Incomplete FAQ on Labor Certification in Chicago

updated July 16, 2002

- Seems there are two analysts working on RIR case
- It usually takes 3 to 3.5 months for RIR cases (for most of IT) and
takes about 2.5 years for Regular from your receipt date
- It usually takes about 6 to 10 days to receive Hard Copy after your case get certified
- If you running out of time in your H1-B (close to 6 years), Is possible to make a request
to DOL officer to expedite your case (give them your request and proof that you're 6 years
almost up) (USE WITH YOUR OWN RISK, I AM NOT RESPONSIBLE)

We have been having trouble with our national status system.
It is being worked on, and hopefully will be backup soon.

- The status is updated on 5 am from Monday to Thursday (according to official)
- Based on observation, the status SEEMS updated on 9 am Chicago Time from Monday to Thursday and seems on
9 pm on Friday afternoon also sometimes on saturday

- Based on observation
when DOL officers review cases depends on DOT Code and RIR/Non RIR

for example if you are Prof / Teacher for some college/university
it gets approved very fast , within 2 weeks after RD

if you are IT related jobs, it takes about 3 to 3.5 months
for RIR

if you are chef, it takes about 3-5 months for RIR

if you are cleaner/gardener , it just take couple days after RD
because they have to wait very long time in local

and when they take RIR case, seems they follow the RD
but it depends on the officer which case # he/she wants to
review


- Currently it takes less than 1 month for your cases to be put on Automated Voice message
after Local SESA send it to Chicago

IL SESA RFE

Got to know from my attorneys that SESA has rasied a query on the salary. They have assured me that its a minor query and will be resolved pretty soon - expected approval date is end of Aug.

Seems AVM has not been updated since last monday

Any approval recently on 15,16 or 17 July ?

emailed one of the officer, that officer said, AVM is
updated once a week
 
Some Approval

Hi, everyone, I am new to this forum, but I can see Nanaji and wxm8 is doing great job.
While checking with AVM system, I found there was some cases certifed on July 15th and some cases they have issued the notice.
Case #05408316 was certifed on July 15th. According to AVM system they are working on April 5th cases.
 
I think DOL randomly picks the cases

I noticed one case with following inoformation.

Case # - 05408500
RD DOL-May7th 2002
Certified by DOL - May 11th 2002

Please look at FAQ

I think for that Case #, the occupation must be
Education related / labor related


hope this explain why certain cases get certified a lot faster
 
There are 9 more cases received on last week of march

There are 9 more cases received on last week of march by July 17
3 cases on 054079XX
6 cases on 054080XX

I am still waiting (I am in that 3 cases)
Hopefuly I hear good news in these 2 days
 
AVM Updates

According to AVM, I think they have certifed most of the cases before 05408349, which is dated April 3rd, I hope today they will work on April 5th cases. It looks like they are very slow this week, may be just 10-15 cases per day.
 
Ask for opinion

I think we have very excelent group here (helping each other)

one think that I like to happen , is passing information
such as FAQ and Tracker to new people if our cases
get certified and we move on.

Let me know how we going to do it :)
 
wxm8, thanks for your selflessness. I was just wondering how we can benefit from regular posters like you when you move on to I140 board. I am new here and have no experience, I will appreciate whatever you can do to make it easier for us newbies. My spouse is the one filling GC and it is in EB2-RIR, still with MI SESA. PD is 02/21/2002. Thank you.

Do you know what is your case DOT Code
There is a possibility to guess how long is going to take
if in the past , there are similar DOT Code that already get certified

I cannot compile FAQ without help from other people

I expecially thank to nanaji for his input and jbm for
his tracker and some old member such as glakes that
might be not in this list anymore


my wish list

- once the email works with DOL Chicago, I like to
all the result from email to be collected and put into
database. in that case we can kind of "guess" how long
for DOL officers to process case base on DOT code / proffesion
and we can compile list example
DOT 030.162.010 takes about 3.5 months for RIR processing
so it will help any member. All they need to do is to look
their DOT code and compare it with the list and can get
estimate time for their cases

- Asking for new volunteer to maintain FAQ / tracker when
whoever maintain it before, his/her cases get certified and
that person move on because we want these information
keep available for all new people that just joint these list

- Getting experience from other user, for example , when other
user talk to DOL officers, what can they expect and what can
they get

I think all my "wish list" is going to help because sometimes
we do not get these information from our lawyer / our company
so we have to help each other except decision for
case to get certified :)

You talked about the DOT. All these days I have given my case number to get the status. How do we use the DOT code to verify the status. Since I am fairly new to this forum, please enlighten me on this so that I keep posting the lattest info about my case.

My case number is 054091XX RD 04/26/2002 DOL Chicago. SESA MI.

You cannot realy use DOT code to verify status

You can only see pattern from all previous case that
get certified using the same DOT code

for example in the past, most cases with DOT code 030.160.010
takes about 3.5 months to get certified then you
can assume that if your DOT code is t 030.160.010 then your case will get certified approximately in 3.5 months

Thanks for the info. It really helps. My DOT code is 030.167.014. Do you think it is anywhere near a decision ?

My RD date will complete 3.5 months on 08/10/02. Can I expect a decision around that date ?
