Priya,
My attorney never received case no from DOL but my case has been approved. I only tracked the status through AVM using company's phone no and found the case no from there.

Thank you very much for your information.

From the AVM I am not able to find my case.Because there are so many cases applied from my company with same DOT code.

So I called DOL officer and told my last and first name.So he gave me My case number.

Hope that number is my case number !!!!:)

Hi all,

Yesterday, I got news from my lawyer that my case has been approved. Thanks for great information on this forum, keep up the good work. See you all in I-140 + I-485 boat.

Here is my case detail:

Send to SESA: Jan 2001
Sent to Regional: April 25, 2002
Approved: August 5, 2002
Case #: 054091XX
DOT CODE: 030.162-010

My RIR Labor certification was filed at IL SESA with PD 15th April 2002. My attorney or I haven't heard anything from SESA yet eventhough the processing times website says they are processing applications received 5/20/2002.

Anyone here in the same situation? Anybody who got the case approved at SESA with the same timeframe?

Even I am in the same situation.

Mine was sent to SESA on Mar18th.Until now I didnt get any information from my attorney.
so I called DOL officer and gave my last name and firts name and then they gave me my case number.
or u can use ur compnay phone number to find out whether ur case have been moved to DOL or not.

You may want to get your attorney to give IL SESA a call.
Mine was filed Mar 15th and I too did not hear back for quite a while. It seems SESA had sent an RFE and that was the reason for the delay.

My case is denied

I called AVm,
I am getting message like RIR denied.can anyone tell me what does that message mean.

I think it is better if your lawyer gives a call to DOL. It may be due to many reasons, like of lack of proper advertising, not advertising for a long enough duration etc.

because my labour has been denied.

nbindu, Do not lost hope yet

As far as I know , They still processing case 91XX and 92XX
and as I recall , your case is 95XX

Sometimes, AVM give different answer, Please at least
triple check the AVM, make sure it is your case and you get the same message when you call AVM


Ask your lawyer to call, maybe it just some simple thing
that DOL want to change

Please check with AVM 2-3 times before doing anything.
Sometime I also hear some garbage when I check my case number with AVM, but when i check next time it's ok.

And don't worry it would be something very simple.

If you are sure about your case denied, then ask your lawyer to call DOL.

I am praying to god that the AVM shd be wrong for my case.
yes my case in 95XX.But i tried more than 3 times.I am still getting the same message.

I am so much worried abt it.

nbindu, Don't worry.

Eventhough your case has been converted to non-RIR, Chicago DOL is porcessing jan-feb 2002 cases (compare to April-may 2002 for RIR) so you only loosing 4-5 months, which you already gain time by interim rulling allowing concurently filing i-140 & i-485 (i-140 takes 3-4 months alone).

So I think you didn't loose lots of time (except if you want to do CP)

I think SESA is very long way for the non RIR cases.I think if I apply in regular now it will take 1 year in SESA and more 6 months in DOL.Even after waitinf for so long they might reject the case.

What are u telling abt 2 months.Is it for DOL.now if i want to preocess in regulat can I use my old PD of labour.

Pl let me know if u know any information.

Have you asked your lawyer whether he knows the reason
DOL reject your case ?

How much time you still have until your H1-B expired ?

I think if it convert to regular and sent it back to sesa
you will NOT loose your priority date

so if your PD is jan 2002 for your SESA RIR, when it is
back from Chicago to your local SESA, you still have your
Priority date. If Local sesa is processing Nov 2001, it is
not that bad (Depends on how much time you still have), Total
time will be 2 months (Local Sesa) + 5 months for Labor (Chicago)

Please let us know what did your lawyer say

based on Labor file more than 1 year
