finally after
keep calling my lawyer, he agreed to call DOL officer this
morning and after calling DOL officer, he found out that
my case was misplaced. DOL officer promised him to look
my case today and I just got word from my lawyer that
my case already certified and my lawyer give them fedex
account so they can send it overnight

I am feel so much release. Thanks for the encouragement
from everybody

FAQ & Tracker responsibility

Folks,
I seem to be at the bottommost of the list here (since my processing is still stuck at State labor coz of an RFE), I'll take on the responsibility of the FAQ.

wxm8 - pl check in frequently to help answer some q's in this forum.

And when jbm gets DoL approval, I can take over the tracker as well.

For umyal, I read in www.immigration-law.com that DOL suppose to publish interim or final regulation for PERM application in this month which is much much faster maybe only take 2 weeks for entire Labor Certification.You might want to consider that. Make sure you understand all the
requirement and caveat

First off...Wxm8, congrats......carry on your great work in I 140 forum.

Sachdev, Wxm8... thank you so much for looking at my case passionately as your own. I really appreciate it. WXM8, I don't think my approved labor from past company will help me in getting extension come Nov 2003. At this moment, I am ready to take the paycut to file I 140/485 by joining the DE based company. Best reason is "Peace of Mind" since the last 7 months i.e. from Jan 2002 (when I found out my ex-employer's lawyer had not filed my I 140 ) were like hell..emotionally. You know guys what I mean.. !!

Another reason is I built my own company in India from 99 which is employing 18 people now with a branch in US. Thereby I feel that there is too much at stake.. since I would loose lot of business if I leave US.

So all in all, I am going to confirm with the DE based company next week and will file I 140/485 simultaneously.

One question though, does anyone know whether you need to be on the employer's payroll before you file I 140?

Good luck to you on what ever decision you take. Since you have all the info with you it will be easier for you to make a decision.

You don't have to be an employee of your GC sponsoring company as GC is for a future job. However you have to join that company as soon as you get your GC stamped and work for them for a reasonable length of time. Reasonable length is not defined and safe time would be one year. This will save you from any complications at the time of making an application for your citizenship, if you have any intentions of becoming a citizen of America. This is the basic info that i know. A discussion with an attorney will always be a better option in these matters.

Incomplete FAQ on Labor Certification in Chicago

- Seems there are two analysts working on RIR case
- It usually takes 3 to 3.5 months for RIR cases (for most of IT) and
<B>takes about 4.5 to 5 Months for Regular cases</B>
- It usually takes about 6 to 10 days to receive Hard Copy after your case get certified
- If you running out of time in your H1-B (close to 6 years), Is possible to make a request
to DOL officer to expedite your case (give them your request and proof that you're 6 years
almost up) (USE WITH YOUR OWN RISK, I AM NOT RESPONSIBLE)

- The status is updated on 5 am from Monday to Thursday (according to official)
- Based on observation, the status SEEMS updated on 9 am Chicago Time from Monday to Thursday and seems on 9 pm on Friday afternoon also sometimes on saturday
- (Fron mnew) On every monday, Automatic Voice Message gets updated (very long update). When you call AVM and the phone keep ringing, it means AVM update is in progress

- Based on observation
when DOL officers review cases depends on DOT Code and RIR/Non RIR

for example if you are Prof / Teacher for some college/university
it gets approved very fast , within 2 weeks after RD

if you are IT related jobs, it takes about 3 to 3.5 months
for RIR

if you are chef, it takes about 3-5 months for RIR

if you are cleaner/gardener , it just take couple days after RD
because they have to wait very long time in local

and when they take RIR case, seems they follow the RD
but it depends on the officer which case # he/she wants to
review


- Currently it takes less than 1 month for your cases to be put on Automated Voice message
after Local SESA send it to Chicago

Your case has RD 4/1/2002 and today's date is August 31, 2002. When you
check AVM, AVM reported that they already process case with RD 5/1/2002, it means
that your case is about 2 weeks to 1 month behind. Please ask your lawyer to
inquiry about your status, because there are possibilities that your case
is lost or misplaced

I HAVE A QUESTION.
MY COWORKER'S RIR HAS BEEN DENIED TODAY
BY DOL CHICAGO. WE ARE A STATE GOVT INSTITUTION
AND HAVE NEVER HAD A LAYOFF.THERE MIGHT BE ADVERTISEMENT ISSUES ON HIS CASE.
MY QUESTION IS IF RIR HAS BEEN DENIED DOES IT MEAN
THE END OR DOES IT MEAN THAT THE CASE IS UNDER
REGUALAR LC.

Hi,
I have not yet got my case number from my attorney.I got my case number thru john from DOL.
I am worried why did it take so much time to send the case number to my attorney.

Expecting the same because they have cleared 054090xx series
except some 10-15. And they started 054091xx and 054092xx.
I started collecting all the documents required for filing 140 & 485.
:) :)

My case has been sent to DOL on may 8th. They told me the case number after 3 weeks.
My RD is May 14th and I got my case number in May ending or June first week! Dont worry I saw some posts saying they didnt get their case number till their case got certified.

It depends. If it said it just need RFE, then Do the best
to respond that RFE. If it gets denied and no RFE required
then RIR automatically become Regular Labor

Do not worry, if your case experience unusual delay
for example they processes case that have RD 1 month
more than you, then you should worry
