California DOL (Regional) Tracking

Got certified

Here is some hope:

PD: 8/8/2001
DOL: 5/20/2002
NOF: 4/23/2003

The company retested the market with about 50 incoming resume or so. HR notify me that my case got certified.

I am working in a big biotech company in bay area as 151-031. E2 category. The company has lay-off several months back.

So keep your figure crossed. The waiting is painful but hope to see all you in I140/485 forum.

To give y'll a brief on my painful labor history :
Mine is a mid-size bay area company with very nominal lay-offs.
My company filed 21 cases with SWA in March 2001, all were transferred to DOL in May 2001 and DOL remanded back to state in July 2001. Everything was so fast and quick those days. Out of 21 total Labor apps 4 were remanded back to state and rest all went through fine. I am one of those 4 unlucky ones. According to lawyer all 4 applications remanded were handled by the same officer.

She said lets refile again with RIR. Wish we had continued in non-RIR rather than refiling. I guess there is something wrong with DOT code 999.151-081. I hope my application does not end up with the same office this time.

My dates kinda match with happybee but yet the AVM says status as recieved for my case. And the status was updated on Sep 2002.

Hoping for some thing better this time.

Email System

I sent out an email in the morning to check the status, and have not yet received an answer back. Sometimes the reply pops up days later, sometimes you get an answer back almost immediately... It happens so that you don't get a reply at all!
Response time varies, but I think there is someting going on today. Try again tomorrow or wait patiently.

EMail Response System not working

The DOL Email system is down for atleast two weeks now. So don't expect the response email soon. I have been sending one emaill per day since last two weeks, but no response yet.

Question to kab_ayega_gc

when your case remanded to state?
4 cases which remanded are they with the same DOT code?
did you filed immediately again in RIR if yes then is your case at state or federal.
what was reason for remanding state.

It was remanded to state in July 2001. No 2 had the same DOT codes as yours. We filed in RIR again in August 2001. No reasons given for remanding to state.

Did they give you reason for remanding to state? That will be helpful to know

The DOL Email system is working now. No change in my status though :).

Can anyone post the DOL phone number to call to check status?

Do the email system and AVM usually give the same status or can they be different?

Havn't heard from lawyers yet.

Brief Chat with SF DOL personnel

Just FYI.
I just had a brief telephonic chat with one of the SF DOL
adjucators. She told me that a lot (but NOT all) of the RIR
cases are getting remanded to state. And they are processing
August, 2002 cases.
When I asked her about the criteria for "Remand to State",
she told me that she can not discuss that with me.
I also asked her what happens when case gets remanded to
State, she asked to check with my lawyer / EDD on that.

I am just keeping my fingers crossed. My case DOL RD is in
beginning of Sept., 2002.
