I asked my lawyer to contact DOL today and inquire abt my case.hopefully he will get information tomorrow some time.

I have 1 1/2 yrs still.

My SESA is IL.now IL is processing April 2001.so I would have to wait for a long time.my PD is March 18th.so there is once yr to wait.

Did your lawyer charge seperately for your dependent AOS filing ?
Or did you file by yourself ? My lawyer now saying they will charge seprately for my dependent for i-485. is it easy to fill out their i-485/ ap/ ead ?

My lawyer charged everything :)

I think it is better for lawyer to file it for you, because of
this current economy.

Here are things that people get RFE when they apply
for I-140

Hi guys,

I have been studying the RFEs that ppl are talking about on various boards. I feel most RFEs are happening due to incomplete lawyer legwork. This is not surprising since many lawyers didn't even know about this stuff in the heydeys of 1999-2000. LC was not a problem in those days.

Most RFEs are on

1. Company financials
This is of course the biggest cause.

I know for a fact that my company lawyer spend a lot of time collecting financial info from my HR. I am not sure if he forwarded the info to INS ... I can say they at least seemed to prepare for it.

2. Signed copy of the Form ETA 750, Part B.
Some RFEs are on this, and I believe this is required for an LC substitution to prove that the substituted candidate had the same or more qualification as the original applicant on the date of filing the original LC

3. Experience certificates
I believe that this is needed for the same reason as no 2.

So guys who are doing their LC substitutions now, make sure your lawyer is doing all this legwork. If he simply goes ahead and files the 140 without any involvement from you, alarm bells should ring.

My green card process is done by my lawyer
including LC, i-140 and my i-485

But recently she send me advance bill for my wife AOS legal fee.
I know my paperwork she is going to do, but I am not sure if for dependent paperwork at i-485 stage (including fp,ap and ead) she want to charge me separately. So I was wondering is it easy to file my wife paperwork by ourself, while my lawyer will file my paperwork.

(i.e. switching companies 6months after filing I-485 ).
now with the concurrent filing how they will calculate the 180 days

What is your AVM message say ? is it still same ?

Anyway I am not sure how INS is going to interpret portability rule.
1. It's still be after filing i-485 (eventhough i-485 and i140 file concurently) or
2. may be 6 months after I-140 approval.

But if I see any posting I will let you know.

- Seems there are two analysts working on RIR case
- It usually takes 3 to 3.5 months for RIR cases (for most of IT) and takes about 4.5 to 5 Months for Regular cases
- It usually takes about 6 to 10 days to receive Hard Copy after your case get certified
- If you running out of time in your H1-B (close to 6 years), Is possible to make a request to DOL officer to expedite your case (give them your request and proof that you're 6 years almost up) (USE WITH YOUR OWN RISK, I AM NOT RESPONSIBLE)

your case, because it will irritate DOL officer and some attorneys said if they get

- The status is updated on 5 am from Monday to Thursday (according to official)
- Based on observation, the status SEEMS updated on 9 am Chicago Time from Monday to Thursday and seems on 9 pm on Friday afternoon also sometimes on saturday
- (Fron mnew) On every monday, Automatic Voice Message gets updated (very long update). When you call AVM and the phone keep ringing, it means AVM update is in progress

- Based on observation
when DOL officers review cases depends on DOT Code and RIR/Non RIR

for example if you are Prof / Teacher for some college/university it gets approved very fast , within 2 weeks after RD

if you are IT related jobs, it takes about 3 to 3.5 months for RIR

if you are chef, it takes about 3-5 months for RIR

if you are cleaner/gardener , it just take couple days after RD because they have to wait very long time in local

and when they take RIR case, seems they follow the RD but it depends on the officer which case # he/she wants to review


- Currently it takes less than 1 month for your cases to be put on Automated Voice message after Local SESA send it to Chicago

- If your case has not been processed according to time frame then make sure to
call your lawyer to inquiry about your case status, for example Your case has RD 4/1/2002 and today's date is August 31, 2002. When you check AVM, AVM reported that they already process case with RD 5/1/2002, it means that your case is about 2 weeks to 1 month behind. Please ask your lawyer to inquiry about your status, because there are possibilities that your case is lost or misplaced

Good news

My case was certified on 08/08/02
I was out of station for three days. Today I called in the AVM it is saying "certified".

I am expecting the Hard copy some time next week. Going for medicals.... Thanks a lot for all the support and advise but I will
come and participate in this as much as I can!!

Here are my case details:

Case Number : 0540957X
Went to MI SESA : 07/19/2001
Approved date in MI SESA : 05/08/2002

Received date in DOL :05/14/2002
Approved Date :08/08/2002

Going for I-140 & I-485

I think next turn to get labor certificate approval would be puneet_gcard. Have you recently check AVM Punnet_gcard ?
It should be approve with in next week or so.

And if everything work out for good then I will also join you guys in I-140 and I-485 forum in another month and half.

I am still trying to find a good forum for I-140, and I-485
so far, I find 3 forums (If you file for Nebraska Service Center)

(1) Nebraska I-140 Issue
(2) Nebraska Tracker
(3) I-485 issue

I just wonder which forum is the best for participate.
Anybody know ?
I wish there are forum that cover for Concurrent Filing I-140
and I-485 for Nebraska Service Center including all issues related to I-140 and I-485

My company is based on Columbus, Ohio. I believe there
are no openings now in my company.

I filed my application as RIR

Takes 3.5 months on Ohio SESA
Takes 4 months on Federal Chicago
